Application of fertilisers and waste to land set aside for the provision of non-food crops

1.

Subject to paragraph 2, a farmer shall not apply any fertiliser or waste to land set aside for the provision of non-food crops.

A farmer may apply fertiliser or waste to the set-aside land for the provision of non-food crops only to the extent that–

(a)

if it is necessary to do so in order to ensure the proper growth of the non-food crops being produced on it; and

(b)

in a manner which is consistent with the Code of Good Practice for the Protection of Environmental Pollution from Agricultural Activity, approved by the Water (Prevention of Pollution) (Code of Practice) (Scotland) Order 200545.
