This Order reinstates the requirement for a provider of a housing support service which is a care service and is paid by a local authority out of grants provided by the Scottish Ministers under the Housing (Scotland) Act 2001 (asp 10), to be registered under the Regulation of Care (Scotland) Act 2001 (asp 8). 2005 No. 322 HOUSING The Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Amendment Order 2005 Made 8th June 2005 Laid before the Scottish Parliament 9th June 2005 Coming into force 1st July 2005 The Scottish Ministers, in exercise of the powers conferred by section 91(4) of the Housing (Scotland) Act 2001 and all other powers enabling them in that behalf, and after consultation with such bodies representing local authorities and such other persons as they think fit in accordance with section 91(7) of that Act, hereby make the following Order: Citation, commencement and revocation 1 1 This Order may be cited as the Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Amendment Order 2005 and shall come into force on 1st July 2005. 2 The Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Amendment (No. 2) Order 2004 is hereby revoked. Amendment to the Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Order 2003 2 At the end of paragraph 3 of Part I of the Schedule of the Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Order 2003 insert “, and, where the service so provided is a care service, the service is registered under the 2001 Act”. This Order further amends the Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Order 2003. This Order reinstates the requirement for a provider of a housing support service which is a care service and is paid by a local authority out of grants provided by the Scottish Ministers under the Housing (Scotland) Act 2001 (asp 10), to be registered under the Regulation of Care (Scotland) Act 2001 (asp 8).

It revokes the Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Amendment Order (No. 2) 2004, which removed the above requirement for registration under the Regulation of Care (Scotland) Act 2001 (asp 8).
