(Fees for Applications and Deemed Applications) (Scotland) Amendment Regulations 2000 and the Town and Country Planning (Fees for Applications and Deemed Applications) (Scotland) Amendment Regulation 2002 and make provision for the payment of fees:–to planning authorities in respect of applications made under Part III of the Town and Country Planning (Scotland) Act 1997 for planning permission for development or for approval of matters reserved by an outline planning permission and in respect of applications for consent for the display of advertisements;to the Scottish Ministers in respect of applications for planning permission which are deemed to have been made, by virtue of the provisions of section 133(7) of the 1997 Act, in connection with an appeal against an enforcement notice; andfor applications for certificates of lawful use or development made under section 150(1) and certificates of proposed use or development under section 151(1) of the 1997 The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c. 46)</ref>.</p></authorialNote>, and of all other powers enabling them in that behalf, hereby make the following Regulations, a draft of which has, in accordance with subsection (4) of that section, been laid before and approved by resolution of the Scottish Parliament:</p></formula></preamble><body><hcontainer name="crossheading" ukl:Name="P1group"><heading>Application, citation and commencement</heading><hcontainer name="regulation" eId="regulation-1"><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Town and Country Planning (Fees for Applications and Deemed Applications) (Scotland) Regulations 2004 and shall come into force on 1st June 2004.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><intro><p>These Regulations apply to–</p></intro><level class="para1" eId="regulation-1-2-a"><num>(a)</num><intro><p>applications made on or after the day these Regulations come into force for–</p></intro><level class="para2" eId="regulation-1-2-a-i"><num>(i)</num><content><p>any planning permission or deemed application for planning permission;</p></content></level><level class="para2" eId="regulation-1-2-a-ii"><num>(ii)</num><content><p>approval of reserved matters;</p></content></level><level class="para2" eId="regulation-1-2-a-iii"><num>(iii)</num><content><p>a certificate of lawful use or development under section 150 or a certificate of proposed use or development under section 151 of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>;</p></content></level><level class="para2" eId="regulation-1-2-a-iv"><num>(iv)</num><content><p>consent for the display of advertisements;</p></content></level><level class="para2" eId="regulation-1-2-a-v"><num>(v)</num><content><p>a determination as to whether the planning authority’s prior approval will be required in relation to development under Schedule 1 to the <abbr title="Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (S.I. 1992/223)">General Permitted Development Order</abbr>; and</p></content></level></level><level class="para1" eId="regulation-1-2-b"><num>(b)</num><content><p>deemed applications for planning permission in connection with an enforcement notice issued on or after the day these Regulations come into force.</p></content></level></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Interpretation</heading><hcontainer name="regulation" eId="regulation-2"><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><intro><p>In these Regulations, unless the context otherwise requires–</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984 (S.I. 1984/467)">1984 Regulations</abbr>” means the Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984<authorialNote class="footnote" eId="f00002" marker="2"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00003" href="http://www.legislation.gov.uk/id/uksi/1984/467">1984/467</ref>, as amended by S.I <ref eId="c00004" href="http://www.legislation.gov.uk/id/uksi/1992/1763">1992/1763</ref> and <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00005" href="http://www.legislation.gov.uk/id/uksi/1996/252">1996/252</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“community council” means a community council established under section 51 of the Local Government (Scotland) Act 1973<authorialNote class="footnote" eId="f00003" marker="3"><p>Section 51 of the Local Government (Scotland) Act <ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/1973/65">1973 (c. 65)</ref> was amended by the Local Government <abbr title="et cetera" xml:lang="la">etc.</abbr> (Scotland) Act <ref eId="c00007" href="http://www.legislation.gov.uk/id/ukpga/1994/39">1994 (c. 39)</ref>, Schedule 14.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“the <abbr title="Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (S.I. 1992/223)">General Permitted Development Order</abbr>” means the Town and Country Planning (General Permitted Development) (Scotland) Order 1992<authorialNote class="footnote" eId="f00004" marker="4"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00008" href="http://www.legislation.gov.uk/id/uksi/1992/223">1992/223</ref>, amended by <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00009" href="http://www.legislation.gov.uk/id/uksi/1992/1078">1992/1078</ref> and <ref eId="c00010" href="http://www.legislation.gov.uk/id/uksi/1992/2084">2084</ref>, <ref eId="c00011" href="http://www.legislation.gov.uk/id/uksi/1993/1036">1993/1036</ref>, <ref eId="c00012" href="http://www.legislation.gov.uk/id/uksi/1994/1442">1994/1442</ref>, <ref eId="c00013" href="http://www.legislation.gov.uk/id/uksi/1996/1266">1996/1266</ref> and <ref eId="c00016" href="http://www.legislation.gov.uk/id/uksi/1996/3023">3023</ref>, <ref eId="c00017" href="http://www.legislation.gov.uk/id/uksi/2001/266">2001/266</ref>, and <ref eId="c00018" href="http://www.legislation.gov.uk/id/uksi/2003/341">2003/341</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>” means the Town and Country Planning (Scotland) Act 1997<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00019" href="http://www.legislation.gov.uk/id/ukpga/1997/8">1997 c. 8</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“dwellinghouse” means a building or part of a building which is used as a single private dwellinghouse, and for no other purpose;</p></content></hcontainer><hcontainer name="definition"><content><p>“outline planning permission” and “reserved matters” have the same meaning as in the Town and Country Planning (General Development Procedure) (Scotland) Order 1992<authorialNote class="footnote" eId="f00006" marker="6"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00020" href="http://www.legislation.gov.uk/id/uksi/1992/224">1992/224</ref>, amended by <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00021" href="http://www.legislation.gov.uk/id/uksi/1992/2083">1992/2083</ref>, <ref eId="c00022" href="http://www.legislation.gov.uk/id/uksi/1993/1039">1993/1039</ref>, <ref eId="c00023" href="http://www.legislation.gov.uk/id/uksi/1994/2585">1994/2585</ref> and <ref eId="c00024" href="http://www.legislation.gov.uk/id/uksi/1994/3293">3293</ref>, <ref eId="c00025" href="http://www.legislation.gov.uk/id/uksi/1995/2043">1995/2043</ref>, <ref eId="c00026" href="http://www.legislation.gov.uk/id/uksi/1996/467">1996/467</ref>, and <ref eId="c00027" href="http://www.legislation.gov.uk/id/uksi/2001/245">2001/245</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“the Schedule” means the Schedule to these Regulations; and</p></content></hcontainer><hcontainer name="definition"><content><p>“use of land” includes use of land for the winning and working of minerals.