Schedule 1 to, the National Health Service (Scotland) Act 1978<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00001" href="http://www.legislation.gov.uk/id/ukpga/1978/29">1978 c. 29</ref>; section 105(7) which was amended by the Health Services Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/1980/53">1980 (c. 53)</ref>, Schedule 6, paragraph 5(1) and Schedule 7, by the Health and Social Services and Social Security Adjudication Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/1983/41">1983 (c. 41)</ref>, Schedule 9, paragraph 24, and by the Health Act <ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/1999/8">1999 (c. 8)</ref> (“the <abbr title="Health Act 1999 c. 8">1999 Act</abbr>”), Schedule 4, paragraph 60, contains provisions relevant to the exercise of the powers under which these Regulations are made. See section 66(1) of the <abbr title="Health Act 1999 c. 8">1999 Act</abbr> in relation to any provision of that Act being taken to be a pre-commencement enactment within the meaning of the Scotland Act <ref eId="c00005" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c. 46)</ref>. Section 108 of the 1978 Act contains a definition of “regulations” relevant to the exercise of the statutory powers under which these Regulations are made. Paragraph 7A of Schedule 1 to the 1978 Act was inserted by the National Health Service and Community Care Act <ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/1990/19">1990 (c. 19)</ref> (“the <abbr title="National Health Service and Community Care Act 1990 c. 19">1990 Act</abbr>), Schedule 5, paragraph 5. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act <ref eId="c00007" href="http://www.legislation.gov.uk/id/ukpga/1998/46">1998 (c. 46)</ref>.</p></authorialNote> as read with article 5 of, and Part I of the Schedule to, the Scottish Council for Postgraduate Medical and Dental Education Order 1993<authorialNote class="footnote" eId="f00002" marker="2"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00008" href="http://www.legislation.gov.uk/id/uksi/1993/577">1993/577</ref>.</p></authorialNote> and as read with article 6 of, and Part I of the Schedule to, the <abbr class="acronym" title="National Health Service">NHS</abbr> Education Scotland Order 2002<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00009" href="http://www.legislation.gov.uk/id/ssi/2002/103">S.S.I. 2002/103</ref>.</p></authorialNote>, and of all other powers enabling them in that behalf, and after consultation, in accordance with paragraph 7C of Schedule 1 to the said Act of 1978<authorialNote class="footnote" eId="f00004" marker="4"><p>Paragraph 7C of Schedule 1 was inserted by the <abbr title="National Health Service and Community Care Act 1990 c. 19">1990 Act</abbr>, Schedule 5, paragraph 5.</p></authorialNote>, with such bodies and organisations as appear to them to be concerned, hereby make the following Regulations:</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation and commencement</heading><num>1.</num><content><p>These Regulations may be cited as the Scottish Council for Postgraduate Medical and Dental Education and <abbr class="acronym" title="National Health Service">NHS</abbr> Education for Scotland (Transfer of Staff) Regulations 2002 and shall come into force on 31st March 2002.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Transfer of staff from the Council to the Board</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><content><p>All officers and employees of the Scottish Council for Postgraduate Medical and Dental Education on 31st March 2002 shall transfer to <abbr class="acronym" title="National Health Service">NHS</abbr> Education for Scotland on that date.</p></content></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p>The contracts of employment between officers and employees transferred by paragraph (1) and the Scottish Council for Postgraduate Medical and Dental Education shall not be terminated but shall have effect from 31st March 2002 as if originally made between such officers and employees and <abbr class="acronym" title="National Health Service">NHS</abbr> Education for Scotland.</p></content></paragraph></hcontainer><hcontainer name="signatures"><hcontainer name="signatureBlock"><content><block name="signature"><signature refersTo="#">MALCOLM CHISHOLM</signature></block><block name="role"><role refersTo="#">A member of the Scottish Executive</role></block><blockContainer class="address"><p><location refersTo="#">St Andrew’s House,</location></p><p><location refersTo="#">Edinburgh</location></p></blockContainer><block name="date"><date date="2002-03-05">5th March 2002</date></block></content></hcontainer></hcontainer></body><conclusions><blockContainer class="explanatoryNote"><subheading>(This note is not part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>These Regulations transfer the officers and employees of the Scottish Council for Postgraduate Medical and Dental Education (“the Council”) to <abbr class="acronym" title="National Health Service">NHS</abbr> Education for Scotland.</p></blockContainer><blockContainer ukl:Name="P"><p>The transfer takes place on 31st March 2002 when the functions of the Council will be transferred to <abbr class="acronym" title="National Health Service">NHS</abbr> Education for Scotland and following which the Council will be abolished.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
