section 40 was amended by the Sheriff Courts (Scotland) Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/1913/28">1913 c. 28</ref>, Schedule 1; the Secretaries of State Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1926/18">1926 c. 18</ref>, section 1(3); the Administration of Justice (Scotland) Act <ref eId="c00005" href="http://www.legislation.gov.uk/id/ukpga/1933/41">1933 c. 41</ref>, Schedule; the Divorce Jurisdiction, Court Fees and Legal Aid (Scotland) Act <ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/1983/12">1983 c. 12</ref>, Schedule 1, paragraph 7 and Schedule 2; and the Law Reform (Miscellaneous Provisions) (Scotland) Act <ref eId="c00007" href="http://www.legislation.gov.uk/id/ukpga/1990/40">1990 c. 40</ref>, Schedule 9, paragraph 1.</p></authorialNote> and of all other powers enabling them in that behalf, do hereby enact and declare:</p></formula></preamble><body><article eId="section-1"><heading>Citation and commencement</heading><num>1.</num><paragraph eId="section-1-1"><num>(1)</num><content><p>This Act of Sederunt may be cited as the Act of Sederunt (Fees of Shorthand Writers in the Sheriff Court) (Amendment) 2004 and shall come into force on 4th May 2004.</p></content></paragraph><paragraph eId="section-1-2"><num>(2)</num><content><p>This Act of Sederunt shall be inserted in the Books of Sederunt.</p></content></paragraph></article><article eId="section-2"><heading>Increase in fees of shorthand writers</heading><num>2.</num><paragraph eId="section-2-1"><num>(1)</num><content><p>The Table of Fees set out in the Act of Sederunt (Fees of Witnesses and Shorthand Writers in the Sheriff Court) 1992<authorialNote class="footnote" eId="f00002" marker="2"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00008" href="http://www.legislation.gov.uk/id/uksi/1992/1878">1992/1878</ref>; the most recent amendment was by <ref eId="c00009" href="http://www.legislation.gov.uk/id/ssi/2003/246">S.S.I. 2003/246</ref>.</p></authorialNote> shall be amended in accordance with the following sub-paragraph.</p></content></paragraph><paragraph eId="section-2-2"><num>(2)</num><intro><p>In Schedule 2 (shorthand writers' fees)–</p></intro><level class="para1" eId="section-2-2-a"><num>(a)</num><content><p>in paragraph 1 (attendance), for the amounts of £30.53 and £122.09 there shall be substituted the amounts of £31.51 and £126.00 respectively;</p></content></level><level class="para1" eId="section-2-2-b"><num>(b)</num><content><p>in paragraph 4 (transcripts), for the amounts of £5.00 and £6.12 there shall be substituted the amounts of £5.16 and £6.32 respectively;
