2.—(1) Within the permitted areas specified in article 4(9B) of the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 3) Order 2001(1) (“the Controlled Area Order”) that Order shall apply as read with the following paragraph of this article.
(2) Where paragraph (1) above applies, the application by article 2 of the Controlled Area Order of article 35A of the Foot-and-Mouth Disease Order 1983(2) is modified by the addition at the end of paragraph (1) of that article of–
“, but that notice may only be displayed if that inspector has obtained the written approval of the Divisional Veterinary Manager and has notified the prohibition to the Scottish Ministers”.