</p></content></hcontainer></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p>Expressions used in regulation 14 have the same meaning as in the <abbr title="Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984 (S.I. 1984/467)">1984 Regulations</abbr>.</p></content></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><intro><p>Any reference in these Regulations–</p></intro><level class="para1" eId="regulation-2-3-a"><num>(a)</num><content><p>to a numbered regulation, is a reference to the regulation so numbered in these Regulations;</p></content></level><level class="para1" eId="regulation-2-3-b"><num>(b)</num><content><p>to a numbered paragraph, is a reference to the paragraph so numbered in the Schedule; and</p></content></level><level class="para1" eId="regulation-2-3-c"><num>(c)</num><content><p>to a numbered Table is a reference to the Table so numbered in Part III of the Schedule.</p></content></level></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Fees for planning applications</heading><hcontainer name="regulation" eId="regulation-3"><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><content><p>Subject to regulations 4 to 9 and paragraph 8(3) of the Schedule, where an application is made to a planning authority for planning permission or for the approval of reserved matters, a fee shall be paid to that authority in accordance with the provisions of these Regulations.</p></content></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><content><p>The fee payable in respect of the application shall be calculated in accordance with the Schedule.</p></content></paragraph><paragraph eId="regulation-3-3"><num>(3)</num><content><p>Where a fee is due in respect of an application it shall be paid to the planning authority with which the application is lodged and shall accompany the application.</p></content></paragraph><paragraph eId="regulation-3-4"><num>(4)</num><content><p>Any fee paid under this regulation shall be refunded if the application is rejected as invalidly made.</p></content></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Exceptions</heading><hcontainer name="regulation" eId="regulation-4"><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><intro><p>Regulation 3 shall not apply where the planning authority to which the application is made is satisfied that it relates solely to the carrying out of operations–</p></intro><level class="para1" eId="regulation-4-1-a"><num>(a)</num><content><p>in the curtilage or for the alteration or extension of a dwellinghouse, other than the erection of a dwellinghouse, for the purpose of providing means of access to or within the dwellinghouse for a disabled person who resides or proposes to reside in that dwellinghouse, or of providing facilities designed to secure that person’s greater safety, health or comfort; or</p></content></level><level class="para1" eId="regulation-4-1-b"><num>(b)</num><content><p>for the purpose of providing means of access for disabled persons to or within a building or premises to which members of the public are admitted.</p></content></level></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><content><p>In this regulation, “disabled person” has the same meaning as in section 1 of the Disability Discrimination Act 1995<authorialNote class="footnote" eId="f00007" marker="7"><p><ref eId="c00028" href="http://www.legislation.gov.uk/id/ukpga/1995/50">1995 c. 50</ref>.</p></authorialNote>.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-5"><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><intro><p>Regulation 3 shall not apply where the planning authority to which the application is made is satisfied–</p></intro><level class="para1" eId="regulation-5-1-a"><num>(a)</num><level class="para2" eId="regulation-5-1-a-i"><num>(i)</num><content><p>that the application relates solely to development which is within one or more of the classes, other than Class 18, specified in Schedule 1 to the <abbr title="Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (S.I. 1992/223)">General Permitted Development Order</abbr>; and</p></content></level><level class="para2" eId="regulation-5-1-a-ii"><num>(ii)</num><intro><p>that the permission granted by article 3 of that Order does not apply in respect of that development by reason of and only by reason of–</p></intro><level class="para3" eId="regulation-5-1-a-ii-aa"><num>(aa)</num><content><p>a direction made under article 4 of that Order which is in force on the date when the application is made; or</p></content></level><level class="para3" eId="regulation-5-1-a-ii-bb"><num>(bb)</num><content><p>the requirements of a condition imposed on a permission granted or deemed to be granted under Part III of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr> otherwise than by that Order; or</p></content></level></level></level><level class="para1" eId="regulation-5-1-b"><num>(b)</num><content><p>that the application relates to development on land used for the purposes of agriculture, other than dwellinghouses or the buildings excluded by virtue of paragraph (2)(d) of Class 18 in Schedule 1 to the <abbr title="Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (S.I. 1992/223)">General Permitted Development Order</abbr> from that class, and the development is to be used for purposes incidental to that use.</p></content></level></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><content><p>The reference in paragraph (1)(a)(i) to an application which relates to development which is within one or more of the classes specified in Schedule 1 to the <abbr title="Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (S.I. 1992/223)">General Permitted Development Order</abbr> shall include an application for planning permission for the continuance of a use of land, or the retention of buildings or works, without compliance with a condition subject to which a previous planning permission has been granted, and which prohibits or limits the carrying out of any development which is within one or more of the said classes.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><num>6.</num><intro><p>Regulation 3 shall not apply where the planning authority to which the application is made is satisfied–</p></intro><level class="para1" eId="regulation-6-a"><num>(a)</num><content><p>that the application relates solely to the use of a building or other land for a purpose of any class specified in the Schedule to the Town and Country Planning (Use Classes) (Scotland) Order 1997<authorialNote class="footnote" eId="f00008" marker="8"><p><ref eId="c00029" href="http://www.legislation.gov.uk/id/uksi/1997/3061">SI 1997/3061</ref> as amended by <ref eId="c00030" href="http://www.legislation.gov.uk/id/uksi/1998/1196">SI 1998/1196</ref>.</p></authorialNote>;</p></content></level><level class="para1" eId="regulation-6-b"><num>(b)</num><content><p>that the existing use of that building or other land is for another purpose of the same class; and</p></content></level><level class="para1" eId="regulation-6-c"><num>(c)</num><content><p>that the making of an application for planning permission in respect of the use to which the application relates is necessary by reason of and only by reason of a condition imposed on a permission granted or deemed to be granted under Part III of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-7"><num>7.