They replace the provisions of regulations 6, 7 and 8 of National Health Service (General Dental Services) (Scotland) Regulations 1996 (“the 1996 Regulations”) which previously dealt with those The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act <ref eId="c00007" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c. 46)</ref>.</p></authorialNote> and of all other powers enabling them in that behalf, hereby make the following Regulations:</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation, commencement and interpretation</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the National Health Service (Vocational Training for General Dental Practice) (Scotland) Regulations 2004 and shall come into force on 5th July 2004.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><intro><p>In these Regulations–</p></intro><hcontainer name="definition"><content><p>“<abbr title="National Health Service (Scotland) Act 1978 c. 29">the Act</abbr>” means the National Health Service (Scotland) Act 1978;</p></content></hcontainer><hcontainer name="definition"><content><p>“the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr>” means the National Health Service (General Dental Services) (Scotland) Regulations 1996<authorialNote class="footnote" eId="f00002" marker="2"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00008" href="http://www.legislation.gov.uk/id/uksi/1996/177">1996/177</ref>; amended by <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00009" href="http://www.legislation.gov.uk/id/uksi/1996/841">1996/841</ref> and <ref eId="c00010" href="http://www.legislation.gov.uk/id/uksi/1996/2060">2060</ref>, <ref eId="c00011" href="http://www.legislation.gov.uk/id/ssi/2003/422">422</ref> and <ref eId="c00026" href="http://www.legislation.gov.uk/id/ssi/2004/37">2004/37</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr>” means the Dentists Vocational Training Appeal Body constituted in accordance with regulation 4;</p></content></hcontainer><hcontainer name="definition"><content><p>“Appeal Committee” means the Appeal Committee appointed under regulation 5(6);</p></content></hcontainer><hcontainer name="definition"><content><p>“approved trainer” means a dentist on Part A of a dental list and who is approved by <abbr title="NHS Education for Scotland">the Board</abbr> as being a dentist who has the requisite skills and suitable practice facilities to enable the dentist to act as a trainer;</p></content></hcontainer><hcontainer name="definition"><content><p>“<abbr title="NHS Education for Scotland">the Board</abbr>” means <abbr class="acronym" title="National Health Service">NHS</abbr> Education for Scotland established by the <abbr class="acronym" title="National Health Service">NHS</abbr> Education for Scotland Order 2002<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00027" href="http://www.legislation.gov.uk/id/ssi/2002/103">S.S.I. 2002/103</ref>; amended by <ref eId="c00028" href="http://www.legislation.gov.uk/id/ssi/2003/242">S.S.I. 2003/242</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“community dental service” means the dental service provided in Scotland under sections 1 and 39(2) of <abbr title="National Health Service (Scotland) Act 1978 c. 29">the Act</abbr>, in England and Wales under sections 3(1)(c) and 5(1A) of the National Health Service Act 1977<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00029" href="http://www.legislation.gov.uk/id/ukpga/1977/49">1977 c. 49</ref>; section 5(1A) was inserted by the Health and Medicines Act <ref eId="c00030" href="http://www.legislation.gov.uk/id/ukpga/1988/49">1988 c. 49</ref>, section 10(1)(b).</p></authorialNote> and in Northern Ireland under articles 5(1)(c) and 9(1)(a) and (1A) of the Health and Personal Social Services (Northern Ireland) Order 1972<authorialNote class="footnote" eId="f00005" marker="5"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00031" href="http://www.legislation.gov.uk/id/nisi/1972/1265">1972/1265 (N.I. 14)</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“Community law” has the same meaning as in section 126(9) of the Scotland Act 1998<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00032" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 c. 46</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“dental list” means the list prepared by a Health Board in accordance with regulation 4(1) of the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr>;</p></content></hcontainer><hcontainer name="definition"><content><p>“dentist” means a registered dental practitioner;</p></content></hcontainer><hcontainer name="definition"><content><p>“<abbr class="acronym" title="European Economic Area">EEA</abbr> state” means a Member State, Norway, Iceland or Liechtenstein;</p></content></hcontainer><hcontainer name="definition"><content><p>“pilot scheme” has the same meaning as in section 1(1) of the National Health Service (Primary Care) Act 1997<authorialNote class="footnote" eId="f00007" marker="7"><p><ref eId="c00033" href="http://www.legislation.gov.uk/id/ukpga/1997/46">1997 c. 46</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“primary dental care” means care and treatment delivered by the dentist at the first point of contact with the patient;</p></content></hcontainer><hcontainer name="definition"><content><p>“regular forces” has the same meaning as in section 225(1) of the Army Act 1955 <authorialNote class="footnote" eId="f00008" marker="8"><p><ref eId="c00034" href="http://www.legislation.gov.uk/id/ukpga/1955/18">1955 c. 18</ref>; relevant amendments to section 225(1) were made by the Reserve Forces Act <ref eId="c00035" href="http://www.legislation.gov.uk/id/ukpga/1996/14">1996 c. 14</ref>, Schedule 11.