declare:</p></formula></preamble><body><hcontainer name="crossheading" ukl:Name="P1group"><heading>Citation and commencement</heading><rule eId="article-1"><num>1.</num><intro><p>This Act of Adjournal–</p></intro><level class="para1" eId="article-1-a"><num>(a)</num><content><p>may be cited as the Act of Adjournal (Criminal Procedure Rules Amendment <abbr title="Number">No.</abbr> 2) (Human Rights Act 1998) 2000;</p></content></level><level class="para1" eId="article-1-b"><num>(b)</num><content><p>shall come into force on 2nd October 2000; and</p></content></level><level class="para1" eId="article-1-c"><num>(c)</num><content><p>shall be inserted in the Books of Adjournal.</p></content></level></rule></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Procedure in matters arising out of the Human Rights Act 1998</heading><rule eId="article-2"><num>2.</num><content><p><mod>After Chapter 40 of the Criminal Procedure Rules 1996<authorialNote class="footnote" eId="f00003" marker="3"><p> <abbr class="acronym" title="Statutory Instrument">S.I.</abbr> <ref eId="c00003" href="http://www.legislation.gov.uk/id/uksi/1996/513">1996/513</ref> as amended.</p></authorialNote> there is inserted–<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="default"><part><num><b>CHAPTER 41</b></num><heading><b>HUMAN RIGHTS ACT 1998</b></heading><hcontainer name="crossheading" ukl:Name="P1group"><heading>Application and interpretation</heading><article><num>41.1.</num><paragraph><num>(1)</num><content><p>This Chapter deals with various matters relating to the Human Rights Act 1998.</p></content></paragraph><paragraph><num>(2)</num><intro><p>In this Chapter–</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Human Rights Act 1998 c. 42">1998 Act</abbr>” means the Human Rights Act 1998;</p></content></hcontainer><hcontainer name="definition"><content><p>“declaration of incompatibility” has the meaning given by section 4 of the <abbr title="Human Rights Act 1998 c. 42">1998 Act</abbr>.</p></content></hcontainer></paragraph></article></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Evidence of judgments <abbr title="Et cetera" xml:lang="la">etc</abbr></heading><article><num>41.2.</num><paragraph><num>(1)</num><content><p>Evidence of any judgment, decision, declaration or opinion of which account has to be taken by the court under section 2 of the <abbr title="Human Rights Act 1998 c. 42">1998 Act</abbr> shall be given by reference to any authoritative and complete report of the said judgment, decision, declaration or opinion and may be given in any manner.</p></content></paragraph><paragraph><num>(2)</num><content><p>Evidence given in accordance with paragraph (1) shall be sufficient evidence of that judgment, decision, declaration or opinion.</p></content></paragraph></article></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Declaration of incompatibility</heading><article><num>41.3.</num><paragraph><num>(1)</num><content><p>Where in any proceedings the court is considering whether to make a declaration of incompatibility it shall give notice of this in Form 41.3—A to such persons as the Lord Justice General may from time to time direct.</p></content></paragraph><paragraph><num>(2)</num><intro><p>Where any–</p></intro><level class="para1"><num>(a)</num><content><p>Minister of the Crown (or person nominated by him);</p></content></level><level class="para1"><num>(b)</num><content><p>member of the Scottish Executive;</p></content></level><level class="para1"><num>(c)</num><content><p>Northern Ireland Minister;</p></content></level><level class="para1"><num>(d)</num><content><p>Northern Ireland department,</p></content></level><wrapUp><p>wishes to be joined as a party to proceedings in relation to which the Crown is entitled to receive notice under section 5 of the <abbr title="Human Rights Act 1998 c. 42">1998 Act</abbr> he or, as the case may be, it shall serve notice in Form 41.3—B to that effect on the Deputy Principal Clerk of Justiciary and shall serve a copy of the notice on all other parties to the proceedings.</p></wrapUp></paragraph></article><article><num>41.4.</num><content><p>Within 14 days after the date of service of the notice under rule 41.3(2), the person serving the notice shall lodge a minute in the proceedings in Form 41.4 and shall serve a copy of that minute on all other parties to the proceedings.</p></content></article><article><num>41.5.</num><content><p>The court may fix a diet for a hearing on the question of incompatibility as a separate hearing from any other hearing in the proceedings and may sist the proceedings if it considers it necessary to do so while the
