The Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Amendment (No. 2) Order 2004

Coming into force
The Scottish Ministers, in exercise of the powers conferred by section 91(4) of the Housing (Scotland) Act 20011 and all other powers enabling them in that behalf, and after consultation with such bodies representing local authorities and such other persons as they think fit in accordance with section 91(7) of that Act, hereby make the following Order:

Citation and commencement1.

This Order may be cited as the Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Amendment (No. 2) Order 2004 and shall come into force on 20th August 2004.

Amendment to the Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Order 20032.

In paragraph 3 of Part I of the Schedule to the Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Order 20032 omit “, and, where the service so provided is a care service, the service is registered under the 2001 Act”.

This Order further amends the Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Order 2003 as amended by the Housing (Scotland) Act 2001 (Payments out of Grants for Housing Support Services) Amendment Order 2004. This Order removes the requirement for a provider of a housing support service which is a care service and is paid by a local authority out of grants provided by Scottish Ministers under the Housing (Scotland) Act 2001 (asp 10) to be registered under the Regulation of Care (Scotland) Act 2001 (asp 8).
