<Text>These Regulations may be cited as the Registration of Foreign Adoptions (Scotland) Regulations 2003, and shall come into force on 1st June 2003.</Text>

<P1group>
<Title>Interpretation</Title>
<P1 DocumentURI="http://www.legislation.gov.uk/ssi/2003/67/regulation/2/made" IdURI="http://www.legislation.gov.uk/id/ssi/2003/67/regulation/2" id="regulation-2">
<Pnumber>2</Pnumber>
<P1para>
<Text>In these Regulations–</Text>
<UnorderedList Decoration="none" Class="Definition">

<Text>“the <Abbreviation Expansion="Adoption (Scotland) Act 1978 c. 28">1978 Act</Abbreviation>” means the Adoption (Scotland) Act 1978;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“the Adopted Children Register” has the same meaning as in section 45 of the 1978 Act<FootnoteRef Ref="f00003"/>;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“central authority” has the same meaning as in <Abbreviation Expansion="the Convention on Protection of Children and Co-operation in respect of Intercountry Adoption, concluded at the Hague on 29th May 1993">the Convention</Abbreviation>;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“the Convention” means the Convention on Protection of Children and Co-operation in respect of Intercountry Adoption, concluded at the Hague on 29th May 1993<FootnoteRef Ref="f00004"/>;</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“Convention adoption” means an adoption effected under the law of any country or territory outside the British Islands in which the Convention is in force, and certified in pursuance of Article 23(1) of the Convention; and</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>“overseas adoption” has the same meaning as in section 65(2) of the 1978 Act<FootnoteRef Ref="f00005"/>.</Text>
</Para>

<Title>Form of an entry in the Adopted Children Register</Title>

<Text>An entry made in the Adopted Children Register in respect of a Convention adoption or an overseas adoption shall be in the form set out in the Schedule to these Regulations.</Text>
</P1para>
</P1>
</P1group>
<P1group>
<Title>Manner of an application for an entry in the Adopted Children Register</Title>

<Pnumber>4</Pnumber>

<P2 DocumentURI="http://www.legislation.gov.uk/ssi/2003/67/regulation/4/1/made" IdURI="http://www.legislation.gov.uk/id/ssi/2003/67/regulation/4/1" id="regulation-4-1">
<Pnumber>1</Pnumber>
<P2para>
<Text>An application for an entry to be made in the Adopted Children Register in respect of a Convention adoption or an overseas adoption shall be made in the manner provided for by paragraphs (2) or (3) below as the case may be.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/ssi/2003/67/regulation/4/2/made" IdURI="http://www.legislation.gov.uk/id/ssi/2003/67/regulation/4/2" id="regulation-4-2">
<Pnumber>2</Pnumber>
<P2para>
<Text>An application under paragraph (1) above in respect of a Convention adoption shall be made in writing, and shall include where appropriate a translation of that application into English certified by the translator as a correct translation.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/ssi/2003/67/regulation/4/3/made" IdURI="http://www.legislation.gov.uk/id/ssi/2003/67/regulation/4/3" id="regulation-4-3">
<Pnumber>3</Pnumber>

<Text>An application under paragraph (1) above in respect of an overseas adoption shall be made in writing, and shall include where appropriate a translation of that application into English certified by the translator as a correct translation.</Text>
</P2para>
</P2>

<Text>In this regulation any application, translation or certificate may be in electronic form, and if in electronic form may be submitted by e-mail or similar means.</Text>

<Title>Persons who may apply for an entry in the Adopted Children Register</Title>

<Pnumber>1</Pnumber>

<Text>An application for an entry to be made in the Adopted Children Register in respect of a Convention adoption or an overseas adoption may be made only by any of the persons specified in paragraph (2) below.</Text>
</P2para>
</P2>

<Pnumber>2</Pnumber>

<Text>The persons specified for the purpose of paragraph (1) above are–</Text>

<Pnumber>a</Pnumber>

<Text>in the case of a sole adoptive parent, that parent;</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ssi/2003/67/regulation/5/2/b/made" IdURI="http://www.legislation.gov.uk/id/ssi/2003/67/regulation/5/2/b" id="regulation-5-2-b">
<Pnumber>b</Pnumber>

<Text>in the case of a couple, either of the adoptive parents;</Text>
</P3para>
</P3>
<P3 DocumentURI="http://www.legislation.gov.uk/ssi/2003/67/regulation/5/2/c/made" IdURI="http://www.legislation.gov.uk/id/ssi/2003/67/regulation/5/2/c" id="regulation-5-2-c">
<Pnumber>c</Pnumber>

<Text>in the case of an adopted person who has attained the age of 16 years, that person;</Text>
</P3para>
</P3>

<Text>in the case of an overseas adoption, where the Registrar General of Births, Deaths and Marriages for Scotland is satisfied that the application is by the Registrar General of Births, Deaths and Marriages (or equivalent officer) for the country in which the adoption order was made, that Registrar (or equivalent officer); and</Text>

</P3>

<Title>Particulars to be given in respect of an application</Title>

<Text>An application for an entry to be made in the Adopted Children Register in respect of a Convention adoption or an overseas adoption shall give the particulars specified in paragraph (2) below.</Text>

<Text>The particulars specified for the purpose of paragraph (1) above are–</Text>

<Text>An application for an entry to be made in the Adopted Children Register in respect of a Convention adoption may be made only if the person making the application provides–</Text>

<Text>the Article 23 certificate made under the Convention by the central authority of the appropriate Convention country or territory in respect of the adoption, or a copy of that certificate certified as a true copy of the original by a notary public or equivalent officer; and</Text>

<Text>These Regulations specify the requirements that must be met before a foreign adoption can be registered in the Adopted Children Register (“<Abbreviation Expansion="Adopted Children Register">ACR</Abbreviation>”). The ACR is maintained by the Registrar General for Scotland under section 45 of the Adoption (Scotland) Act 1978 (“the 1978 Act”).</Text>

<Text>These Regulations are made under paragraph 3 of Schedule 1 to the 1978 Act. That paragraph was substituted by section 12 of the Adoption (Intercountry Aspects) Act 1999 (“the <Abbreviation Expansion="Adoption (Intercountry Aspects) Act 1999 c. 18">1999 Act</Abbreviation>”).</Text>
</P>
<P>
<Text>The 1999 Act gives effect to the 1993 Hague Convention on Protection of Children and Co-operation in respect of Intercountry Adoption. The 1999 Act also makes provision for other registrable foreign adoptions, known as overseas adoptions.</Text>
</P>
<P>
<Text>Regulation 2 adopts the relevant definitions used in the 1978 and 1999 Acts.</Text>
</P>
<P>
<Text>Regulation 3 provides for the form of entry in the ACR, which is prescribed in the Schedule to these Regulations.</Text>
</P>
<P>
<Text>Regulation 4 provides for the manner of an application for an entry in the ACR.</Text>
</P>
<P>
<Text>Regulation 5 specifies those persons who may apply for an entry to be made.</Text>
</P>
<P>
<Text>Regulation 6 specifies the particulars that a person making an application for registration must provide.</Text>
</P>
<P>
<Text>Regulation 7 specifies the documents that must be provided by a person making an application in respect of a registrable foreign adoption.</Text>