</num><intro><p>Where all the conditions set out in regulation 8 and applicable, as the case may be, to paragraph (a) or (b), are satisfied, regulation 3 shall not apply to an application which is made by the same applicant for–</p></intro><level class="para1" eId="regulation-7-a"><num>(a)</num><intro><p>planning permission for development of the same character or description as development to which an earlier application relates and to no other development and following–</p></intro><level class="para2" eId="regulation-7-a-i"><num>(i)</num><content><p>the withdrawal, before notice of decision was issued of that earlier application for planning permission;</p></content></level><level class="para2" eId="regulation-7-a-ii"><num>(ii)</num><content><p>the granting of planning permission for the development;</p></content></level><level class="para2" eId="regulation-7-a-iii"><num>(iii)</num><content><p>the refusal of planning permission; or</p></content></level><level class="para2" eId="regulation-7-a-iv"><num>(iv)</num><content><p>the making of an appeal to the Scottish Ministers under section 47(2) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr> (appeal in default of planning decision)<authorialNote class="footnote" eId="f00009" marker="9"><p>Section 47 was modified by <abbr class="acronym" title="Scottish Statutory Instrument">SSI</abbr> <ref eId="c00031" href="http://www.legislation.gov.uk/id/ssi/1999/1">1999/1</ref>, regulation 45.</p></authorialNote> in relation to an application for planning permission; or</p></content></level></level><level class="para1" eId="regulation-7-b"><num>(b)</num><intro><p>approval of one or more reserved matters following–</p></intro><level class="para2" eId="regulation-7-b-i"><num>(i)</num><content><p>the withdrawal before notice of decision was issued of an application for approval of the same reserved matters;</p></content></level><level class="para2" eId="regulation-7-b-ii"><num>(ii)</num><content><p>the granting of approval of the same reserved matters;</p></content></level><level class="para2" eId="regulation-7-b-iii"><num>(iii)</num><content><p>the refusal to approve the same reserved matters; or</p></content></level><level class="para2" eId="regulation-7-b-iv"><num>(iv)</num><content><p>the making of an appeal to the Scottish Ministers under section 47(2) of <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr> in relation to an application for approval of the same reserved matters,</p></content></level><wrapUp><p>authorised by the same outline planning permission.</p></wrapUp></level></hcontainer><hcontainer name="regulation" eId="regulation-8"><num>8.</num><intro><p>The conditions referred to in regulation 7 are–</p></intro><level class="para1" eId="regulation-8-a"><num>(a)</num><intro><p>that the application is made within 12 months of the date–</p></intro><level class="para2" eId="regulation-8-a-i"><num>(i)</num><content><p>when the earlier application was made, in the case of a withdrawn application;</p></content></level><level class="para2" eId="regulation-8-a-ii"><num>(ii)</num><content><p>of the relevant grant of planning permission or grant of approval of details of reserved matters, as the case may be;</p></content></level><level class="para2" eId="regulation-8-a-iii"><num>(iii)</num><content><p>of the refusal; or</p></content></level><level class="para2" eId="regulation-8-a-iv"><num>(iv)</num><content><p>when under the relevant provisions of the <abbr title="Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (S.I. 1992/223)">General Permitted Development Order</abbr>, the period for the giving of notice of a decision on the earlier application expired, in the case of an application which is made following an appeal under section 47(2) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>;</p></content></level></level><level class="para1" eId="regulation-8-b"><num>(b)</num><content><p>in the case of an application for planning permission which is not made in outline, that the planning permission which has been granted is not an outline planning permission or that the earlier application was also not made in outline;</p></content></level><level class="para1" eId="regulation-8-c"><num>(c)</num><content><p>in the case of an application for planning permission, the application relates to the same site as that to which the earlier application related, or to part of that site, and to no other land except land included solely for the purpose of providing a different means of access to the site;</p></content></level><level class="para1" eId="regulation-8-d"><num>(d)</num><content><p>in the case of an application for approval of reserved matters, the application relates to the same site as that to which the earlier application related, or to part of that site and to no other land;</p></content></level><level class="para1" eId="regulation-8-e"><num>(e)</num><content><p>no application made by or on behalf of the same applicant in relation to the whole or any part of the site has already been exempted from regulation 3 by virtue of regulation 7 and this regulation; and</p></content></level><level class="para1" eId="regulation-8-f"><num>(f)</num><content><p>the fee payable in respect of the earlier application was paid.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-9"><num>9.</num><intro><p>Regulation 3 shall not apply to impose a fee in relation to an application to a planning authority for permission to carry out development consisting of the winning and working of minerals where the application–</p></intro><level class="para1" eId="regulation-9-a"><num>(a)</num><content><p>is for a permission which consolidates two or more subsisting permissions; or</p></content></level><level class="para1" eId="regulation-9-b"><num>(b)</num><content><p>does not seek permission for development which is not authorised by a subsisting permission.</p></content></level></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Fees for deemed applications</heading><hcontainer name="regulation" eId="regulation-10"><num>10.</num><paragraph eId="regulation-10-1"><num>(1)</num><content><p>Subject to paragraphs (3) and (6), a fee shall be paid to the Scottish Ministers where an application for planning permission is deemed to have been made by virtue of section 133(7) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr> (in consequence of an appeal against an enforcement notice).</p></content></paragraph><paragraph eId="regulation-10-2"><num>(2)</num><content><p>Subject to paragraphs (3) and (4) and regulation 15(2), the fee payable in respect of a deemed application shall be calculated in accordance with the Schedule.</p></content></paragraph><paragraph eId="regulation-10-3"><num>(3)</num><intro><p>This paragraph applies where an application is deemed to have been made by virtue of section 133(7) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>. Where this paragraph applies–</p></intro><level class="para1" eId="regulation-10-3-a"><num>(a)</num><content><p>a fee shall be paid in respect of the application by every person who has made a valid appeal against the relevant enforcement notice;</p></content></level><level class="para1" eId="regulation-10-3-b"><num>(b)</num><content><p>the fee payable shall be twice the fee calculated in accordance with the Schedule;</p></content></level><level class="para1" eId="regulation-10-3-c"><num>(c)</num><content><p>half the fee shall be paid to the Scottish Ministers and the other half shall be paid to the planning authority which served the relevant enforcement notice.