Explanatory Note

(This note is not part of the Regulations)

These Regulations implement in Scotland Commission Decision 2001/740/EC concerning certain protection measures with regard to foot-and-mouth disease in the United Kingdom and repealing Commission Decision 2001/356/EC.

They amend the restrictions on imports and exports of certain animals and animal products contained in the Import and Export Restrictions (Foot-and-Mouth Disease) (Scotland) (No. 2) Regulations 2001 (“the principal Regulations”), to continue the effect of those restrictions, with amendments, until midnight on 31st December 2001.

Regulation 2 makes provision to amend the restrictions to permit the dispatch from Scotland of pig meat from certain areas, subject to compliance with certain restrictions, to permit the dispatch of certain milk products, and to permit the dispatch of frozen porcine semen produced after 30th September 2001 in accordance with specified conditions in a semen collection centre authorised by the Scottish Ministers to dispatch such semen.

Regulation 3 makes consequential amendments to the principal Regulations, and to three sets of amending Regulations.

Regulations 4 to 7 make consequential amendments to the Meat Products (Hygiene) Regulations 1994, the Fresh Meat (Hygiene and Inspection) Regulations 1995 and the Minced Meat and Minced Meat and Meat Preparations (Hygiene) Regulations 1995. These Regulations were amended by the Foot-and-Mouth Disease (Marking of Meat, Meat Products, Minced Meat and Meat Preparations) (Scotland) Regulations 2001 (“the amending Regulations”), which are not yet in force. Provisions contained in the amending Regulations on the marking of meat require to be in force to permit exports in accordance with the amendment of the restrictions on import and export in Commission Decision 2001/740/EC. References inserted in those Regulations by the amending Regulations now require to be amended for the purposes of the principal Regulations. Accordingly those Regulations require to be amended to come into force at the same time as these Regulations, that is 5.00 p.m. on 24th October 2001.