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“salaried dentist” means a dentist employed by a health board who undertakes to provide general dental services at a health centre, hospital or from any vehicle or moveable facility;</p></content></hcontainer><hcontainer name="definition"><content><p>“satisfactory completion of vocational training”, and related expressions, shall be construed in accordance with regulation 3;</p></content></hcontainer><hcontainer name="definition"><intro><p>“vocational training”, except as provided for in regulation 8, means a period of employment–</p></intro><level class="para1"><num>(a)</num><content><p>which is undertaken within a period of up to two years (or the equivalent period of part time employment) from the date of commencement of employment, or such extension of that period as may be approved by the Postgraduate Dental Dean<authorialNote class="footnote" eId="f00009" marker="9"><p>The post of Postgraduate Dental Dean is held by an employee of <abbr title="NHS Education for Scotland">the Board</abbr>.</p></authorialNote>; and</p></content></level><level class="para1"><num>(b)</num><content><p>during which period the dentist is employed under a contract of service by an approved trainer or, where the approved trainer is a salaried dentist, under a contract of service with a Health Board, to provide a wide range of dental care and treatment, to attend such study days as that contract requires and to undertake assessments required in order to satisfactorily complete vocational training;</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“vocational training certificate”, except as provided for in regulation 8, means a certificate confirming that a dentist has satisfactorily completed vocational training issued–</p></intro><level class="para1"><num>(a)</num><content><p>in Scotland, by the Postgraduate Dental Dean, or a Director of Postgraduate General Dental Practice Education<authorialNote class="footnote" eId="f00010" marker="10"><p>The posts of Director of Postgraduate General Dental Practice Education are also held by employees of <abbr title="NHS Education for Scotland">the Board</abbr>.</p></authorialNote>;</p></content></level><level class="para1"><num>(b)</num><content><p>in England, Wales or Northern Ireland, by a Postgraduate Dental Dean;</p></content></level><level class="para1"><num>(c)</num><content><p>by the Director of the Royal Naval Dental Service, the Director of the Royal Army Dental Corp or the Director of the Dental Branch of the Royal Air Force;</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“vocational training number”, except where the context otherwise requires in paragraph 6 of regulation 2 and regulation 8, means the number allocated to a dentist–</p></intro><level class="para1"><num>(a)</num><content><p>in Scotland, under regulation 2;</p></content></level><level class="para1"><num>(b)</num><content><p>in England and Wales, under regulation 5A (applications for vocational training numbers) of the National Health Service (General Dental Services) Regulations 1992<authorialNote class="footnote" eId="f00011" marker="11"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00036" href="http://www.legislation.gov.uk/id/uksi/1992/661">1992/661</ref>; regulation 5A was inserted by <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00037" href="http://www.legislation.gov.uk/id/uksi/1993/2209">1993/2209</ref> and amended by <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00038" href="http://www.legislation.gov.uk/id/uksi/1993/3172">1993/3172</ref>, <ref eId="c00039" href="http://www.legislation.gov.uk/id/uksi/1998/1648">1998/1648</ref> and <ref eId="c00040" href="http://www.legislation.gov.uk/id/uksi/1998/2224">2224</ref>, <ref eId="c00041" href="http://www.legislation.gov.uk/id/uksi/2001/2421">2001/2421</ref> and <ref eId="c00042" href="http://www.legislation.gov.uk/id/uksi/2002/2469">2002/2469</ref>.</p></authorialNote>; and</p></content></level><level class="para1"><num>(c)</num><content><p>in Northern Ireland, under regulation 5A (applications for vocational training numbers) of the Health and Personal Social Services General Dental Services Regulations (Northern Ireland) 1993<authorialNote class="footnote" eId="f00012" marker="12"><p><ref eId="c00043" href="http://www.legislation.gov.uk/id/nisr/1993/326">S.R. 1993/ 326</ref>; regulation 5A was inserted by <ref eId="c00044" href="http://www.legislation.gov.uk/id/nisr/1993/401">S.R. 1993/401</ref> and amended by <ref eId="c00045" href="http://www.legislation.gov.uk/id/nisr/1998/245">1998/ 245</ref>.</p></authorialNote>;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“writing” does not include transmission by electronic means.</p></content></hcontainer></paragraph><paragraph eId="regulation-1-3"><num>(3)</num><content><p>Any reference in these Regulations to a numbered regulation or the Schedule or to a numbered paragraph or sub-paragraph of such a regulation is, unless otherwise expressly provided, a reference to a regulation, paragraph or sub-paragraph bearing that number in these Regulations or to the Schedule to these Regulations.