</p></content></level></paragraph><paragraph eId="regulation-10-4"><num>(4)</num><content><p>The fee due in respect of a deemed application shall accompany the written notice of the relevant appeal to the Scottish Ministers.</p></content></paragraph><paragraph eId="regulation-10-5"><num>(5)</num><intro><p>In the case of an application deemed to have been made by virtue of section 133(7) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>, this regulation shall not apply where the person who has appealed against the relevant enforcement notice had–</p></intro><level class="para1" eId="regulation-10-5-a"><num>(a)</num><content><p>before the date when the notice was served, made an application to the planning authority for planning permission for the development to which the relevant enforcement notice relates and had paid the fee payable in respect of that application; or</p></content></level><level class="para1" eId="regulation-10-5-b"><num>(b)</num><content><p>before the date specified in the notice as the date on which the notice is to take effect, made an appeal to the Scottish Ministers under section 47(2) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>,</p></content></level><wrapUp><p>and at the date when the relevant enforcement notice was served that application or, in the case of an appeal made before the date on which the enforcement notice is to take effect, that appeal, had not been determined.</p></wrapUp></paragraph><paragraph eId="regulation-10-6"><num>(6)</num><intro><p>Regulations 4, 5 and 6 shall apply to a deemed application as they apply to an application for planning permission made to the planning authority, with the following modifications–</p></intro><level class="para1" eId="regulation-10-6-a"><num>(a)</num><content><p>references to the planning authority to whom the application is made shall be construed as references to the Scottish Ministers; and</p></content></level><level class="para1" eId="regulation-10-6-b"><num>(b)</num><content><p>references to the development to which the application relates shall be construed as references to the use of land or the operations to which the relevant enforcement notice relates.</p></content></level></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Refunds of fees for deemed applications</heading><hcontainer name="regulation" eId="regulation-11"><num>11.</num><paragraph eId="regulation-11-1"><num>(1)</num><intro><p>In the case of an application deemed to have been made by virtue of section 133 (7) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>, the amount of any fee paid in respect of the deemed application shall be refunded to the appellant in the following circumstances–</p></intro><level class="para1" eId="regulation-11-1-a"><num>(a)</num><content><p>where the Scottish Ministers decline jurisdiction on the relevant appeal under section 130 of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr> on the grounds that it does not comply with one or more of the requirements of subsection (1) of that section;</p></content></level><level class="para1" eId="regulation-11-1-b"><num>(b)</num><intro><p>where the Scottish Ministers under section 132(3) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>–</p></intro><level class="para2" eId="regulation-11-1-b-i"><num>(i)</num><content><p>dismiss the appeal on the grounds that the appellant has failed to comply with section 130(3) within the time prescribed under section 131(1); or</p></content></level><level class="para2" eId="regulation-11-1-b-ii"><num>(ii)</num><content><p>allow the appeal and quash the enforcement notice on the grounds that the planning authority failed to comply with any requirement imposed by virtue of paragraph (b), (c) or (e) of section 131(1);</p></content></level></level><level class="para1" eId="regulation-11-1-c"><num>(c)</num><content><p>where the planning authority withdraws the relevant enforcement notice before it takes effect or if the Scottish Ministers consider that there was no subject matter to appeal against since the purposed enforcement notice had no legal effect; and</p></content></level><level class="para1" eId="regulation-11-1-d"><num>(d)</num><content><p>save in the case of an application deemed to have been made in connection with an enforcement notice alleging a breach of planning control by the use of land as a caravan site or where, on the determination of the appeal, the Scottish Ministers issue a certificate under section 150<authorialNote class="footnote" eId="f00010" marker="10"><p>Section 150 was modified by <ref eId="c00032" href="http://www.legislation.gov.uk/id/ssi/2000/323">S.S.I. 2000/323</ref>, regulation 7(5).</p></authorialNote> or section 151 of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr> in accordance with section 154(3) of that Act, where the Scottish Ministers allow the appeal against the relevant enforcement notice on any of the grounds set out in section 130(1)(b) to (g) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>.</p></content></level></paragraph><paragraph eId="regulation-11-2"><num>(2)</num><level class="para1" eId="regulation-11-2-a"><num>(a)</num><intro><p>In the event of the relevant appeal under section 130 or section 154 of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr> being withdrawn with the result that there are at least 21 days between the date of withdrawal and–</p></intro><level class="para2" eId="regulation-11-2-a-i"><num>(i)</num><content><p>the date or, in the event of postponement, the latest date appointed for the holding of an inquiry into that appeal; or</p></content></level><level class="para2" eId="regulation-11-2-a-ii"><num>(ii)</num><content><p>in the case of an appeal which is being dealt with by way of written submissions, the date or, in the event of postponement, the latest date appointed for the inspection of the site to which the enforcement notice relates,</p></content></level><wrapUp><p>any fee paid in respect of the deemed application shall be refunded to the appellant.</p></wrapUp></level><level class="para1" eId="regulation-11-2-b"><num>(b)</num><content><p>For the purposes of this paragraph an appeal shall be treated as being withdrawn on the date on which notice in writing of the withdrawal is received by the Scottish Ministers.</p></content></level></paragraph><paragraph eId="regulation-11-3"><num>(3)</num><content><p>The reference in paragraph (2) to an appeal being dealt with by way of written submissions shall be construed as a reference to an appeal in respect of which no local inquiry is to be held under section 265 of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr><authorialNote class="footnote" eId="f00011" marker="11"><p>Section 265 applied by the Planning (Hazardous Substances) (Scotland) Act <ref eId="c00033" href="http://www.legislation.gov.uk/id/ukpga/1997/10">1997 (c. 10)</ref>, sections 36, 40(2) (with sections 9(3), 10(5), 38(6)).</p></authorialNote>.</p></content></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Fees for applications for certificates of lawful use or development</heading><hcontainer name="regulation" eId="regulation-12"><num>12.</num><paragraph eId="regulation-12-1"><num>(1)</num><content><p>Subject to paragraphs (2), (3) and (4), where an application is made to a planning authority under section 150(1) (certificate of lawful use or development) or section 151 (certificate of proposed use or development) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr> a fee shall be paid to that authority.