Treatment) (Scotland) Act 2003<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00002" href="http://www.legislation.gov.uk/id/asp/2003/13">2003 asp 13</ref>. See section 329(1) for the definition of “regulations”.</p></authorialNote>, and of all other powers enabling them in that behalf, hereby make the following Regulations:</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation and commencement</heading><num>1.</num><content><p>These Regulations may be cited as the Mental Health (Social Circumstances Reports) (Scotland) Regulations 2005 and shall come into force on 5th October 2005.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Social circumstances report</heading><num>2.</num><intro><p>A social circumstances report shall set out the following information, where it is relevant to the care of the patient–</p></intro><level class="para1" eId="regulation-2-a"><num>(a)</num><content><p>the reasons for the use of compulsory powers;</p></content></level><level class="para1" eId="regulation-2-b"><num>(b)</num><content><p>the views of the patient with respect to the use of compulsory powers;</p></content></level><level class="para1" eId="regulation-2-c"><num>(c)</num><content><p>if the patient is unable to give a view, and only if available to the mental health officer, the views of the patient’s named person, carer, guardian and welfare attorney with respect to the use of compulsory powers;</p></content></level><level class="para1" eId="regulation-2-d"><num>(d)</num><content><p>the patient’s state of mental health;</p></content></level><level class="para1" eId="regulation-2-e"><num>(e)</num><content><p>the patient’s state of physical health;</p></content></level><level class="para1" eId="regulation-2-f"><num>(f)</num><content><p>the patient’s mental health history;</p></content></level><level class="para1" eId="regulation-2-g"><num>(g)</num><content><p>an assessment of the risk of harm to the patient and to others;</p></content></level><level class="para1" eId="regulation-2-h"><num>(h)</num><content><p>the patient’s personal history including details of employment, finances and accommodation prior to the use of compulsory powers;</p></content></level><level class="para1" eId="regulation-2-i"><num>(i)</num><content><p>details of the patient’s family situation including whether the patient has children, dependents and caring responsibilities;</p></content></level><level class="para1" eId="regulation-2-j"><num>(j)</num><content><p>details of the patient’s regular social contacts;</p></content></level><level class="para1" eId="regulation-2-k"><num>(k)</num><content><p>the patient’s ability to care for himself or herself;</p></content></level><level class="para1" eId="regulation-2-l"><num>(l)</num><content><p>the care being provided to the patient prior to the use of compulsory powers;</p></content></level><level class="para1" eId="regulation-2-m"><num>(m)</num><content><p>any matters which would require the local authority to make inquiries into the patient’s case under section 33 of the Mental Health (Care and Treatment) (Scotland) Act 2003;</p></content></level><level class="para1" eId="regulation-2-n"><num>(n)</num><content><p>any alternatives to the use of compulsory powers which were considered and ruled out;</p></content></level><level class="para1" eId="regulation-2-o"><num>(o)</num><content><p>any history of offending, including consideration of victims and those affected;</p></content></level><level class="para1" eId="regulation-2-p"><num>(p)</num><content><p>any history of substance misuse;</p></content></level><level class="para1" eId="regulation-2-q"><num>(q)</num><content><p>ethnic, cultural and religious factors;</p></content></level><level class="para1" eId="regulation-2-r"><num>(r)</num><content><p>whether the patient has difficulty in communicating; and</p></content></level><level class="para1" eId="regulation-2-s"><num>(s)</num><content><p>any plan which has been put in place to deal with any of the above.</p></content></level></hcontainer><hcontainer name="signatures"><hcontainer name="signatureBlock"><content><block name="signature"><signature refersTo="#">RHONA BRANKIN</signature></block><block name="role"><role refersTo="#">Authorised to sign by the Scottish Ministers</role></block><blockContainer class="address"><p><location refersTo="#">St Andrew’s House, Edinburgh</location></p></blockContainer><block name="date"><date date="2005-06-06">6th June 2005</date></block></content></hcontainer></hcontainer></body><conclusions><blockContainer class="explanatoryNote"><subheading>(This note is not part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>These Regulations prescribe the contents of a social circumstances report which is provided for in section 231 of the <ref eId="c00001" href="http://www.legislation.gov.uk/id/asp/2003/13">Mental Health(Care and Treatment) (Scotland) Act 2003, asp 13</ref>.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