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Applications for vocational training numbers</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><intro><p>An application for a vocational training number shall be made in writing to <abbr title="NHS Education for Scotland">the Board</abbr> and–</p></intro><level class="para1" eId="regulation-2-1-a"><num>(a)</num><intro><p>shall state that the dentist has also made an application under regulation 5<authorialNote class="footnote" eId="f00013" marker="13"><p>Regulation 5 was amended by <ref eId="c00046" href="http://www.legislation.gov.uk/id/ssi/1999/51">S.S.I. 1999/51</ref>, regulation 2, <ref eId="c00047" href="http://www.legislation.gov.uk/id/ssi/2000/188">2000/188</ref>, regulation 4, <ref eId="c00048" href="http://www.legislation.gov.uk/id/ssi/2001/368">2001/368</ref>, regulation 2.</p></authorialNote> of the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr> (application for inclusion in the dental list) for inclusion in Part A of the dental list and shall–</p></intro><level class="para2" eId="regulation-2-1-a-i"><num>(i)</num><content><p>specify the Health Board to which that application has been made; and</p></content></level><level class="para2" eId="regulation-2-1-a-ii"><num>(ii)</num><content><p>state the date on which it was made; and</p></content></level></level><level class="para1" eId="regulation-2-1-b"><num>(b)</num><intro><p>shall either–</p></intro><level class="para2" eId="regulation-2-1-b-i"><num>(i)</num><content><p>state that the dentist has completed vocational training satisfactorily and be accompanied by the dentist’s vocational training certificate;</p></content></level><level class="para2" eId="regulation-2-1-b-ii"><num>(ii)</num><content><p>state that the experience or training which the dentist has acquired ought to be regarded as equivalent to vocational training and that that experience or training has been completed within the last 5 years and be accompanied by written details of that experience or training; or</p></content></level><level class="para2" eId="regulation-2-1-b-iii"><num>(iii)</num><content><p>state that the dentist is exempt from the requirement to have completed vocational training on one of the grounds set out in paragraph (3) and be accompanied by written details in support of that statement.</p></content></level></level></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p>For the purpose of paragraph (1)(b)(ii) experience or training shall not be prevented from being equivalent to vocational training merely because the structure of the experience does not comply exactly with the definition of vocational training.</p></content></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><intro><p>A dentist is exempt from the requirement to have completed vocational training if that dentist–</p></intro><level class="para1" eId="regulation-2-3-a"><num>(a)</num><content><p>is registered by virtue of section 15(1)(b)<authorialNote class="footnote" eId="f00014" marker="14"><p>Section 15(1)(b) was amended by <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00049" href="http://www.legislation.gov.uk/id/uksi/1996/1496">1996/1496</ref>, regulation 2(1).</p></authorialNote> or (2A)<authorialNote class="footnote" eId="f00015" marker="15"><p>Section 15(2A) was inserted by <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00050" href="http://www.legislation.gov.uk/id/uksi/1996/1496">1996/1496</ref>, regulation 2(2).</p></authorialNote> of the Dentists Act 1984 (qualification for registration in the dentists register) or is in any other way a person in respect of whom an <abbr class="acronym" title="European Economic Area">EEA</abbr> State is prohibited by Community law from imposing such a requirement;</p></content></level><level class="para1" eId="regulation-2-3-b"><num>(b)</num><content><p>has had their name included in a dental list in the United Kingdom (other than in Part B only of a dental list in Scotland) within the period of five years ending on the date of the application by that dentist to be included in the dental list; or</p></content></level><level class="para1" eId="regulation-2-3-c"><num>(c)</num><content><p>has practised in primary dental care in either the community dental service or the regular forces or has performed personal dental services in connection with a pilot scheme for a period amounting in aggregate to not less than four years full-time employment (or part-time employment of equivalent duration), and has so practised for not less than four months in full-time employment (or part-time employment of equivalent duration) within the period of four years ending with the date of application by that dentist under paragraph (1).</p></content></level></paragraph><paragraph eId="regulation-2-4"><num>(4)</num><intro><p>An application for a vocational training number shall be granted by <abbr title="NHS Education for Scotland">the Board</abbr> if–</p></intro><level class="para1" eId="regulation-2-4-a"><num>(a)</num><content><p>a vocational training certificate has been issued to the applicant, following satisfactory completion of vocational training;</p></content></level><level class="para1" eId="regulation-2-4-b"><num>(b)</num><content><p>the applicant has, in the opinion of <abbr title="NHS Education for Scotland">the Board</abbr>, acquired experience or completed training which ought to be regarded as equivalent to satisfactory completion of vocational training; or</p></content></level><level class="para1" eId="regulation-2-4-c"><num>(c)</num><content><p>the applicant is exempt from the requirement to have completed vocational training on one of the grounds set out in paragraph (3).