                the Ministers
              ”</InlineAmendment>.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2000-08-01"><Title> Amendment of regulation 3 of the principal Regulations</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/4" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/4" id="regulation-4"><Pnumber>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/4/1" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/4/1" id="regulation-4-1"><Pnumber>1</Pnumber><P2para><Text>In regulation 3(1) (interpretation)–</Text><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/4/1/a" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/4/1/a" id="regulation-4-1-a"><Pnumber>a</Pnumber><P3para><Text>the following definitions shall be inserted in the appropriate places:–</Text><BlockAmendment TargetClass="unknown" TargetSubClass="unknown" Context="unknown" Format="default"><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“genetically modified" has the same meaning as for the purposes of Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1990/0220" id="c00001" Class="EuropeanEconomicCommunityDirective" Year="1990" Number="220">90/220/EEC</Citation> <CommentaryRef Ref="c16203741"/> on the deliberate release into the environment of genetically modified organisms;</Text></Para></ListItem></UnorderedList></BlockAmendment><AppendText>;</AppendText><BlockAmendment TargetClass="unknown" TargetSubClass="unknown" Context="unknown" Format="default"><P2para><Text>“the Ministers" means the Scottish Ministers;</Text></P2para></BlockAmendment><AppendText>;</AppendText><BlockAmendment TargetClass="unknown" TargetSubClass="unknown" Context="unknown" Format="default"><P2para><Text>“third country" means a country listed in the Annex to Council Decision <Citation URI="http://www.legislation.gov.uk/european/decision/1995/0514" id="c00002" Class="EuropeanUnionDecision" Year="1995" Number="514">95/514/EC</Citation> <CommentaryRef Ref="c16203751"/>;</Text></P2para></BlockAmendment><AppendText>;</AppendText></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/4/1/b" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/4/1/b" id="regulation-4-1-b"><Pnumber>b</Pnumber><P3para><Text>the definition of “marketing" and “the Minister" shall be omitted; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/4/1/c" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/4/1/c" id="regulation-4-1-c"><Pnumber>c</Pnumber><P3para><Text>for the definition of “official examination" there shall be substituted–</Text></P3para></P3></P2para></P2><BlockText><Para><Text> <InlineAmendment>“
                official examination
              ”</InlineAmendment> means–</Text><BlockAmendment TargetClass="unknown" TargetSubClass="unknown" Context="unknown" Format="default"><P3><Pnumber>a</Pnumber><P3para><Text>in relation to Certified Seed produced in the United Kingdom–</Text><P4><Pnumber>i</Pnumber><P4para><Text>an examination or test carried out by or on behalf of the Ministers, the Minister of Agriculture, Fisheries and Food, the National Assembly for Wales or the Department of Agriculture and Rural Development;</Text></P4para></P4><P4><Pnumber>ii</Pnumber><P4para><Text>an examination carried out under official supervision; or</Text></P4para></P4><P4><Pnumber>iii</Pnumber><P4para><Text>a test carried out by an establishment licensed as a seed testing station under official supervision;</Text></P4para></P4></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>in relation to uncertified Pre-basic Seed, Pre-basic Seed and Basic Seed, produced in the United Kingdom–</Text><P4><Pnumber>i</Pnumber><P4para><Text>an examination or a test carried out by or on behalf of the Ministers, the Minister of Agriculture, Fisheries and Food, the National Assembly for Wales or the Department of Agriculture and Rural Development; or</Text></P4para></P4><P4><Pnumber>ii</Pnumber><P4para><Text>a test carried out by an establishment licensed as a seed testing station under official supervision;</Text></P4para></P4></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>in relation to any description of seed produced elsewhere than in the United Kingdom, an examination or a test approved by the Ministers;</Text></P3para></P3></BlockAmendment><AppendText>;</AppendText></Para><Para><Text> and</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="d"><Para><Text>the definition of “small package" shall be omitted.