Section 2(2) was amended by the Scotland Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c. 46)</ref>, Schedule 8, paragraph 15(3). The function conferred upon the Minister of the Crown under section 2(2) of the European Communities Act 1972, insofar as within devolved competence, was transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998.</p></authorialNote>, and of all other powers enabling them in that behalf, hereby make the following Regulations:</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation, commencement and extent</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Salmonella in Laying Flocks (Sampling Powers) (Scotland) Regulations 2004 and shall come into force on 14th January 2005.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations extend to Scotland only.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><intro><p>In these Regulations–</p></intro><hcontainer name="definition"><content><p>“the Commission Decision” means Commission Decision <ref eId="c00001" href="http://www.legislation.gov.uk/european/decision/2004/0665">2004/665/<abbr class="acronym" title="European Community">EC</abbr></ref> dated 22nd September 2004<authorialNote class="footnote" eId="f00002" marker="2"><p>O.J. <abbr title="Number">No.</abbr> L 303, 30.9.04, p.30.</p></authorialNote> concerning a baseline study on the prevalence of salmonella in laying flocks of <i>Gallus gallus</i>;</p></content></hcontainer><hcontainer name="definition"><content><p>“faecal and environmental material” means faeces from laying hens, or dust or other material which may have come into contact with such faeces or with laying hens, or a mixture of such faeces and such dust or other material;</p></content></hcontainer><hcontainer name="definition"><content><p>“inspector” means an inspector appointed by the Scottish Ministers or by a local authority for the purpose of these Regulations;</p></content></hcontainer><hcontainer name="definition"><content><p>“laying hen” means any bird of the species <i>Gallus gallus</i> that produces eggs for human consumption;</p></content></hcontainer><hcontainer name="definition"><content><p>“local authority” means a council constituted under section 2 of the Local Government <abbr title="et cetera" xml:lang="la">etc.</abbr> (Scotland) Act 1994<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00005" href="http://www.legislation.gov.uk/id/ukpga/1994/39">1994 c. 39</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“person” in regulations 4(1)(f) and 7(1) does not include a body corporate or a partnership;</p></content></hcontainer><hcontainer name="definition"><content><p>“premises” includes land with or without buildings but does not include any place used only as a dwelling;</p></content></hcontainer><hcontainer name="definition"><content><p>“the Technical Specifications” means those technical specifications referred to at Article 5 of the Commission Decision as having been presented to the European Commission’s Standing Committee on the Food Chain and Animal Health on 15th July 2004 and which are entitled “Baseline Study on the Prevalence of <i>Salmonella</i> in Laying Flocks of <i>Gallus gallus</i> in the <abbr class="acronym" title="European Union">EU</abbr> – Technical Specifications”.</p></content></hcontainer></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Selection of Premises</heading><num>3.</num><content><p>The Scottish Ministers shall be responsible for selection of premises for sampling for the purposes of the Commission Decision.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Powers of inspectors</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><intro><p>An inspector for the purposes of the Commission Decision and in accordance with the Technical Specifications shall, on giving notice in writing to the occupier or person in charge of premises selected in terms of regulation 3 for sampling and on producing, if requested, some duly authenticated document showing that inspector’s authority, have the right to–</p></intro><level class="para1" eId="regulation-4-1-a"><num>(a)</num><content><p>enter at all reasonable hours those premises;</p></content></level><level class="para1" eId="regulation-4-1-b"><num>(b)</num><content><p>make inquiries of any person (whether on those premises or not);</p></content></level><level class="para1" eId="regulation-4-1-c"><num>(c)</num><content><p>examine, retain or copy any records including computerised records which may appear to that inspector to be relevant;</p></content></level><level class="para1" eId="regulation-4-1-d"><num>(d)</num><content><p>take and retain such samples, including samples of faecal and environmental material, as well as any other samples that that inspector considers necessary;</p></content></level><level class="para1" eId="regulation-4-1-e"><num>(e)</num><content><p>be accompanied by such vehicles and equipment as that inspector considers necessary;</p></content></level><level class="para1" eId="regulation-4-1-f"><num>(f)</num><content><p>be assisted by such other persons as that inspector considers necessary; and</p></content></level><level class="para1" eId="regulation-4-1-g"><num>(g)</num><content><p>require the occupier or person in charge of those premises or any employee or agent of that occupier or person to provide such assistance, co-operation, information and documentation including records, computerised or otherwise, as may reasonably be required by that inspector.