The National Health Service Reform (Scotland) Act 2004 (Commencement No. 2) Order 2004
Citation1.
This Order may be cited as the National Health Service Reform (Scotland) Act 2004 (Commencement No. 2) Order 2004.
Appointed day2.
The days appointed for the coming into force of the following provisions of the National Health Service Reform (Scotland) Act 2004 are:–
(a)
1st September 2004, for:–
(i)
(ii)
section 2, but only for the purpose of enabling the Scottish Ministers to make regulations under section 4B(6) of the 1978 Act;
(b)
30th September 2004, for:–
(i)
sections 1(2) and (3), 3, 4, 5, 6 and 7;
(ii)
section 2, so far as it is not already in force;
(iii)
section 11(1), so far as relating to schedule 1, paragraph 1(1), (2), (3) and (6); and
(iv)
schedule 1, paragraph 1(1), (2), (3) and (6);
(c)
1st January 2005, for section 9; and
(d)
1st February 2005, for section 8.

This Order brings into force the following provisions of the National Health Service Reform (Scotland) Act 2004 (asp 7) (“the Act”):–
on 1st September 2004, section 1(1), but only for the purpose of providing in the Act that the National Health Service (Scotland) Act 1978 (c. 29) shall be referred to as “the 1978 Act” and section 2, but only for the purpose of making regulations under section 4B(6) of the 1978 Act;
on 30th September 2004, sections 1(2) and (3), 2 (in so far as is it is not already in force), 3, 4, 5, 6, 11(1) (so far as relating to paragraph 1(1), (2), (3) and (6) of schedule 1) and paragraph 1(1), (2), (3) and (6) of schedule 1;
on 1st January 2005, section 9;
on 1st February 2005, section 8.
The following provisions of the Act have been brought into force by the National Health Service Reform (Scotland) Act 2004 (Commencement No. 1) Order 2004 (S.S.I. 2004/335) made before the date of this order:–
