The Scottish Ministers in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Potatoes Originating in Egypt (Amendment) (No. 2) (Scotland) Regulations 2000 and shall come into force on 30th November 2000.

(2) These Regulations extend to Scotland only.

Interpretation

2.  In these Regulations “the principal Regulations” means the Potatoes Originating in Egypt Regulations 1998(2).

Amendment of the principal Regulations

3.—(1) The principal Regulations shall be amended in accordance with paragraphs (2) and (3) below.

(2) In regulation 2 (interpretation) for the definition of “the Decision” there shall be substituted–

  • “the Decision” means Commission Decision 96/301/EC authorising member States temporarily to take additional measures against the dissemination ofPseudomonas solanacearum (Smith) Smith as regards Egypt(3) as amended by the instruments listed in the Schedule to these Regulations;.

(3) After regulation 6 there shall be inserted the Schedule set out in the Schedule to these Regulations.

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which extend to Scotland only, implement Commission Decision 2000/568/EC amending Decision 96/301/EC authorising member States temporarily to take emergency measures against the dissemination ofPseudomonas solanacearum (Smith) Smith as regards Egypt (O.J. No. L 238, 22.9.2000, p.59).

The Regulations amend the definition of “the Decision” in the Potatoes Originating in Egypt Regulations 1998 (regulation 2(2)). Commission Decision 2000/568/EC renews the framework within which potatoes may be imported from Egypt into the territory of the European Community.

No regulatory appraisal has been prepared in respect of these Regulations.