</p></content></level></paragraph><paragraph eId="regulation-2-5"><num>(5)</num><intro><p>If <abbr title="NHS Education for Scotland">the Board</abbr> determines to grant an application for a vocational training number it shall–</p></intro><level class="para1" eId="regulation-2-5-a"><num>(a)</num><content><p>allocate to the applicant a vocational training number;</p></content></level><level class="para1" eId="regulation-2-5-b"><num>(b)</num><content><p>notify the applicant of that number within 14 days of the determination; and</p></content></level><level class="para1" eId="regulation-2-5-c"><num>(c)</num><content><p>enter that number against the name of the applicant in a register kept for that purpose.</p></content></level></paragraph><paragraph eId="regulation-2-6"><num>(6)</num><content><p>Once a vocational training number has been allocated either under these Regulations or the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr>, it will cease to be valid if the dentist concerned does not for any continuous period of 5 years commencing on or after the date of commencement of these Regulations provide general dental services.</p></content></paragraph><paragraph eId="regulation-2-7"><num>(7)</num><content><p>If <abbr title="NHS Education for Scotland">the Board</abbr> does not allocate a vocational training number to the applicant, it shall within 10 days of that decision, send to the applicant a notice to that effect together with a statement setting out the reasons why it has not done so and telling the applicant about the right to appeal to the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr>, the time limit for appeals specified in regulation 5(1) and giving the address to which an appeal must be sent.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Satisfactory completion of vocational training</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><intro><p>Vocational training–</p></intro><level class="para1" eId="regulation-3-1-a"><num>(a)</num><content><p>shall, if the whole period of that training was undertaken after these Regulations come into force, be assessed by <abbr title="NHS Education for Scotland">the Board</abbr> by means of reports, examinations, interviews, written submissions and other forms of assessment designed to test the competencies specified in the Schedule; and</p></content></level><level class="para1" eId="regulation-3-1-b"><num>(b)</num><content><p>shall be satisfactorily completed if the dentist has, in the opinion of <abbr title="NHS Education for Scotland">the Board</abbr>, acquired the dental experience which may reasonably be expected to be acquired from training of that duration in that employment.</p></content></level></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><content><p>Subject to paragraph (1)(a) and the Schedule, the procedure for carrying out the assessment of, and the curriculum to be followed by, a dentist shall be determined by <abbr title="NHS Education for Scotland">the Board</abbr> after consultation with such organisations as, in the opinion of the Scottish Ministers, represent the general body of dentists and published by <abbr title="NHS Education for Scotland">the Board</abbr> from time to time<authorialNote class="footnote" eId="f00016" marker="16"><p>The procedure is available from the offices of <abbr class="acronym" title="National Health Service">NHS</abbr> Education for Scotland, 22 Queen Street, Edinburgh.</p></authorialNote>.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading><abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr> for appeals against refusal of vocational training number.</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><content><p>The body to which appeals may be made in respect of a refusal to grant a vocational training number shall be a body of seven persons appointed by the Scottish Ministers and shall be known as the “Dentists Vocational Training Appeal Body”.</p></content></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><intro><p>Of the seven persons referred to in paragraph (1)–</p></intro><level class="para1" eId="regulation-4-2-a"><num>(a)</num><intro><p>one person shall be appointed as convener of the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr> who–</p></intro><level class="para2" eId="regulation-4-2-a-i"><num>(i)</num><content><p>is an advocate or solicitor in Scotland of at least 10 years standing; or</p></content></level><level class="para2" eId="regulation-4-2-a-ii"><num>(ii)</num><content><p>has a 10 year general qualification (within the meaning of section 71 of the Courts and Legal Services Act 1990<authorialNote class="footnote" eId="f00017" marker="17"><p><ref eId="c00051" href="http://www.legislation.gov.uk/id/ukpga/1990/41">1990 c. 41</ref>.