The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c. 46)</ref>.</p></authorialNote> and of all other powers enabling them in that behalf, hereby make the following Order:</p></formula></preamble><body><article eId="article-1"><heading>Citation, commencement and extent</heading><num>1.</num><paragraph eId="article-1-1"><num>(1)</num><content><p>This Order may be cited as the Planning and Compensation Act 1991 (Amendment of Schedule 18) (Scotland) Order 2003 and shall come into force on 1st April 2003.</p></content></paragraph><paragraph eId="article-1-2"><num>(2)</num><content><p>This Order shall extend to Scotland only.</p></content></paragraph></article><article eId="article-2"><heading>Additions to provisions relating to interest on compensation</heading><num>2.</num><content><p><mod>Part I (compensation provisions that do not provide for interest) of Schedule 18 to the Planning and Compensation Act 1991 shall be amended by the insertion, after the entry relating to section 39(3) of the Land Compensation (Scotland) Act 1963<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/1963/51">1963 c. 51</ref>.</p></authorialNote>, of–<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><tblock class="table" ukl:Orientation="portrait"><foreign><table xmlns="http://www.w3.org/1999/xhtml"><tbody><tr><td><p xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0">Section 46B of the Control of Pollution Act 1974</p></td><td><p xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0">In the case of so much of the compensation as is payable under section 46B–</p><blockList xmlns="http://docs.oasis-open.org/legaldocml/ns/akn/3.0" class="ordered alpha parens" ukl:Name="OrderedList" ukl:Type="alpha" ukl:Decoration="parens"><item><num>(a)</num><p>by virtue of paragraph 4(a) of the Schedule to the Anti-Pollution Works (Scotland) Regulations 2003 (loss and damage for which compensation payable), the date of the depreciation;</p></item><item><num>(b)</num><p>by virtue of paragraph 4(b), (c), or (d) of that Schedule, the date on which the loss is sustained or the damage is done; or where injurious affection is sustained, the date of the injurious affection;</p></item><item><num>(c)</num><p>by virtue of paragraph 4(e) of that Schedule, the date on which the expenses become payable<authorialNote class="footnote" eId="f00003" marker="3"><p>Section 46B of the Control of Pollution Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1974/40">1974 (c. 40)</ref> was inserted by the Environment Act <ref eId="c00005" href="http://www.legislation.gov.uk/id/ukpga/1995/25">1995 (c. 25)</ref>, Schedule 29, paragraph 22. For the Anti-Pollution Works (Scotland) Regulations 2003 see <ref eId="c00006" href="http://www.legislation.gov.uk/id/ssi/2003/168">S.S.I. 2003/168</ref>.</p></authorialNote></p></item></blockList></td></tr></tbody></table></foreign></tblock></quotedStructure><inline name="appendText">.</inline></mod></p></content></article><hcontainer name="signatures"><hcontainer name="signatureBlock"><content><block name="signature"><signature refersTo="#">ROSS FINNIE</signature></block><block name="role"><role refersTo="#">A member of the Scottish Executive</role></block><blockContainer class="address"><p><location refersTo="#">St Andrew’s House, Edinburgh</location></p></blockContainer><block name="date"><date date="2003-03-10">10th March 2003</date></block></content></hcontainer></hcontainer></body><conclusions><blockContainer class="explanatoryNote"><subheading>(This note is not part of the Order)</subheading><blockContainer ukl:Name="P"><p>Part I of Schedule 18 to the Planning and Compensation Act 1991 specifies or describes the date from which interest is payable on compensation arising under the statutory provisions mentioned, which do not themselves provide for the payment of interest.</p></blockContainer><blockContainer ukl:Name="P"><p>Article 2 of this Order amends that Part of that Schedule by adding provisions relating to the payment of compensation under section 46B of the Control of Pollution Act 1974 (“the <abbr title="Control of Pollution Act 1974 c. 40">1974 Act</abbr>”).</p></blockContainer><blockContainer ukl:Name="P"><p>Compensation is payable under that section where a person has granted, or joined in granting, rights to enable the person on whom a works notice is served to carry out such anti-pollution works or operations as are specified in the notice. The amount of the compensation is assessed in accordance with the Anti-Pollution Works (Scotland) Regulations 2003.</p></blockContainer><blockContainer ukl:Name="P"><p>The rate of interest payable in respect of compensation under section 46B of the <abbr title="Control of Pollution Act 1974 c. 40">1974 Act</abbr> is that prescribed under section 40 (rate of interest after entry on land) of the Land Compensation (Scotland) Act 1963.</p></blockContainer><blockContainer ukl:Name="P"><p>This Order extends to Scotland only.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
