The Scottish Ministers, in exercise of the powers conferred by section 33(2)(b) and (3) of the Legal Aid (Scotland) Act 1986(1), and of all other powers enabling them in that behalf, hereby make the following Regulations:
1. These Regulations may be cited as the Advice and Assistance (Scotland) Amendment (No. 2) Regulations 2004 Amendment Regulations 2004 and shall come into force on 27th June 2004.
2. In the Advice and Assistance (Scotland) Amendment (No. 2) Regulations 2004(2) for regulation 2 substitute–
“These Regulations shall apply only in relation to fees for work done or outlays incurred on or after 28th June 2004.”.

These Regulations amend regulation 2 of the Advice and Assistance (Scotland) Amendment (No. 2) Regulations 2004. In respect of existing cases where advice and assistance was granted prior to 28th June 2004 the fee increases will apply to work done or outlays incurred on or after that date. In respect of new cases where advice and assistance is granted on or after 28th June 2004 the new fees will also apply.
1986 c. 47; section 33 was amended for purposes not relevant to these Regulations. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
