in exercise of the powers conferred by sections 17P, 105(7) and 108(1) of the National Health Service (Scotland) Act 1978<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00002" Section 17P was inserted by the <ref eId="c00003" href="http://www.legislation.gov.uk/id/asp/2004/1">Primary Medical Services (Scotland) Act 2004 (asp 1)</ref>, section 5(2) and is extended by the Health and Medicines Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1988/49">1988 (c. 49)</ref>, section 17 as amended by <ref eId="c00005" href="http://www.legislation.gov.uk/id/ssi/2004/167">S.S.I. 2004/167</ref>; section 105(7) was amended by the Health Services Act <ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/1980/53">1980 (c. 53)</ref>, Schedule 6, paragraph 5 and Schedule 7, the Health and Social Services and Social Security Adjudications Act <ref eId="c00007" href="http://www.legislation.gov.uk/id/ukpga/1983/41">1983 (c. 41)</ref>, Schedule 9, paragraph 24 and the Health Act <ref eId="c00008" href="http://www.legislation.gov.uk/id/ukpga/1999/8">1999 (c. 8)</ref>, Schedule 4, paragraph 60; section 108(1) defines “prescribed” and “regulations”. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act <ref eId="c00009" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c. 46)</ref>.</p></authorialNote> and of all other powers enabling them in that behalf, hereby make the following Regulations:</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation and commencement</heading><num>1.</num><content><p>These Regulations may be cited as the National Health Service (Primary Medical Services Performers Lists) (Scotland) Amendment Regulations 2004 and shall come into force on 7th June 2004.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Amendment of the National Health Service (Primary Medical Services Performers Lists) (Scotland) Regulations 2004</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><content><p>The National Health Service (Primary Medical Services Performers Lists) (Scotland) Regulations 2004<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00010" href="http://www.legislation.gov.uk/id/ssi/2004/114">S.S.I. 2004/114</ref>.</p></authorialNote> shall be amended as provided in this regulation.</p></content></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p>In regulation 7(5) (decisions and grounds for refusal and deferral) for “paragraph (3)” substitute “paragraph (4)”.</p></content></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><intro><p>In regulation 10 (removal from the primary medical services performers list of medical practitioners not performing primary medical services)–</p></intro><level class="para1" eId="regulation-2-3-a"><num>(a)</num><content><p>in paragraphs (1) and (2)(a) for “service” substitute “services”; and</p></content></level><level class="para1" eId="regulation-2-3-b"><num>(b)</num><content><p>in paragraph (7) for “medical practitioner” substitute “performer”.</p></content></level></paragraph><paragraph eId="regulation-2-4"><num>(4)</num><intro><p>In regulation 11 (re-inclusion in a primary medical services performers list)–</p></intro><level class="para1" eId="regulation-2-4-a"><num>(a)</num><content><p>for “performer's” substitute “performers”; and</p></content></level><level class="para1" eId="regulation-2-4-b"><num>(b)</num><content><p>for “practitioner” substitute “person”.</p></content></level></paragraph><paragraph eId="regulation-2-5"><num>(5)</num><content><p>In sub-paragraph (c) of paragraph (3) and sub-paragraph (j) of paragraph (8) of regulation 14 (disclosure of information) omit “that” in the second place where it occurs in each of those sub-paragraphs.</p></content></paragraph><paragraph eId="regulation-2-6"><num>(6)</num><intro><p>In Schedule 1–</p></intro><level class="para1" eId="regulation-2-6-a"><num>(a)</num><content><p>in paragraph 2(b) before “register of medical practitioners” insert “the”;</p></content></level><level class="para1" eId="regulation-2-6-b"><num>(b)</num><intro><p>in paragraph 3–</p></intro><level class="para2" eId="regulation-2-6-b-i"><num>(i)</num><content><p>in sub-paragraph (b)(iii) omit “in” in the first place where it occurs;
