The Scottish Ministers, in exercise of the powers conferred by sections 3 and 22(2) of the Sea Fish (Conservation) Act 19671 and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement1.

This Order may be cited as the Sea Fish (Specified Sea Areas) (Regulation of Nets and Other Fishing Gear) (Scotland) Amendment Order 2003 and shall come into force on 11th March 2003.

Amendment of the Sea Fish (Specified Sea Areas) (Regulation of Nets and Other Fishing Gear) (Scotland) Order 20002.

The Sea Fish (Specified Sea Areas) (Regulation of Nets and Other Fishing Gear) (Scotland) Order 20002 is amended in accordance with this article.

In article 5(2) (twine thickness requirements)3, for “99 millimetres” there is substituted “94 millimetres”.

This Order amends the Sea Fish (Specified Sea Areas) (Regulation of Nets and Other Fishing Gear) (Scotland) Order 2000 as amended (S.S.I. 2000/227) (“the principal Order”). This Order like the principal Order is made pursuant to Article 46 of Council Regulation (EEC) No. 850/98 of 30th March 1998 for the conservation of fishery resources through technical measures for the protection of juveniles of marine organisms (O.J. No. L 125, 27.4.98, p.1). This Order forms part of the law of Scotland only.

The Order amends article 5(2) of the principal Order which makes provision in relation to twine thickness of nets carried or used for the purpose of fishing for Norway lobsters. The Order amends article 5(2) to provide that the twine thickness provisions specified apply to nets with a mesh size of between 70 and 94 millimetres (formerly they applied to nets with a mesh size between 70 and 99 millimetres) (article 2).
