in exercise of the powers conferred by section 36(1) and (2)(b) of the Legal Aid (Scotland) Act 1986<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00001" The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c. 46)</ref>.</p></authorialNote> and of all other powers enabling them in that behalf, hereby make the following Regulations, a draft of which has, in accordance with section 37(2) of that Act, been laid before and approved by resolution of, the Scottish Parliament:</p></formula></preamble><body><hcontainer name="crossheading" ukl:Name="P1group"><heading>Citation and commencement</heading><hcontainer name="regulation" eId="regulation-1"><num>1.</num><content><p>These Regulations may be cited as the Civil Legal Aid (Financial Conditions) (Scotland) Regulations 2002 and shall come into force on 8th April 2002.</p></content></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Application</heading><hcontainer name="regulation" eId="regulation-2"><num>2.</num><content><p>These Regulations shall apply only in relation to any case where an application for civil legal aid is made to the Scottish Legal Aid Board on or after 8th April 2002.</p></content></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Amendment of the Legal Aid (Scotland) Act 1986</heading><hcontainer name="regulation" eId="regulation-3"><num>3.</num><content><p>For the yearly amount of £9,034 specified in section 15(1) of the Legal Aid (Scotland) Act 1986<authorialNote class="footnote" eId="f00002" marker="2"><p>The existing figure specified in section 15(1) was inserted by <ref eId="c00004" href="http://www.legislation.gov.uk/id/ssi/2001/123">S.S.I. 2001/123</ref>.</p></authorialNote>, there shall be substituted the yearly amount of £9,188.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-4"><num>4.</num><content><p>For the yearly amount of £2,767 specified in section 17(2)(a) of the Legal Aid (Scotland) Act 1986<authorialNote class="footnote" eId="f00003" marker="3"><p>The existing figure specified in section 17(2)(a) was inserted by <ref eId="c00005" href="http://www.legislation.gov.uk/id/ssi/2001/123">S.S.I. 2001/123</ref>.</p></authorialNote>, there shall be substituted the yearly amount of £2,814.</p></content></hcontainer></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Revocation</heading><hcontainer name="regulation" eId="regulation-5"><num>5.</num><content><p>The Civil Legal Aid (Financial Conditions) (Scotland) Regulations 2001<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00006" href="http://www.legislation.gov.uk/id/ssi/2001/123">S.S.I. 2001/123</ref>.</p></authorialNote> are hereby revoked except in relation to any case where an application for civil legal aid is made to the Scottish Legal Aid Board before 8th April 2002.</p></content></hcontainer></hcontainer><hcontainer name="signatures"><hcontainer name="signatureBlock"><content><block name="signature"><signature refersTo="#">JAMES WALLACE</signature></block><block name="role"><role refersTo="#">A member of the Scottish Executive</role></block><blockContainer class="address"><p><location refersTo="#">St Andrew’s House,</location></p><p><location refersTo="#">Edinburgh</location></p></blockContainer><block name="date"><date date="2002-03-19">19th March 2002</date></block></content></hcontainer></hcontainer></body><conclusions><blockContainer class="explanatoryNote"><subheading>(This note is not part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>These Regulations increase certain of the financial limits of eligibility for civil legal aid under the Legal Aid (Scotland) Act 1986.</p></blockContainer><blockContainer ukl:Name="P"><p>The income limits are increased to make eligible for civil legal aid, persons with a yearly disposable income of not more than £9,188 (instead of £9,034) and to make eligible without payment of a contribution, persons with a yearly disposable income of not more than £2,814 (instead of £2,767) (regulations 3 and 4).</p></blockContainer><blockContainer ukl:Name="P"><p>The Regulations only apply in relation to any case where an application for civil legal aid is made to the Scottish Legal Aid Board on or after 8th April 2002 (regulation 2).</p></blockContainer><blockContainer ukl:Name="P"><p>The Civil Legal Aid (Financial Conditions) (Scotland) Regulations 2001 are revoked except in relation to any case where an application for civil legal aid is made to the Scottish Legal Aid Board before 8th April 2002 (regulation 5).</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