</p></authorialNote>); or</p></content></level><level class="para2" eId="regulation-4-2-a-iii"><num>(iii)</num><content><p>is a member of the Bar of Northern Ireland or a solicitor of the Supreme Court of Northern Ireland of at least 10 years standing;</p></content></level></level><level class="para1" eId="regulation-4-2-b"><num>(b)</num><content><p>three shall be dentists nominated by a body appearing to the Scottish Ministers to be representative of the dental profession; and</p></content></level><level class="para1" eId="regulation-4-2-c"><num>(c)</num><content><p>three shall be dentists nominated by the Scottish Ministers.</p></content></level></paragraph><paragraph eId="regulation-4-3"><num>(3)</num><content><p>The Scottish Ministers shall appoint a person to act as secretary to the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr>.</p></content></paragraph><paragraph eId="regulation-4-4"><num>(4)</num><intro><p>In this regulation–</p></intro><hcontainer name="definition"><content><p>“advocate” means a member of the Faculty of Advocates;</p></content></hcontainer><hcontainer name="definition"><content><p>“solicitor in Scotland” means any person enrolled as a solicitor in pursuance of the Solicitors (Scotland) Act 1980<authorialNote class="footnote" eId="f00018" marker="18"><p><ref eId="c00052" href="http://www.legislation.gov.uk/id/ukpga/1980/46">1980 c. 46</ref>.</p></authorialNote>.</p></content></hcontainer></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Procedure on appeal</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><content><p>A dentist, whose application for a vocational training number has been refused by <abbr title="NHS Education for Scotland">the Board</abbr>, may appeal against the refusal by giving to the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr>, within 42 days after that dentist has received notice of the refusal pursuant to regulation 2(7) (or such extended period as the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr> may allow pursuant to paragraph (2)), a written notice of appeal setting out a statement of the facts and contentions on which the dentist intends to rely.</p></content></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><content><p>The convener may agree to an extension or further extension of the period of 42 days for lodging an appeal (either before or after that period has expired).</p></content></paragraph><paragraph eId="regulation-5-3"><num>(3)</num><content><p>In any case in which a dentist appeals to the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr> in terms of paragraph (1), that dentist shall also send a copy of the written notice of appeal to <abbr title="NHS Education for Scotland">the Board</abbr>.</p></content></paragraph><paragraph eId="regulation-5-4"><num>(4)</num><content><p>The Board shall, within 21 days of the date of receipt of the copy notice of appeal referred to in paragraph (3), send to the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr> a statement, signed and dated, saying whether or not the appeal is opposed.</p></content></paragraph><paragraph eId="regulation-5-5"><num>(5)</num><content><p>The convener may agree to an extension or further extension of the period of 21 days referred to in paragraph (4) for lodging the statement by <abbr title="NHS Education for Scotland">the Board</abbr> (either before or after that period has expired).</p></content></paragraph><paragraph eId="regulation-5-6"><num>(6)</num><intro><p>On receipt of a notice of appeal, the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr> shall appoint an Appeal Committee to determine the appeal and the Appeal Committee shall consist of the convener and two other persons, of whom–</p></intro><level class="para1" eId="regulation-5-6-a"><num>(a)</num><content><p>one shall be drawn from the dentists appointed to the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr> under regulation 4(1) following their nomination under regulation 4(2)(b); and</p></content></level><level class="para1" eId="regulation-5-6-b"><num>(b)</num><content><p>the other shall be drawn from the dentists appointed to the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr> under regulation 4(1) following their nomination under regulation 4(2)(c).</p></content></level></paragraph><paragraph eId="regulation-5-7"><num>(7)</num><intro><p>If the appeal is opposed by <abbr title="NHS Education for Scotland">the Board</abbr>, <abbr title="NHS Education for Scotland">the Board</abbr> shall reply within 21 days of the receipt of a copy of the written notice of appeal under paragraph (3) and shall–</p></intro><level class="para1" eId="regulation-5-7-a"><num>(a)</num><content><p>set out fully on what grounds the appeal is opposed;</p></content></level><level class="para1" eId="regulation-5-7-b"><num>(b)</num><content><p>specify any representations which <abbr title="NHS Education for Scotland">the Board</abbr> may desire to submit with regard to the information furnished by the dentist; and</p></content></level><level class="para1" eId="regulation-5-7-c"><num>(c)</num><intro><p>send to the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr>–</p></intro><level class="para2" eId="regulation-5-7-c-i"><num>(i)</num><content><p>a certified copy of the application made by the dentist under regulation 2(1);</p></content></level><level class="para2" eId="regulation-5-7-c-ii"><num>(ii)</num><content><p>a certified copy of the notice to the dentist and the statement of reasons specified in regulation 2(7);</p></content></level><level class="para2" eId="regulation-5-7-c-iii"><num>(iii)</num><content><p>certified copies of any further written correspondence between the dentist and <abbr title="NHS Education for Scotland">the Board</abbr> in relation to the application; and</p></content></level><level class="para2" eId="regulation-5-7-c-iv"><num>(iv)</num><content><p>any documentary evidence which <abbr title="NHS Education for Scotland">the Board</abbr> may desire to submit.