The Tenements (Scotland) Act 2004 (Commencement No. 1) Order 2004

The Scottish Ministers, in exercise of the powers conferred by section 34(2) of the Tenements (Scotland) Act 2004(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation

1.  This Order may be cited as the Tenements (Scotland) Act 2004 (Commencement No. 1) Order 2004.

Commencement of provisions

2.—(1) The day appointed for the coming into force of the following provisions of the Tenements (Scotland) Act 2004 is 28th November 2004–

(a)sections 1 to 12;

(b)section 13, except subsection (6);

(c)sections 14 to 17, 19 to 24, 26 to 30 and 33; and

(d)schedules 1 to 3

(2) The day appointed for the coming into force of sections 13(6), 31 and 32 of the Tenements (Scotland) Act 2004 is 10th November 2004.

Explanatory Note

(This note is not part of the Order)

This order appoints 28th November 2004 as the date for the coming into force of sections 1 to 12, 13, except subsection (6), 14 to 17, 19 to 24, 26 to 30 and 33 and schedules 1 to 3 of the Tenements (Scotland) Act 2004 (“the 2004 Act”). This Order appoints 10th November 2004 as the date of coming into force of sections 13(6), 31 and 32 of the 2004 Act.

The 2004 Act received Royal Assent on 22nd October 2004. Section 34 came into force on Royal Assent. Section 25 and schedule 4 to the 2004 Act came into force on the day after Royal Assent.
