(This note is not part of the Regulations)

These Regulations make provision for the purposes of and in connection with the allocation of property held by the Scottish Hospital Trust (“the Trust”), which is to be dissolved, to Health Boards.

Regulations 2 and 3 provide for the how the Trust property is to be realised and divided between Health Boards.

Regulation 4 provides for the division of property held on behalf of any Health Board or NHS trust in accordance with the share specified in the Schedule.

Regulation 5 provides for the methods of valuation of Trust property.

Regulation 6 provides a method by which the final expenses and liabilities of the Trust are to be met should the Trust have insufficient funds to meet them.

Regulation 7 provides for the submission to the Scottish Ministers of final accounts, and deposit of records of the Trust in the National Archives of Scotland.

The Schedule provides for the percentage share which each Health Board is to receive in the Trust property.