</p></content></paragraph><paragraph eId="regulation-12-2"><num>(2)</num><content><p>This regulation shall not apply where the planning authority to which the application is made is satisfied that it relates solely to the carrying out of operations specified in regulation 4 for the purposes specified in that regulation.</p></content></paragraph><paragraph eId="regulation-12-3"><num>(3)</num><intro><p>Where all of the conditions set out in paragraph (4) are satisfied, this regulation shall not apply to–</p></intro><level class="para1" eId="regulation-12-3-a"><num>(a)</num><content><p>an application which is made following the withdrawal (before notice of decision was issued) of an application made by or on behalf of the same applicant;</p></content></level><level class="para1" eId="regulation-12-3-b"><num>(b)</num><content><p>an application which is made following the refusal of an application (whether by the planning authority or the Scottish Ministers on appeal) made by or on behalf of the same applicant.</p></content></level></paragraph><paragraph eId="regulation-12-4"><num>(4)</num><intro><p>The conditions referred to in paragraph (3) are–</p></intro><level class="para1" eId="regulation-12-4-a"><num>(a)</num><intro><p>that the application is made within 12 months of–</p></intro><level class="para2" eId="regulation-12-4-a-i"><num>(i)</num><content><p>the date when the earlier application was made, in the case of a withdrawn application; or</p></content></level><level class="para2" eId="regulation-12-4-a-ii"><num>(ii)</num><content><p>the date of refusal, in any other case;</p></content></level></level><level class="para1" eId="regulation-12-4-b"><num>(b)</num><content><p>that the application relates to the same site as that to which the earlier application related, or to part of that site and to no other land;</p></content></level><level class="para1" eId="regulation-12-4-c"><num>(c)</num><content><p>that the planning authority to which the application is made is satisfied that it relates to a use, operation or other matter of the same description as the use, operation or matter to which the earlier application related and to no other use, operation or matter;</p></content></level><level class="para1" eId="regulation-12-4-d"><num>(d)</num><content><p>that the fee payable in respect of the earlier application was paid; and</p></content></level><level class="para1" eId="regulation-12-4-e"><num>(e)</num><content><p>that no application made by or on behalf of the same applicant in relation to the whole or any part of the site has already been exempted from this regulation by paragraph (3).</p></content></level></paragraph><paragraph eId="regulation-12-5"><num>(5)</num><intro><p>Subject to paragraphs (6) to (10), the fee payable in respect of an application to which this regulation applies shall be–</p></intro><level class="para1" eId="regulation-12-5-a"><num>(a)</num><content><p>in the case of an application under section 150(1)(a) or (b) (or under both paragraphs), the amount that would be payable in respect of an application for planning permission to institute the use or carry out the operations specified in the application (or an application to do both, as the case may be);</p></content></level><level class="para1" eId="regulation-12-5-b"><num>(b)</num><content><p>in the case of an application under section 150(1)(c), £120, and on or after 1st April 2005, £130;</p></content></level><level class="para1" eId="regulation-12-5-c"><num>(c)</num><content><p>in the case of an application under section 151(1), half the amount that would be payable in respect of an application for planning permission to institute the use or carry out the operations specified in the application (or an application to do both, as the case may be).</p></content></level></paragraph><paragraph eId="regulation-12-6"><num>(6)</num><content><p>Where a use specified in an application under section 151(1)(a) is use as one or more separate dwellinghouses, the fee payable in respect of that use shall be £240 for each dwellinghouse, subject to a maximum of £12,000, and on or after 1st April 2005, shall be £260 for each dwellinghouse, subject to a maximum of £13,000.</p></content></paragraph><paragraph eId="regulation-12-7"><num>(7)</num><content><p>Where an application is made under section 150(1)(a) or (b) (or under both paragraphs) and under section 150(1)(c), the fee payable shall be the sum of the fees that would have been payable if there had been an application under section 150(1)(a) or (b) (or under both paragraphs, as the case may be) and a separate application under section 150(1)(c).</p></content></paragraph><paragraph eId="regulation-12-8"><num>(8)</num><content><p>In the case of an application which relates to land in the area of two or more planning authorities, paragraph 8 of Part II of the Schedule shall apply for the purpose of determining the authority to which the fee shall be payable and the amount payable as it applies in the case of an application for planning permission which relates to such land.</p></content></paragraph><paragraph eId="regulation-12-9"><num>(9)</num><content><p>Where an application is made by or on behalf of a community council, the fee payable shall be one-half of the amount that would otherwise be payable in accordance with paragraphs (5) to (8).</p></content></paragraph><paragraph eId="regulation-12-10"><num>(10)</num><content><p>The fee due in respect of an application to which this regulation applies shall accompany the application when it is lodged with the planning authority.</p></content></paragraph><paragraph eId="regulation-12-11"><num>(11)</num><content><p>Any fee paid pursuant to this regulation shall be refunded if the application is rejected as invalidly made.</p></content></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Fees for certain applications for the prior approval of the planning authority</heading><hcontainer name="regulation" eId="regulation-13"><num>13.</num><paragraph eId="regulation-13-1"><num>(1)</num><content><p>Where an application is made to a planning authority for determination as to whether the prior approval of the authority will be required in relation to development under Schedule 1 to the <abbr title="Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (S.I. 1992/223)">General Permitted Development Order</abbr> a fee shall be paid to that authority of £46, and on or after 1st April 2005, £50.</p></content></paragraph><paragraph eId="regulation-13-2"><num>(2)</num><content><p>Any fee paid under this regulation shall be refunded if the application is rejected as invalidly made.</p></content></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Fees for applications for consent for advertisements</heading><hcontainer name="regulation" eId="regulation-14"><num>14.</num><paragraph eId="regulation-14-1"><num>(1)</num><content><p>Where an application is made to a planning authority under regulation 15 of the <abbr title="Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984 (S.I. 1984/467)">1984 Regulations</abbr> for consent for the display of an advertisement, a fee shall accompany the application and shall be paid to that authority in accordance with this regulation.