The Scottish Ministers, in exercise of the powers conferred by sections 38(1), 39B and 143(1) of the Roads (Scotland) Act 1984(1) and of all other powers enabling them in that behalf, and after consultation with representative organisations in accordance with section 38(2) of that Act, hereby make the following Regulations:
1. These Regulations may be cited as the Road Humps and Traffic Calming (Scotland) Amendment Regulations 2002 and shall come into force on 1st October 2002.
2.—(1) After regulation 7(1)(b) of the Roads (Traffic Calming) (Scotland) Regulations 1994(2) there shall be inserted–
“; or
constructed on a road which is designated as a home zone”.
(2) After regulation 7(2) there shall be inserted–
“(3) In this regulation a “home zone” means any road designated as a home zone by virtue of section 74(1) of the Transport (Scotland) Act 2001(3).”.
3.—(1) In regulation 7(1) of the Road Humps (Scotland) Regulations 1998(4) after “zone” there shall be inserted “or on a road that is designated as a home zone”.
(2) After regulation 7(2) there shall be inserted–
“(3) In this regulation a “home zone” means any road designated as a home zone by virtue of section 74(1) of the Transport (Scotland) Act 2001.”.

These Regulations amend–
(a)the Roads (Traffic Calming) (Scotland) Regulations 1994 (“the 1994 Regulations”) which prescribe the traffic calming works which a roads authority may construct in a road maintained by them; and
(b)the Road Humps (Scotland) Regulations 1998 (“the 1998 Regulations”) which make provision as to the construction and maintenance of road humps.
Regulation 2 amends regulation 7 of the 1994 Regulations so that the signing provisions relating to the warning of the presence of traffic calming works do not apply to traffic calming works on a road designated as a home zone.
Regulation 3 amends regulation 7 of the 1998 Regulations so that the signing and lighting provisions and certain provisions relating to the placing of road humps do not apply to a road hump on a road designated as a home zone.
1984 c. 54; section 39B was inserted by the Traffic Calming Act 1992 (c. 30), Schedule 2. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