</p></content></level></level></paragraph><paragraph eId="regulation-5-8"><num>(8)</num><content><p>In connection with an appeal, the Appeal Committee may require such further particulars from the dentist and such documents in support of the dentist’s appeal, and may make such inquires of such persons as it thinks fit.</p></content></paragraph><paragraph eId="regulation-5-9"><num>(9)</num><content><p>The Appeal Committee shall send to the dentist and to <abbr title="NHS Education for Scotland">the Board</abbr> (if the appeal is opposed) a copy of any comments made by such persons in reply to those inquiries and shall give the dentist and <abbr title="NHS Education for Scotland">the Board</abbr> (if the appeal is opposed) a period of 21 days beginning with the date on which the comments are sent to the respective parties in which to reply to such comments.</p></content></paragraph><paragraph eId="regulation-5-10"><num>(10)</num><content><p>The Appeal Committee shall give notice to the dentist that the dentist may, within such period as is specified in the notice, require the Appeal Committee to give the dentist an opportunity of appearing before and being heard by that Committee.</p></content></paragraph><paragraph eId="regulation-5-11"><num>(11)</num><content><p>The Appeal Committee shall appoint a date, time and place for the consideration of the appeal, and may, or shall if so required by the dentist, hold a hearing for that purpose.</p></content></paragraph><paragraph eId="regulation-5-12"><num>(12)</num><content><p>If a hearing is to be held, the Appeal Committee shall appoint a date, time and place for the hearing and, not less than 21 days before the date, shall send notice to the dentist and to <abbr title="NHS Education for Scotland">the Board</abbr> informing them of such date, time and place.</p></content></paragraph><paragraph eId="regulation-5-13"><num>(13)</num><content><p>At a hearing by the Appeal Committee, the dentist may appear and be heard in person or by counsel or a solicitor or by any other person on their behalf, and <abbr title="NHS Education for Scotland">the Board</abbr> may appear and be represented by counsel or a solicitor or by any duly authorised member or officer.</p></content></paragraph><paragraph eId="regulation-5-14"><num>(14)</num><content><p>The dentist may withdraw the appeal at any time.</p></content></paragraph><paragraph eId="regulation-5-15"><num>(15)</num><content><p>Where the dentist has required a hearing but does not appear and is not represented at the hearing, and the Appeal Committee are not satisfied that there was good reason for the failure to appear or be represented, they may treat the requirement as having been withdrawn and either hold no hearing or proceed with the hearing in the absence of the dentist.</p></content></paragraph><paragraph eId="regulation-5-16"><num>(16)</num><content><p>If there is a hearing, the proceedings of the Appeal Committee shall be conducted in private, unless the dentist requests a public hearing.</p></content></paragraph><paragraph eId="regulation-5-17"><num>(17)</num><content><p>The Appeal Committee shall determine the appeal and shall, within 10 days of that determination, notify the dentist and <abbr title="NHS Education for Scotland">the Board</abbr> in writing of their decision and the reasons for it.</p></content></paragraph><paragraph eId="regulation-5-18"><num>(18)</num><content><p>Where <abbr title="NHS Education for Scotland">the Board</abbr> receives notice that a dentist’s appeal has been allowed, it shall allocate a vocational training number to the dentist, notify the dentist of that number within 10 days, and enter that number in its register of vocational training numbers.</p></content></paragraph><paragraph eId="regulation-5-19"><num>(19)</num><content><p>Subject to the foregoing paragraphs, the procedure of the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr> and of the Appeal Committee shall be such as that Body and Committee respectively thinks fit.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Service of documents</heading><num>6.</num><intro><p>Any notice or other document which is required or authorised by these Regulations to be given or sent–</p></intro><level class="para1" eId="regulation-6-a"><num>(a)</num><content><p>to a dentist by <abbr title="NHS Education for Scotland">the Board</abbr>, the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr> or an Appeal Committee may be given or sent by delivering it to the dentist or by sending it by post to the dentist at the dentist’s usual or last known address;</p></content></level><level class="para1" eId="regulation-6-b"><num>(b)</num><content><p>to a dentist in connection with an appeal under regulation 5 who is represented by a solicitor for the purposes of that appeal, may be given or sent (as an alternative to a method mentioned in paragraph (a)) by delivering it to the solicitor or by sending it by post to the solicitor at the solicitor’s usual or principal address;</p></content></level><level class="para1" eId="regulation-6-c"><num>(c)</num><content><p>to the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr> or an Appeal Committee may be given or sent by delivering it to, or by sending it by post to, the Secretary of the <abbr title="Dentists Vocational Training Appeal Body">Appeal Body</abbr> at the address mentioned in the notice given under regulation 2(7).