</p></content></paragraph><paragraph eId="regulation-14-2"><num>(2)</num><content><p>Subject to the provisions of paragraphs (3) to (7) the fee payable in respect of each site on which one or more than one advertisement is to be displayed shall be £120, and on or after 1st April 2005, £130.</p></content></paragraph><paragraph eId="regulation-14-3"><num>(3)</num><content><p>Where the application relates to the display of advertisements on parking meters, litter bins, public seating benches or bus shelters within a specified area, the whole of the area to which the application relates shall be treated as one site for the purpose of this regulation.</p></content></paragraph><paragraph eId="regulation-14-4"><num>(4)</num><content><p>Where the application is made by a community council, the amount of the fee payable in respect of the application shall be reduced by one half.</p></content></paragraph><paragraph eId="regulation-14-5"><num>(5)</num><intro><p>Where all of the conditions set out in paragraph (6) are satisfied, this regulation shall not apply to an application for the display of advertisements which is made following–</p></intro><level class="para1" eId="regulation-14-5-a"><num>(a)</num><content><p>the withdrawal before notice of decision was issued; or</p></content></level><level class="para1" eId="regulation-14-5-b"><num>(b)</num><content><p>the refusal of consent whether by the planning authority or by the Scottish Ministers on appeal,</p></content></level><wrapUp><p>in respect of an application for the display of advertisements made by the same person.</p></wrapUp></paragraph><paragraph eId="regulation-14-6"><num>(6)</num><intro><p>The conditions referred to in paragraph (5) are–</p></intro><level class="para1" eId="regulation-14-6-a"><num>(a)</num><intro><p>that the application is made within 12 months of–</p></intro><level class="para2" eId="regulation-14-6-a-i"><num>(i)</num><content><p>the date when the earlier application was made, in the case of a withdrawn application; or</p></content></level><level class="para2" eId="regulation-14-6-a-ii"><num>(ii)</num><content><p>in any other case, the date of refusal;</p></content></level></level><level class="para1" eId="regulation-14-6-b"><num>(b)</num><content><p>that the application relates to the same site as that to which the earlier application related, or to part of that site;</p></content></level><level class="para1" eId="regulation-14-6-c"><num>(c)</num><content><p>that the planning authority to which the application is made is satisfied that it relates to an advertisement or advertisements, of the same description other than content, as the advertisement or advertisements to which the earlier application related;</p></content></level><level class="para1" eId="regulation-14-6-d"><num>(d)</num><content><p>that the fee payable in respect of the earlier application was paid; and</p></content></level><level class="para1" eId="regulation-14-6-e"><num>(e)</num><intro><p>that no previous application has at any time been made by the same applicant which related to–</p></intro><level class="para2" eId="regulation-14-6-e-i"><num>(i)</num><content><p>the same site as the site to which the earlier application related; and</p></content></level><level class="para2" eId="regulation-14-6-e-ii"><num>(ii)</num><content><p>an advertisement of the same description other than content as any advertisement to which the earlier application related, and which was exempted from the provisions of this regulation by paragraph (5).</p></content></level></level></paragraph><paragraph eId="regulation-14-7"><num>(7)</num><content><p>No fee is payable under this regulation in respect of an application for consent to display an advertisement if the application is occasioned by direction under regulation 11 of the <abbr title="Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984 (S.I. 1984/467)">1984 Regulations</abbr> disapplying regulation 10 in relation to that advertisement.</p></content></paragraph><paragraph eId="regulation-14-8"><num>(8)</num><content><p>Any fee paid under this regulation shall be refunded if the relevant application is rejected as invalidly made.</p></content></paragraph></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Revocation</heading><hcontainer name="regulation" PERMISSION OR FOR APPROVAL OF RESERVED MATTERS</heading><part eId="schedule-part-I"><num>PART I</num><heading>INTRODUCTION</heading><paragraph eId="schedule-paragraph-1" class="schProv1"><num>1.</num><intro><p>In this Schedule–</p></intro><level class="para1" eId="schedule-paragraph-1-a"><num>(a)</num><content><p>any reference to a category of development shall be taken to mean one of the categories of development specified in column 1 of the tables set out in Part III;</p></content></level><level class="para1" eId="schedule-paragraph-1-b"><num>(b)</num><content><p>in the case of an application for approval of reserved matters, references to the category of development to which an application relates shall be construed as references to the category of development authorised by the relevant outline planning permission;</p></content></level><level class="para1" eId="schedule-paragraph-1-c"><num>(c)</num><intro><p>in the case of an application for planning permission which is deemed to have been made by virtue of section 133(7) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>, references to–</p></intro><level class="para2" eId="schedule-paragraph-1-c-i"><num>(i)</num><content><p>the development to which an application relates shall be construed as references to the use of land or the operations as the case may be to which the relevant enforcement notice relates;</p></content></level><level class="para2" eId="schedule-paragraph-1-c-ii"><num>(ii)</num><content><p>the amount of floor space or the number of dwellinghouses to be created by the development shall be construed as references to the amount of purposes for which it is proposed that floor space be used shall be construed as references to the purposes for which floor space was stated to be used in the enforcement notice.</p></content></level></level></paragraph></part><part eId="schedule-part-II"><num>PART II</num><heading>GENERAL PROVISIONS</heading><paragraph eId="schedule-paragraph-2" class="schProv1"><num>2.</num><intro><p>Subject to paragraphs 3 to 10, the fee payable under regulation 3 or regulation 10 for a category of development shall be calculated in accordance with–</p></intro><level class="para1" eId="schedule-paragraph-2-a"><num>(a)</num><content><p>for the period up to and including 31 March 2005, the appropriate entry specified in Column 2 of Table 1;</p></content></level><level class="para1" eId="schedule-paragraph-2-b"><num>(b)</num><content><p>for the period on or after 1st April 2005, the appropriate entry specified in Column 2 of Table 2; and</p></content></level><wrapUp><p>paragraphs 11 to 14.</p></wrapUp></paragraph><paragraph eId="schedule-paragraph-3" class="schProv1"><num>3.</num><content><p>Where an application or deemed application is made or deemed to be made by a community council, the fee payable shall be one half of the amount that would otherwise be payable.</p></content></paragraph><paragraph eId="schedule-paragraph-4" class="schProv1"><num>4.</num><subparagraph eId="schedule-paragraph-4-1"><num>(1)</num><content><p>Where an application or deemed application is made or deemed to be made by a club, society, trust or other organisation which is not established or conducted for profit and whose objects are the provision of facilities for sport or recreation, and the conditions specified in sub paragraph (2) are satisfied, the fee payable shall be £240, and on or after 1st April 2005, £260.