The Wildlife and Countryside Act 1981 (Variation of Schedule) (Scotland) Order 2005

The Scottish Ministers, in exercise of the powers conferred on them by section 22(1)(c) of the Wildlife and Countryside Act 19811, and of all other powers enabling them in that behalf, having consulted with Scottish Natural Heritage in accordance with section 22(2A) of that Act, and having given any local authority affected and any other person affected an opportunity to submit objections or representations with respect to the subject matter of this Order in accordance with section 26(4)(a) of that Act, hereby make the following Order:

Citation, commencement and extent1.

(1)

This Order may be cited as the Wildlife and Countryside Act 1981 (Variation of Schedule) (Scotland) Order 2005 and shall come into force on 30th June 2005.

(2)

This Order extends to Scotland only.

Variation of Schedule 92.

The following plants are added to Part II of Schedule 9 to the Wildlife and Countryside Act 1981–

This Order, which applies in Scotland only, varies Part II of Schedule 9 to the Wildlife and Countryside Act 1981, by adding thirteen species of plant to the list of species of plants which may not be planted or otherwise caused to grow in the wild.
