The Foot-and-Mouth Disease (Scotland) Declaratory Amendment Order 2001

The Scottish Ministers, in exercise of the powers conferred by article 17(1) of the Foot-and-Mouth Disease Order 19831 and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement1.

This Order may be cited as the Foot-and-Mouth Disease (Scotland) Declaratory Amendment Order 2001 and shall come into force on 4th March 2001 at 7.00 p.m.

Amendment of the Foot-and-Mouth Disease Declaratory Orders2.

(1)

In Schedule 2 to each of the Orders specified in paragraph (2) below, there shall be inserted after paragraph 2(b), as follows:–

β€œ(ba)

no person shall transport animals through the infected area, except if the animals are transiting through that area by motorway, trunk road or railway;”.

(2)

The Orders referred to in paragraph (1) above are–

(a)

the Foot-and-Mouth Disease (Scotland) Declaratory Order 20012; and

(b)

the Foot-and-Mouth Disease (Scotland) Declaratory (No. 2) Order 20013.

This Order amends the two Scottish Declaratory Orders declaring infected areas under Part III of the Foot-and-Mouth Disease Order 1983 (S.I. 1983/1950) in order to permit the transit of animals through those infected areas by motorway, trunk road or railway. These amendments are in consequence of articles 4 and 5 of the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 2) Order 2001 (S.S.I. 2001/60).
