The Scottish Ministers, in exercise of the powers conferred by section 42 of the Representation of the People Act 1983(1), and of all other powers enabling them in that behalf, hereby make the following Rules:
1. These Rules may be cited as the Scottish Local Government Elections Amendment Rules 2002 and shall extend to Scotland only.
2. These Rules shall come into force on 19th December 2002.
3.—(1) The Scottish Local Government Elections Rules 2002(2) shall be amended as follows.
(2) In Schedule 1 (revocations), after the number “2213” there shall be inserted the words “The Scottish Local Elections Amendment Rules 1990 S.I. 1990/262”.
(3) In the rules in Schedule 2–
(a)in rule 31(1)(b) for the word “ability” there shall be substituted “inability”; and
(b)in rule 38(3)(a) for the words “electoral ward” there shall be substituted “local government area”.
(4) In the Appendix of Forms in Schedule 2, for the form of notice of election referred to in rule 3 there shall be substituted the form set out in the Schedule to these Rules.
(5) In Schedule 3–
(a)in paragraph 4, for the number “(5)” there shall be substituted “(4)”; and
(b)in paragraph 17, for the words “counting of votes” there shall be substituted “counting of the votes”.

These Rules amend the Scottish Local Government Elections Rules 2002 which apply in respect of the election of councillors in Scotland.
Rule 3 corrects errors or omissions in those Rules.
1983 c. 2. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
