Amendments to the Rules relevant for the purposes of this Act of Sederunt were made by: <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00006" href="http://www.legislation.gov.uk/id/uksi/1996/1756">1996/1756</ref>, <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00007" href="http://www.legislation.gov.uk/id/uksi/1996/2168">1996/2168</ref> and <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00008" href="http://www.legislation.gov.uk/id/uksi/1999/1220">1999/1220</ref> which amended rules 62.47 and 62.48.</p></authorialNote>.</p></content></paragraph></rule></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Amendment of the Rules of the Court of Session</heading><intro><p>In rule 62.47 (interpretation of Part VII)—</p></intro><level class="para1" eId="article-a"><num>(a)</num><content><p><mod>after the definition of “the Act of 1995” there is inserted—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><hcontainer name="definition"><content><p>“the <abbr title="Terrorism Act 2000 c. 11">Act of 2000</abbr>” means the Terrorism Act 2000;</p></content></hcontainer></quotedStructure><inline name="appendText">; and</inline></mod></p></content></level><level class="para1" eId="article-b"><num>(b)</num><content><p>in the definition of “relevant enactment”, after “1995,”, where first occurring, there is inserted “the <abbr title="Terrorism Act 2000 c. 11">Act of 2000</abbr>”.</p></content></level><rule eId="article-3"><num>3.</num><content><p><mod>In paragraph (2) of rule 62.48 (applications for registration under relevant enactments), at the end there is inserted—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><level class="para1"><num>(g)</num><content><p>paragraph 27(3) of Schedule 4 to the <abbr title="Terrorism Act 2000 c. 11">Act of 2000</abbr> (application for registration of an England and Wales order, Northern Ireland order or Islands order</p></content></level></quotedStructure></mod></p></content></rule><rule eId="article-4"><num>4.</num><intro><p>In rule 62.53 (modification and cancellation of registration)—</p></intro><level class="para1" eId="article-4-a"><num>(a)</num><content><p>in the heading to the rule, at the end there is inserted “or 2000”; and</p></content></level><level class="para1" eId="article-4-b"><num>(b)</num><content><p>in paragraph (1), after “1995” there is inserted “or 2000”.</p></content></level></rule><rule eId="article-5"><num>5.</num><content><p><mod>After Chapter 83 of the rules there is added—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><part><num>Chapter 84</num><heading>Applications under the Terrorism Act 2000</heading><article><heading>Interpretation of this Chapter</heading><num>84.1</num><intro><p>In this Chapter—</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Terrorism Act 2000 c. 11">Act of 2000</abbr>” means the Terrorism Act 2000<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00009" href="http://www.legislation.gov.uk/id/ukpga/2000/1">2000 c. 1</ref></p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“administrator” shall be construed in accordance with paragraph 16(1)(b) of Schedule 4 to the <abbr title="Terrorism Act 2000 c. 11">Act of 2000</abbr>; and</p></content></hcontainer><hcontainer name="definition"><content><p>“restraint order” means an order under paragraph 18(1) of Schedule 4 to the <abbr title="Terrorism Act 2000 c. 11">Act of 2000</abbr>.</p></content></hcontainer></article><article><heading>Power and duties of administrator</heading><num>84.2</num><paragraph><num>(1)</num><intro><p>Subject to any condition or exception specified by the court, an administrator appointed under paragraph 16(1)(b) of Schedule 4 to the <abbr title="Terrorism Act 2000 c. 11">Act of 2000</abbr>—</p></intro><level class="para1"><num>(a)</num><intro><p>may take possession of the property in respect of which he has been appointed and of any document which—</p></intro><level class="para2"><num>(i)</num><content><p>is in the possession or control of the person in whom the property is vested; and</p></content></level><level class="para2"><num>(ii)</num><content><p>relates to the property;</p></content></level></level><level class="para1"><num>(b)</num><content><p>may have access to, and copy, any document relating to the property and not in such possession or control as is mentioned in sub-paragraph (a);</p></content></level><level class="para1"><num>(c)</num><content><p>may bring, defend or continue any legal proceedings relating to the property;</p></content></level><level class="para1"><num>(d)</num><content><p>may borrow money in so far as it is necessary to do so to safeguard the property and may for the