In section 130 of the 1997 Act (appeal against enforcement notices), in subsection (2)–

(a)

omit “either”; and

  • at the end insert–

    “; or

    (c)

    by sending such notice to them using electronic communications at such time that, in the ordinary course of transmission, it would be delivered to them before that date.”.
