commencement</heading><rule eId="article-1"><num>1.</num><intro><p>This Act of Adjournal—</p></intro><level class="para1" eId="article-1-a"><num>(a)</num><content><p>may be cited as the Act of Adjournal (Criminal Procedure Rules of Amendment) (Convention Rights (Compliance) (Scotland) Act 2001) 2001;</p></content></level><level class="para1" eId="article-1-b"><num>(b)</num><content><p>shall come into force on 21 December 2001; and</p></content></level><level class="para1" eId="article-1-c"><num>(c)</num><content><p>shall be inserted in the Books of Adjournal.</p></content></level></rule></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Procedure in matters arising out of the Human Rights Act 1998</heading><rule eId="article-2"><num>2.</num><content><p><mod>After Chapter 41 of the Criminal Procedure Rules 1996<authorialNote class="footnote" eId="f00002" marker="2"><p><abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00002" href="http://www.legislation.gov.uk/id/uksi/1996/513">1996/513</ref>, as amended.</p></authorialNote>, there is inserted—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><part><num><b>CHAPTER 42</b></num><heading><b>CONVENTION RIGHTS (COMPLIANCE) (SCOTLAND) ACT 2001</b></heading><article><heading>Application and interpretation</heading><num>42.1.</num><paragraph><num>(1)</num><content><p>This Chapter applies to punishment part hearings.</p></content></paragraph><paragraph><num>(2)</num><intro><p>In this Chapter—</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Convention Rights (Compliance) (Scotland) Act 2001 asp 7">2001 Act</abbr>” means the Convention Rights (Compliance) (Scotland) Act 2001<authorialNote class="footnote" eId="f00003" marker="3"><p>asp 7</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“punishment part hearing” means a hearing in terms of paragraph 12 of Part 1 of the Schedule to the <abbr title="Convention Rights (Compliance) (Scotland) Act 2001 asp 7">2001 Act</abbr>;</p></content></hcontainer><hcontainer name="definition"><content><p>“existing life prisoners” has the meaning given in paragraph 2 of Part 1 of the Schedule to the <abbr title="Convention Rights (Compliance) (Scotland) Act 2001 asp 7">2001 Act</abbr>;</p></content></hcontainer><hcontainer name="definition"><content><p>“procedural hearing” means a hearing, held in terms of rule 42.4, for the purpose of determining any matter raised in terms of rule 42.3.</p></content></hcontainer></paragraph></article><article><heading>Intimation</heading><num>42.2.</num><paragraph><num>(1)</num><content><p>The Deputy Principal Clerk of Justiciary shall intimate the date, time and place of a punishment part hearing in Form 42.2.</p></content></paragraph></article><article><heading>Disputed or additional documents</heading><num>42.3.</num><paragraph><num>(1)</num><intro><p>If an existing life prisoner who has received intimation of a punishment part hearing in terms of rule 42.2(1) wishes to—</p></intro><level class="para1"><num>(a)</num><content><p>dispute the terms of any document, or a part of any document, sent to him by the Scottish Ministers in terms of paragraph 10 of Part 1 of the Schedule to the <abbr title="Convention Rights (Compliance) (Scotland) Act 2001 asp 7">2001 Act</abbr>; or</p></content></level><level class="para1"><num>(b)</num><content><p>lodge any other document,</p></content></level><wrapUp><p>he shall, not later than 21 days before the date of the punishment part hearing, give written intimation to the Deputy Principle Clerk of Justiciary.</p></wrapUp></paragraph><paragraph><num>(2)</num><intro><p>An existing life prisoner who gives intimation in terms of paragraph (1) of this rule shall, at the same time, specify the grounds upon which he seeks to—</p></intro><level class="para1"><num>(a)</num><content><p>dispute the document or part of the document; or</p></content></level><level class="para1"><num>(b)</num><content><p>lodge any other document,</p></content></level><wrapUp><p>and shall lodge any document referred to in, or to which he intends to refer, in support of such grounds.</p></wrapUp></paragraph><paragraph><num>(3)</num><content><p>None of the matters mentioned in paragraph (1) of this rule may be raised after the time specified in that paragraph.</p></content></paragraph></article><article><heading>Procedural hearing</heading><num>42.4.</num><content><p>Where an existing life prisoner gives intimation in terms of paragraph (1) of rule 42.3, there shall, 14 days before the date of the punishment part hearing, be a procedural hearing.(</p></content></article></part></quotedStructure></mod></p></content></rule><rule