</p></content></level></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><content><p>Nothing in paragraphs (1)(b) or (g) shall be construed as requiring any person to answer any question or give any information if to do so might incriminate that person.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Notices</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><intro><p>A notice in writing to be given to any person under regulation 4(1) may be given–</p></intro><level class="para1" eId="regulation-5-1-a"><num>(a)</num><content><p>by delivering it to that person; or</p></content></level><level class="para1" eId="regulation-5-1-b"><num>(b)</num><content><p>by leaving it, or sending it in a pre paid envelope addressed to that person, at the usual or last known place of business or residence of that person, or in the case of a body corporate or partnership at any place of business or the registered office of that body corporate or partnership.</p></content></level></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><content><p>A notice in writing given under regulation 4(1) may be sent to a person as an electronic communication (as defined in the Electronic Communications Act 2000<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/2000/7">2000 c. 7</ref>.</p></authorialNote>), only if that person has consented to the use of that method of communication.</p></content></paragraph><paragraph eId="regulation-5-3"><num>(3)</num><content><p>A notice in writing sent to a person as an electronic communication shall be regarded as sent when the text of it is received in a legible form.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Offences</heading><num>6.</num><paragraph eId="regulation-6-1"><num>(1)</num><intro><p>Any person who–</p></intro><level class="para1" eId="regulation-6-1-a"><num>(a)</num><content><p>intentionally obstructs an inspector or any person assisting an inspector acting in the execution of these Regulations;</p></content></level><level class="para1" eId="regulation-6-1-b"><num>(b)</num><content><p>knowingly provides to an inspector or any person assisting an inspector acting in the execution of these Regulations any information which is false or misleading; or</p></content></level><level class="para1" eId="regulation-6-1-c"><num>(c)</num><content><p>without reasonable cause, fails to produce a record or other information when required to do so to an inspector or any person assisting an inspector acting in the execution of these Regulations,</p></content></level><wrapUp><p>shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 5 on the standard scale.</p></wrapUp></paragraph><paragraph eId="regulation-6-2"><num>(2)</num><intro><p>If any person–</p></intro><level class="para1" eId="regulation-6-2-a"><num>(a)</num><content><p>fails to comply with any other requirement imposed on that person under these Regulations; or</p></content></level><level class="para1" eId="regulation-6-2-b"><num>(b)</num><content><p>contravenes any prohibition contained in these Regulations,</p></content></level><wrapUp><p>that person shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 3 on the standard scale.</p></wrapUp></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-7"><heading>Corporate bodies and partnerships</heading><num>7.</num><paragraph eId="regulation-7-1"><num>(1)</num><intro><p>Where a body corporate or a partnership is guilty of an offence under these Regulations, and that offence is proved to have been committed with the consent or connivance of, or to have been attributable to any neglect on the part of–</p></intro><level class="para1" eId="regulation-7-1-a"><num>(a)</num><content><p>any director, manager, secretary or other similar officer of the body corporate;</p></content></level><level class="para1" eId="regulation-7-1-b"><num>(b)</num><content><p>any person who was purporting to act in any such capacity; or</p></content></level><level class="para1" eId="regulation-7-1-c"><num>(c)</num><content><p>in the case of a partnership, a partner or any person who was purporting to act as such,</p></content></level><wrapUp><p>any such person, as well as the body corporate or partnership, shall be guilty of the offence and be liable to be proceeded against and punished accordingly.</p></wrapUp></paragraph><paragraph eId="regulation-7-2"><num>(2)</num><content><p>For the purposes of paragraph (1), “director”, in relation to a body corporate whose affairs are managed by its members, includes a member of the body corporate.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-8"><heading>Enforcement</heading><num>8.</num><paragraph eId="regulation-8-1"><num>(1)</num><content><p>These Regulations shall be executed and enforced by the local authority except where otherwise provided.</p></content></paragraph><paragraph eId="regulation-8-2"><num>(2)</num><content><p>The Scottish Ministers may direct, in relation to cases of a particular description or a particular case, that any duty imposed on a local authority under paragraph (1) shall be discharged by the Scottish Ministers and not by the local authority.</p></content></paragraph></hcontainer><hcontainer name="signatures"><hcontainer
