The Scottish Ministers, in exercise of the powers conferred by sections 71(16) and 104(4) of, paragraphs 1(3) and 7(1) of Schedule 9 to, the Children Act 1989(1) and of all other powers enabling them in that behalf, hereby make the following Regulations—
1. These Regulations may be cited as the Child Minding and Day Care (Registration and Inspection Fees) Amendment (Scotland) Regulations 2001 and shall come into force on 1st August 2001.
2.—(1) The Child Minding and Day Care (Registration and Inspection Fees) Regulations 1991(2) shall be amended in accordance with the following provisions of this regulation.
(2) In regulation 3 (registration)—
(a)in paragraph (1) for “£12.50” there is substituted “£14.00”; and
(b)in paragraph (2)—
(i)in sub-paragraph (a) for “£110.00” there is substituted “£121.00”; and
(ii)in sub-paragraph (b) for “£12.50” there is substituted “£14.00”.
(3) In regulation 4 (fee on annual inspection)—
(a)in paragraph (a) for “£10.00” there is substituted “£11.00”;
(b)in paragraph (b) for “£85.00” there is substituted “£94.00”; and
(c)in paragraph (c) for “£10.00” there is substituted “£11.00”.
3. The Child Minding and Day Care (Registration and Inspection Fees) (Amendment) Regulations 1996 are hereby revoked(3).

These Regulations amend the Child Minding and Day Care (Registration and Inspection Fees) Regulations 1991. Registration fees for providers of full day care on non-domestic premises are increased from £110 to £121 and for providers of sessional day care and child minders from £12.50 to £14.00 (regulation 2(2)). Annual inspection fees for such providers are increased from £85 to £94 and from £10 to £11 respectively (regulation 2(3)).
These Regulations also revoke the Child Minding and Day Care (Registration and Inspection Fees) (Amendment) Regulations 1996 (regulation 3).
1989 c. 41. “Prescribed” in paragraphs 1(3) and 7(1) of Schedule 9 is defined in section 105(1) of the Act as meaning prescribed by regulations. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1948 (c. 46).