</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-7"><heading>Amendment of the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr></heading><num>7.</num><paragraph eId="regulation-7-1"><num>(1)</num><content><p>The <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr> are amended in accordance with the following paragraphs.</p></content></paragraph><paragraph eId="regulation-7-2"><num>(2)</num><intro><p>In regulation 2(1)–</p></intro><level class="para2" eId="regulation-7-2-i"><num>(i)</num><content><p>omit the definitions of “<abbr title="Dentists dentist has commenced, but not completed, their vocational training under the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr>, then in respect of such a dentist these Regulations shall apply subject to the following modifications:–</p></intro><level class="para1" eId="regulation-8-1-a"><num>(a)</num><content><p>“vocational training” in these Regulations shall have the same meaning as it did in regulation 2(1)<authorialNote class="footnote" eId="f00022" marker="22"><p>The definition of “vocational training” was amended by <ref eId="c00060" href="http://www.legislation.gov.uk/id/ssi/2000/352">S.S.I. 2000/352</ref>.</p></authorialNote> of the <abbr <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr> but has not been issued with or refused a vocational training certificate in respect of that training under those Regulations, then in respect of such a dentist these Regulations shall apply subject to the following modifications:–</p></intro><level class="para1" eId="regulation-8-2-a"><num>(a)</num><content><p>“vocational training” shall have the same meaning as in regulation 2(1) of the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr> immediately before 5th July 2004;</p></content></level><level class="para1" eId="regulation-8-2-b"><num>(b)</num><content><p>a vocational training certificate shall be issued to the dentist by the Postgraduate Dental Dean, or a Director of Postgraduate General Dental Practice omitted.</p></content></level></paragraph><paragraph eId="regulation-8-3"><num>(3)</num><intro><p>Where, immediately before 5th July 2004, a dentist has completed their vocational training under the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr> and been issued with a vocational training certificate under those Regulations but has not applied for a vocational training number under those Regulations, then in respect of such a dentist these Regulations shall apply subject to the following modifications–</p></intro><level class="para1" eId="regulation-8-3-a"><num>(a)</num><content><p>“vocational training” and “vocational training certificate” in these Regulations shall have the same meaning as in regulation 2(1) of the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr> immediately before 5th July 2004;</p></content></level><level class="para1" eId="regulation-8-3-b"><num>(b)</num><intro><p>in regulation 2 of these Regulations–</p></intro><level class="para2" eId="regulation-8-3-b-i"><num>(i)</num><content><p>the word “satisfactorily” shall be omitted from sub-paragraph (b)(i) of paragraph (1); and</p></content></level><level class="para2" eId="regulation-8-3-b-ii"><num>(ii)</num><content><p>the words “following satisfactory completion of vocational training” shall be omitted from sub-paragraph (a) of paragraph 4; and</p></content></level></level><level class="para1" eId="regulation-8-3-c"><num>(c)</num><content><p>regulation 3 shall be omitted.</p></content></level></paragraph><paragraph eId="regulation-8-4"><num>(4)</num><intro><p>Where, immediately before 5th July 2004, a dentist completed their vocational training under the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr>, has been issued with a vocational training certificate and applied for a vocational training number under those Regulations but that application has not been determined, any such application shall be determined in accordance with regulation 2 of these Regulations and in respect of such a dentist these Regulations shall apply subject to the following modifications:–</p></intro><level class="para1" eId="regulation-8-4-a"><num>(a)</num><content><p>“vocational training” and “vocational training certificate” in these Regulations shall have the same meaning as in regulation 2(1) of the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr> immediately before 5th July 2004;</p></content></level><level class="para1" eId="regulation-8-4-b"><num>(b)</num><intro><p>in regulation 2 of these Regulations–</p></intro><level class="para2" eId="regulation-8-4-b-i"><num>(i)</num><content><p>the word “satisfactorily” shall be omitted from sub-paragraph (b)(i) of paragraph (1); and</p></content></level><level class="para2" eId="regulation-8-4-b-ii"><num>(ii)</num><content><p>the words “following satisfactory completion of vocational training” shall be omitted from sub-paragraph (a) of paragraph 4; and</p></content></level></level><level class="para1" eId="regulation-8-4-c"><num>(c)</num><content><p>regulation 3 shall be omitted.