The Standards in Scotland’s Schools etc. Act 2000 (Commencement No. 3 and Transitional Provisions) Amendment Order 2001

Coming into force
The Scottish Ministers, in exercise of the powers conferred by section 61(2), (3) and (4) of the Standards in Scotland’s Schools etc. Act 20001, hereby make the following Order:

Citation and commencement1.

This Order may be cited as the Standards in Scotland’s Schools etc. Act 2000 (Commencement No. 3 and Transitional Provisions) Amendment Order 2001 and shall come into force on 31st October 2001.

Amendment2.

In article 4 (transitional and savings provisions) of the Standards in Scotland’s Schools etc. Act 2000 (Commencement No. 3 and Transitional Provisions) Order 20002 after paragraph (3) there shall be inserted–

“(4)

Notwithstanding the coming into force on 1st November 2001 of sections 46 and 50 of the Act3 for the purposes specified in relation to those sections in column 3 of Part 1 of the Schedule to this Order, sections 10 and 11 of and Schedule 2 to the 1965 Act4 shall continue in force as originally enacted in respect of any investigation, consideration or proceedings instituted in terms of those provisions prior to 1st November 2001.”.

This Order amends the Standards in Scotland’s Schools etc. Act 2000 (Commencement No. 3 and Transitional Provisions) Order 2000 (“the Commencement Order”). Article 2 inserts into the Commencement Order further transitional and savings provisions. It provides for the current procedures under sections 10 and 11 of and Schedule 2 to the Teaching Council (Scotland) Act 1965 to continue to apply to cases where consideration by the Investigating and Disciplinary Committees has commenced prior to 1st November 2001.