</Text></Para></ListItem></OrderedList></BlockText><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/4/2" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/4/2" id="regulation-4-2"><Pnumber>2</Pnumber><P2para><Text>After paragraph (3) of regulation 3 there shall be inserted:–</Text><BlockAmendment TargetClass="secondary" TargetSubClass="regulation" Context="main" Format="default"><P2><Pnumber>3A</Pnumber><P2para><Text>For the purposes of these Regulations, seeds–</Text><P3><Pnumber>a</Pnumber><P3para><Text>produced and packaged in a Member State other than the United Kingdom or a third country;</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>accompanied by a document issued by a competent authority concerned with the certification of beet seeds in that Member State or third country containing information specified at paragraph C(b) of Part I of Schedule 6; and</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>in respect of which an application has been made for a breeder’s confirmation under these Regulations,</Text></P3para></P3><Text>shall be deemed to be seeds produced from seeds issued with such a breeder’s confirmation.</Text></P2para></P2><P2><Pnumber>3B</Pnumber><P2para><Text>For the purposes of these Regulations, seeds–</Text><P3><Pnumber>a</Pnumber><P3para><Text>produced and packaged in a Member State other than the United Kingdom or a third country;</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>accompanied by a document issued by a competent authority concerned with the certification of beet seeds in that Member State or third country containing information specified (in respect of packages of seed not finally certified) at paragraph C(b) of Part I of Schedule 6; and</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>in respect of which an application has been made for an official certificate under these Regulations,</Text></P3para></P3><Text>shall be deemed to be seeds produced from seeds issued with a breeder’s confirmation or an official certificate.</Text></P2para></P2><P2><Pnumber>3C</Pnumber><P2para><Text>For the purposes of these Regulations, seeds–</Text><P3><Pnumber>a</Pnumber><P3para><Text>produced and packaged in a Member State other than the United Kingdom or a third country;</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>labelled in accordance with the requirements of regulation 9; and</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>in the case of a small EC package of seeds, sealed in accordance with the requirements of regulation 8(3), or, in the case of seeds other than a small EC package of seeds, sealed by a competent authority concerned with the certification of beet seeds in that Member State or third country,</Text></P3para></P3><Text>shall be deemed to fall within the meaning of the appropriate category of seeds set out in paragraph (3) above.</Text></P2para></P2></BlockAmendment><AppendText>.</AppendText></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/4/3" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/4/3" id="regulation-4-3"><Pnumber>3</Pnumber><P2para><Text>After paragraph (4) of regulation 3 there shall be inserted–</Text><BlockAmendment TargetClass="secondary" TargetSubClass="regulation" Context="main" Format="default"><P2><Pnumber>5</Pnumber><P2para><Text>In these Regulations “marketing" means–</Text><P3><Pnumber>a</Pnumber><P3para><Text>selling, holding with a view to sale and offering for sale; and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>any disposal, supply or transfer for the purpose of commercial exploitation of seed to third parties,</Text></P3para></P3><Text>whether or not for consideration; and “market" and “marketed" shall be construed accordingly.</Text></P2para></P2><P2><Pnumber>6</Pnumber><P2para><Text>Trade in seed, not aimed at commercial exploitation of the variety, such as the following operations, shall not be treated as marketing of seed of that variety–</Text><P3><Pnumber>a</Pnumber><P3para><Text>the supply of seed to official testing and inspection bodies; or</Text></P4para></P4><P4><Pnumber>ii</Pnumber><P4para><Text>carrying out tests or trials on the seed; and</Text></P4para></P4></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>everything produced from the seed, whether directly or indirectly, and any unused seed, become or remain the property of the first person,</Text></P3para></P3><Text>the prohibitions in paragraph (1) above shall not apply to the marketing of the seed by the first person to the second person as part of that arrangement or to the marketing by the second person to the first person of any seed produced (whether directly or indirectly) from that seed.</Text></P2para></P2><P2><Pnumber>2B</Pnumber><P2para><Text>The prohibitions in paragraph (1) above shall not apply to the marketing by producers of small quantities of seed, other than seed which contains any genetically modified material, for scientific purposes or selection work.