purposes of such borrowing create a security over any part of the property;</p></content></level><level class="para1"><num>(e)</num><content><p>may, if the administrator considers that to do so would be beneficial for the management and the realisation of the property, enter into any contract, or execute any deed, with respect to the property;</p></content></level><level class="para1"><num>(f)</num><content><p>may effect or maintain insurance policies with respect to the property;</p></content></level><level class="para1"><num>(g)</num><content><p>may, where the person in whom the property is vested has not completed title to any of the property, complete title to it: provided that completion of title in the name of the person in whom the property is vested shall not validate by accretion any unperfected right in favour of any person other than the administrator;</p></content></level><level class="para1"><num>(h)</num><content><p>may sell (but not to himself or an associate of his) the property and redeem any obligation secured on that property;</p></content></level><level class="para1"><num>(i)</num><content><p>may discharge any of his functions through agents or employees: provided that the administrator shall be personally liable to meet the fees and expenses of any such agents or employees out of such remuneration as is payable to the administrator by virtue of paragraph 17(2) of Schedule 4 to the <abbr title="Terrorism Act 2000 c. 11">Act of 2000</abbr>;</p></content></level><level class="para1"><num>(j)</num><content><p>may take such professional advice as he considers necessary for the proper discharge of his functions;</p></content></level><level class="para1"><num>(k)</num><content><p>may at any time apply to the court for directions with respect to the exercise of his powers and duties;</p></content></level><level class="para1"><num>(l)</num><content><p>may exercise any power conferred on him by the court whether such power was conferred at the time of his appointment or on his subsequent application to the court; and</p></content></level><level class="para1"><num>(m)</num><content><p>may do anything incidental to the above powers and duties.</p></content></level></paragraph><paragraph><num>(2)</num><intro><p>Subject to the proviso to sub-paragraph (g) of paragraph (1)—</p></intro><level class="para1"><num>(a)</num><content><p>a person dealing with an administrator in good faith and for value shall not require to determine whether the administrator is acting within the powers mentioned in that sub-paragraph; and</p></content></level><level class="para1"><num>(b)</num><content><p>the validity of any title shall not be challengeable by reason only of the administrator having acted outwith those powers.</p></content></level></paragraph><paragraph><num>(3)</num><content><p>The exercise of a power mentioned in any of sub-paragraphs (c) to (h) of paragraph (1) shall be in the name of the person in whom the property is vested.</p></content></paragraph></article><article><heading>Applications for variation or recall of restraint order</heading><num>84.3</num><paragraph><num>(1)</num><content><p>An application under paragraph 19(2) (recall or variation of restraint order) of Schedule 4 to the <abbr title="Terrorism Act 2000 c. 11">Act of 2000</abbr> shall be made by note in the process containing the interlocutor making the restraint order to which the application relates.</p></content></paragraph><paragraph><num>(2)</num><content><p>Subject to rule 14.6(2) (application to shorten or extend the period of notice), the period of notice for lodging answers to a note under paragraph (1) of this rule by any person affected by a restraint order shall be 14 days.</p></content></paragraph></article></part></quotedStructure><inline name="appendText">.</inline></mod></p></content></rule></hcontainer><hcontainer name="signatures"><hcontainer name="signatureBlock"><content><block name="signature"><signature refersTo="#">W. Paragraph 4 amends rule 62.53 so as to apply the procedure set out in that rule in relation to the modification and cancellation of an order under that paragraph.</p></blockContainer><blockContainer ukl:Name="P"><p>Paragraph 5 inserts a new chapter to the Rules. The new rule 84.2 sets out the powers and duties of an administrator appointed under paragraph 16(1)(b) of Schedule 4 to that <abbr title="Terrorism Act 2000 c. 11">Act of 2000</abbr>. Rule 84.3 sets out the procedure for an application to vary or recall a restraint order made under paragraph 18(1) of Schedule 4 to that <abbr title="Terrorism Act 2000 c. 11">Act of 2000</abbr>.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
