The Scottish Ministers, in exercise of the powers conferred by sections 2(5), 25(2), 105(7) and 108(1) of the National Health Service (Scotland) Act 19781 and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation and commencement1.

These Regulations may be cited as the National Health Service (General Dental Services) (Scotland) Amendment Regulations 2002 and shall come into force on 10th May 2002.

Amendment of the National Health Service (General Dental Services) (Scotland) Regulations 19962.

The National Health Service (General Dental Services) (Scotland) Regulations 19962 are amended in accordance with the following paragraphs.

In regulation 5A(3) (inspection of practice premises), for “paragraphs (2) or (3)” there is substituted “paragraphs (1) or (2)”.

(3)

In each of paragraphs 1 and 2 in Part II of Schedule 4 (prior approval of care and treatment) for “£260” there is substituted “£270”.

These Regulations amend the National Health Service (General Dental Services) (Scotland) Regulations 1996 (“the 1996 Regulations”), which make arrangements under which dentists provide general dental services as part of the National Health Service in Scotland.

Regulation 2(2) amends regulation 5A of the 1996 Regulations to correct a cross-referencing error.

Regulation 2(3) amends Schedule 4 to the 1996 Regulations to increase from £260 to £270 the amount specified as the maximum cost, or likely cost, of care and treatment which a dentist may undertake without seeking the prior approval of the Scottish Dental Practice Board.