</p></content></level></paragraph><paragraph eId="regulation-8-5"><num>(5)</num><content><p>Where, immediately before 5th July 2004, a dentist, not being a dentist with a vocational training certificate issued under the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr>, has applied under regulation 6<authorialNote class="footnote" eId="f00023" marker="23"><p>Regulation 6 was amended by <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00061" href="http://www.legislation.gov.uk/id/uksi/1996/2060">1996/2060</ref>, regulation 2(2), <ref eId="c00062" href="http://www.legislation.gov.uk/id/uksi/1998/1663">1998/1663</ref>, regulation 5, <ref eId="c00063" href="http://www.legislation.gov.uk/id/uksi/1998/2224">1998/2224</ref>, regulation 4(2) and <ref eId="c00064" href="http://www.legislation.gov.uk/id/ssi/1999/51">S.S.I. 1999/51</ref>, regulation 2 and <ref eId="c00065" href="http://www.legislation.gov.uk/id/ssi/2000/188">2000/188</ref>, regulation 5.</p></authorialNote> of those Regulations for a vocational training number but that application has not been determined, then these Regulations shall apply in respect of such a dentist and any such application shall be determined in accordance with regulation 2 of these Regulations except that the words “and that that experience or training has been completed within the last 5 years” shall be omitted from sub paragraph (b)(ii) of paragraph (1) of that regulation.</p></content></paragraph><paragraph eId="regulation-8-6"><num>(6)</num><intro><p>Where immediately before 5th July 2004, an applicant has received notice under regulation 6(7) of the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr> of the refusal of a dental vocational training number under those Regulations but the period for making an appeal under regulation 8(1) of the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr> has not expired, then the applicant shall be entitled to make an appeal under regulation 5(1) and the provisions of these Regulations shall apply to such an appeal except that in regulation 5–</p></intro><level class="para1" eId="regulation-8-6-a"><num>(a)</num><content><p>the period of 42 days specified in paragraphs (1) and (2) shall be modified to however many days of the period set out in regulation 8(1) of the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr> remain on 5th July 2004; and</p></content></level><level class="para1" eId="regulation-8-6-b"><num>(b)</num><content><p>the reference in paragraph (1) to regulation 2(7) shall be a reference to regulation 6(7) of the <abbr Regulations)</subheading><blockContainer ukl:Name="P"><p>These Regulations make provision for the vocational training for dentists. They make provision as to what is meant by vocational training and the satisfactory completion of vocational training, how vocational training numbers are granted and how appeals against their refusal are conducted. They replace the provisions of regulations 6, 7 and 8 of National Health Service (General Dental Services) (Scotland) Regulations 1996 (“the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr>”) which previously dealt with those matters and also make consequential amendments to the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr>.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 2 prescribes how an application for a vocational training number is made to <abbr class="acronym" title="National Health Service">NHS</abbr> Education for Scotland, which is a Special Health Board, what the evidence of satisfactory completion of vocational training or grounds upon which exemption is claimed is, the procedure for issuing a vocational training number and, if the application is refused, the requirement to notify the applicant of the appeal procedure.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 3 prescribes how vocational training is assessed against the competencies in the Schedule and how the assessment procedure and curriculum can be altered.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 4 creates the Dentists Vocational Training Appeal Body to which appeals against refusal to grant a vocational training number may be made.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 5 prescribes the procedure to be followed on such appeals.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 6 makes provision for the service of documents.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 7 makes consequential amendments to the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr></p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 8 makes provision for dentists who have already commenced, but not completed, vocational training under the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr>, dentists who have completed vocational training under the <abbr title="National Health Service (General Dental Services) (Scotland) Regulations 1996 (S.I. 1996/177)">1996 Regulations</abbr> but have not applied for a vocational training number, or dentists whose application for a vocational training number under the 1996 regulations has been refused and is the subject of an appeal.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
