The Sports Grounds and Sporting Events (Designation) (Scotland) Order 2004

Coming into force

The Scottish Ministers, in exercise of the powers conferred on them by section 18 of the Criminal Law (Consolidation) (Scotland) Act 19951 and of all other powers enabling them in that behalf, hereby make the following Order:

Citation1

This Order may be cited as the Sports Grounds and Sporting Events (Designation) (Scotland) Order 2004 and shall come into force on 15th September 2004.

Designation of Sports Grounds and Sporting Events2

For the purposes of Part II of the Criminal Law (Consolidation) (Scotland) Act 1995 there are hereby designated–

a

the sports grounds specified in Parts I and II of Schedule 1 to this Order;

b

the classes of sporting events specified in Part 1 of Schedule 2 to this Order, at any of the sports grounds specified in Parts I and II of Schedule 1 to this Order;

c

the class of sporting event specified in Part II of Schedule 2 to this Order, at the sports grounds specified in Part II of Schedule 1 to this Order;

d

the classes of sporting events taking place outside Great Britain specified in Part III of Schedule 2 to this Order.

Revocation3

The Orders specified in Schedule 3 to this Order are hereby revoked.

Extent4

This Order extends to Scotland except that article 2(d) also extends beyond Scotland but, where it does so, it does so only as a matter of Scots Law.

the Scottish Association Cup;

the Scottish Football League Cup;

c

the Scottish Association Qualifying Cup (North);

d

the UEFA Champions League;

e

the UEFA Cup;

f

the UEFA Inter Toto Cup.

International Association football matches in Scotland.

Association football matches (other than those specified in paragraphs 1 to 5 above) which come within the jurisdiction of the Scottish Football Association Limited.

PART II

Senior Men’s International Rugby Union football matches.

PART III

Association football matches at a sports ground outside Great Britain in which one of the participating teams represents–

a

the Scottish Football Association Limited; or

b

a club which is a member of the Scottish Premier League; or

c

a club which is a member of the Scottish Football League; or

d

a club which is a member of the Highland Football League.

This Order consolidates the previous Sports Grounds and Sporting Events (Designation) (Scotland) Orders with two changes.

This Order designates the sports grounds, the classes of sporting events played at those grounds and the classes of sporting events outside Great Britain for the purposes of Part II of the Criminal Law (Consolidation) (Scotland) Act 1995. This Order revokes the Sports Grounds and Sporting Events (Designation) (Scotland) Order 1998 and the subsequent Orders amending that Order. The two significant changes from the previous Orders are:

a

the designation of football matches at Murrayfield Stadium;

b

the restriction of the designation of Rugby matches from all International Rugby Union Matches to Senior Men’s International Rugby Union Matches.

The Order takes account of new stadia which have been built and stadia which have changed their name.