</p></content></subparagraph><subparagraph eId="schedule-paragraph-4-2"><num>(2)</num><intro><p>The conditions referred to in sub-paragraph (1) are–</p></intro><level class="para1" eId="schedule-paragraph-4-2-a"><num>(a)</num><intro><p>that the application or deemed application relates to–</p></intro><level class="para2" eId="schedule-paragraph-4-2-a-i"><num>(i)</num><content><p>the making of a material change in the use of land to use as a playing field; or</p></content></level><level class="para2" eId="schedule-paragraph-4-2-a-ii"><num>(ii)</num><content><p>the carrying out of operations other than the erection of a building containing floor space, for purposes ancillary to the use of land as playing field,</p></content></level><wrapUp><p>and to no other development; and</p></wrapUp></level><level class="para1" eId="schedule-paragraph-4-2-b"><num>(b)</num><content><p>that the planning authority with which the application is lodged is, or, in the case of a deemed application, the Scottish Ministers are, satisfied that the development is to be carried out on land which is, or is intended to be, occupied by the club, society, trust or organisation and used wholly or mainly for the carrying out of its objects.</p></content></level></subparagraph></paragraph><paragraph eId="schedule-paragraph-5" class="schProv1"><num>5.</num><subparagraph eId="schedule-paragraph-5-1"><num>(1)</num><intro><p>This paragraph applies where–</p></intro><level class="para1" eId="schedule-paragraph-5-1-a"><num>(a)</num><content><p>an application is made for approval of one or more reserved matters (“the current application”);</p></content></level><level class="para1" eId="schedule-paragraph-5-1-b"><num>(b)</num><content><p>the applicant has previously applied for such approval under the same outline planning permission and paid fees in relation to one or more such applications; and</p></content></level><level class="para1" eId="schedule-paragraph-5-1-c"><num>(c)</num><content><p>no application has been made under that permission other than by the applicant.</p></content></level></subparagraph><subparagraph eId="schedule-paragraph-5-2"><num>(2)</num><content><p>Where the amount paid as mentioned in sub-paragraph (1)(b) is not less than the amount which would be payable if the applicant were by the current application seeking approval of all the matters reserved by the outline permission and in relation to the whole of the development authorised by the permission, the fee payable in respect of the current application shall be £240, and on or after 1st April 2005, £260.</p></content></subparagraph><subparagraph eId="schedule-paragraph-5-3"><num>(3)</num><intro><p>Where–</p></intro><level class="para1" eId="schedule-paragraph-5-3-a"><num>(a)</num><content><p>a fee has been paid as mentioned in sub-paragraph (1)(b) at a rate lower than that prevailing at the date of the current application; and</p></content></level><level class="para1" eId="schedule-paragraph-5-3-b"><num>(b)</num><content><p>sub-paragraph (2) would apply if that fee had been paid at the rate applying at that date, the fee in respect of the current application shall be £240, and on or after 1st April 2005, £260.</p></content></level></subparagraph></paragraph><paragraph eId="schedule-paragraph-6" class="schProv1"><num>6.</num><content><p>Where application is made for planning permission for the development of land without complying with conditions subject to which a previous planning permission was granted the fee payable in respect of the application shall be £120, and on or after 1st April 2005, £130.</p></content></paragraph><paragraph eId="schedule-paragraph-7" class="schProv1"><num>7.</num><intro><p>Where an application relates to development to which section 33 of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr> applies, the fee payable in respect of the application shall be–</p></intro><level class="para1" eId="schedule-paragraph-7-a"><num>(a)</num><content><p>where the application relates to development carried out without permission, the fee that would be payable if the application were for planning permission to carry out that development; and</p></content></level><level class="para1" eId="schedule-paragraph-7-b"><num>(b)</num><content><p>in any other case, £120, and on or after 1st April 2005, £130.</p></content></level></paragraph><paragraph eId="schedule-paragraph-8" class="schProv1"><num>8.</num><subparagraph eId="schedule-paragraph-8-1"><num>(1)</num><content><p>This paragraph applies where applications are made or deemed to have been made by virtue of section 133(7) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr> for planning permission or for the approval of reserved matters in respect of the development of land lying in the areas of 2 or more planning authorities.</p></content></subparagraph><subparagraph eId="schedule-paragraph-8-2"><num>(2)</num><content><p>The amount payable in respect of all the applications shall be one and a half times the amount which would have been payable if application had been made to a single authority in respect of the whole development or the sum of the amounts which would have been payable but for this paragraph whichever is the lesser.</p></content></subparagraph><subparagraph eId="schedule-paragraph-8-3"><num>(3)</num><content><p>In applications other than deemed applications the fee payable under sub-paragraph (2) shall accompany only the application to the planning authority in whose area the larger or largest part of the land to which the applications relate is situated.</p></content></subparagraph><subparagraph eId="schedule-paragraph-8-4"><num>(4)</num><content><p>In deemed applications the fee payable to the Scottish Ministers shall be the amount which would be payable by virtue of sub-paragraph (2) if applications for the like permission had been made to the relevant planning authorities on the date on which notice of appeal was given in accordance with section 130(2) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>.</p></content></subparagraph></paragraph><paragraph eId="schedule-paragraph-9" class="schProv1"><num>9.</num><subparagraph eId="schedule-paragraph-9-1"><num>(1)</num><intro><p>Where application is made–</p></intro><level class="para1" eId="schedule-paragraph-9-1-a"><num>(a)</num><content><p>for planning permission in respect of 2 or more proposals for the development of the same land; or</p></content></level><level class="para1" eId="schedule-paragraph-9-1-b"><num>(b)</num><content><p>for approval of reserved matters in respect of 2 or more proposals for the carrying out of the development authorised by an outline planning permission,</p></content></level><wrapUp><p>and application is made in respect of all the proposals on the same date and by the same applicant a single fee shall be payable in respect of all such proposals, calculated as provided in sub paragraph (2).</p></wrapUp></subparagraph><subparagraph eId="schedule-paragraph-9-2"><num>(2)</num><intro><p>Calculations shall be made in accordance with this Schedule of the fee appropriate to each of the proposals and the single fee payable in respect of all the proposals shall be the sum of–</p></intro><level class="para1" eId="schedule-paragraph-9-2-a"><num>(a)</num><content><p>an amount equal to the highest fee calculated in respect of each of the proposals; and</p></content></level><level class="para1" eId="schedule-paragraph-9-2-b"><num>(b)</num><content><p>an amount calculated by adding together the fees appropriate to all of the proposals, other than the fee referred to in sub-sub-paragraph (a) and dividing that total by the figure of 2.</p></content></level></subparagraph></paragraph></part><part eId="schedule-part-III"><num>PART III</num><heading>SCALES OF FEES <abbr title="Et cetera" xml:lang="la">ETC</abbr></heading><paragraph eId="schedule-paragraph-10" class="schProv1"><num>10.</num><intro><p>Where, in respect of any category of development the fee is to be calculated by reference to the site area–</p></intro><level class="para1" eId="schedule-paragraph-10-a"><num>(a)</num><content><p>that area shall be taken as consisting of the area of land to which the application relates or, in the case of an application for planning permission which is deemed to have been made by virtue of section 133(7) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>, the area of land to which the relevant enforcement notice relates; and</p></content></level><level class="para1" eId="schedule-paragraph-10-b"><num>(b)</num><content><p>where the area referred to in sub-paragraph (a) is not an exact multiple of the unit of measurement specified in respect of the relevant category of development, the fraction of a unit remaining after division of the total area by the unit of measurement shall be treated as a complete unit.</p></content></level></paragraph><paragraph eId="schedule-paragraph-11" class="schProv1"><num>11.</num><intro><p>In relation to development within category 2–</p></intro><level class="para1" eId="schedule-paragraph-11-a"><num>(a)</num><content><p>the area of gross floor space to be created by the development shall be ascertained by external measurement of the floor space, whether or not it is to be bounded wholly or partly by external walls of a building,</p></content></level><level class="para1" eId="schedule-paragraph-11-b"><num>(b)</num><content><p>where the area of gross floor space to be created by the development exceeds 75 square metres and is not an exact multiple of 75 square metres, the area remaining after division of the total number of square metres of gross floor space by the figure of 75 shall be treated as being 75 square metres.</p></content></level></paragraph><paragraph eId="schedule-paragraph-12" class="schProv1"><num>12.</num><subparagraph eId="schedule-paragraph-12-1"><num>(1)</num><content><p>Where an application, or a deemed application other than an outline application, relates to development which is partly within category 1 and partly within category 2, the following sub-paragraphs shall apply for the purpose of calculating the fee.</p></content></subparagraph><subparagraph eId="schedule-paragraph-12-2"><num>(2)</num><content><p>The amount of gross floor space which is to be created by that part of the development which is within category 2 (“the non-residential floor space”), shall be calculated and the sum payable in respect of that non-residential floor space shall be added to the sum payable in respect of that part of the development which is within category 1 and, subject to sub-paragraph (4), the result of the addition shall be the fee payable.</p></content></subparagraph><subparagraph eId="schedule-paragraph-12-3"><num>(3)</num><content><p>For the purpose of sub-paragraph (2) where any of the buildings is to contain floor space for the purposes of providing common access or common services or facilities for persons occupying or using that building for residential purposes and for persons occupying or using it for non-residential purposes (“common floor space”), the amount of non-residential floor space shall be assessed in relation to that building, as including such proportion of the common floor space as the amount of non-residential floor space in the building bears to the total amount of gross floor space in the building.</p></content></subparagraph><subparagraph eId="schedule-paragraph-12-4"><num>(4)</num><content><p>Where an application or deemed application to which this paragraph applies relates to development which is also within one or more than one of categories 3 to 12 an amount shall be calculated in accordance with each such category and if any of the amounts so calculated exceeds the amount calculated in accordance with sub-paragraph (2) that higher amount shall be the fee payable in respect of all of the development to which the application or deemed application relates.</p></content></subparagraph></paragraph><paragraph eId="schedule-paragraph-13" class="schProv1"><num>13.</num><intro><p>Subject to paragraph 12 where an application or deemed application, other than an outline application, relates to development which is within more than one of the categories–</p></intro><level class="para1" eId="schedule-paragraph-13-a"><num>(a)</num><content><p>an amount shall be calculated in respect of each category; and</p></content></level><level class="para1" eId="schedule-paragraph-13-b"><num>(b)</num><content><p>the highest amount so calculated shall be the fee payable in respect of the application or deemed application.</p></content></level></paragraph><paragraph eId="schedule-paragraph-14" class="schProv1"><num>14.</num><content><p>Where an application is for outline planning permission and relates to development which is within more than one of the categories the fee payable in respect of the application shall be £240 for each 0.1 hectares of the site area, subject to a maximum of £6,000, and on class="explanatoryNote"><subheading>(This note is not part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>These Regulations revoke the Town and Country Planning (Fees for Applications and Deemed Applications) (Scotland) Regulations 1997, the Town and Country Planning (Fees for Applications and Deemed Applications) (Scotland) Amendment Regulations 2000 and the Town and Country Planning (Fees for Applications and Deemed Applications) (Scotland) Amendment Regulation 2002 and make provision for the payment of fees:–</p><blockContainer ukl:Name="P3" class="para1"><num>(a)</num><p>to planning authorities in respect of applications made under Part III of the Town and Country Planning (Scotland) Act 1997 for planning permission for development or for approval of matters reserved by an outline planning permission and in respect of applications for consent for the display of advertisements;</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(b)</num><p>to the Scottish Ministers in respect of applications for planning permission which are deemed to have been made, by virtue of the provisions of section 133(7) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>, in connection with an appeal against an enforcement notice; and</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(c)</num><p>for applications for certificates of lawful use or development made under section 150(1) and certificates of proposed use or development under section 151(1) of the <abbr title="Town and Country Planning (Scotland) Act 1997 c. 8">1997 Act</abbr>.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><p>The effect of these Regulations is that all fees are increased by approximately 10%, from the date the regulations come into force on or after 1st June 2004, and by a further 10% approximately which is to apply on or after 1st April