</Text></P2para></P2><P2><Pnumber>2C</Pnumber><P2para><Text>If the conditions specified in paragraph (2D) below are satisfied, the prohibitions in paragraph (1) above shall not apply to–</Text><P3><Pnumber>a</Pnumber><P3para><Text>the marketing, as part of any arrangement referred to in paragraph (2A) above by the first person referred to in that paragraph to the second person referred to in that paragraph, of seed which contains any genetically modified material;</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>the marketing, as part of any arrangement referred to in paragraph (2A) above by the second person referred to in that paragraph to the first person referred to in that paragraph, of seed produced (whether directly or indirectly) from the seed marketed to him as part of any such arrangement which contains any genetically modified material; or</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>the marketing by producers, for scientific purposes or selection work, of small quantities of seed which contains any genetically modified material.</Text></P3para></P3></P2para></P2><P2><Pnumber>2D</Pnumber><P2para><Text>The conditions referred to in paragraph (2C) above are–</Text><P3><Pnumber>a</Pnumber><P3para><Text>the deliberate release of the genetically modified material has been authorised under a Part B consent, or the genetically modified material has been accepted for marketing in accordance with a Part C consent, issued for the purposes of Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1990/0220" id="c00003" Class="EuropeanEconomicCommunityDirective" Year="1990" Number="220">90/220/EEC</Citation> on the deliberate release into the environment of genetically modified organisms;</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>the seeds are accompanied during marketing by a copy of the consent;</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>all appropriate measures, in accordance with an environmental risk assessment in respect of the material carried out in accordance with article 7(4) of Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1970/0457" id="c00004" Class="EuropeanEconomicCommunityDirective" Year="1970" Number="457">70/457/EEC</Citation> <CommentaryRef Ref="c16203761"/>, have been taken by the producer of the seed to avoid adverse effects on human health and the environment; and</Text></P3para></P3><P3><Pnumber>d</Pnumber><P3para><Text>in the case of genetically modified material issued with a Part C consent, an authorisation has been granted by the Ministers in accordance with paragraph (2E) below to the person marketing the seed.</Text></P3para></P3></P2para></P2><P2><Pnumber>2E</Pnumber><P2para><Text>An authorisation may be granted by the Ministers for the purpose of paragraph (2D)(d) above if–</Text><P3><Pnumber>a</Pnumber><P3para><Text>the person intending to market the seed has applied to the Ministers before the seed is marketed–</Text><P4><Pnumber>i</Pnumber><P4para><Text>giving the Ministers notice of his intention to market the seed and a description of the proposed marketing in respect of which the authorisation is sought; and</Text></P4para></P4><P4><Pnumber>ii</Pnumber><P4para><Text>giving the Ministers such information relating to the acceptance for marketing of the variety of the seed concerned under Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/1990/0220" id="c00005" Class="EuropeanEconomicCommunityDirective" Year="1990" Number="220">90/220/EEC</Citation>, and the proposed marketing in respect of which the authorisation is sought as the Ministers may require for the purposes of determining whether or not to grant the authorisation; and</Text></P4para></P4></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>the Ministers are satisfied that an authorisation should be granted.</Text></P3para></P3></P2para></P2></BlockAmendment><AppendText>;</AppendText></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/6/e" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/6/e" id="regulation-6-e"><Pnumber>e</Pnumber><P3para><Text>after paragraph (8) there shall be inserted–</Text><BlockAmendment TargetClass="unknown" TargetSubClass="unknown" Context="unknown" Format="default"><P2><Pnumber>8A</Pnumber><P2para><Text>Beet seeds produced and packaged in a Member State other than the United Kingdom which have not yet been officially certified shall not be marketed unless they are–</Text><P3><Pnumber>a</Pnumber><P3para><Text>sealed and labelled as required by regulations 8 and 9; and</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>accompanied by an official document, containing all the information in respect of the seeds specified at paragraph C (b) of Part I of Schedule 6.</Text></P3para></P3></P2para></P2><P2><Pnumber>8B</Pnumber><P2para><Text>A person who imports a package containing a net weight of more than 2 kilograms of beet seeds produced other than in a Member State shall make available to the Ministers in such manner and at such time as the Ministers may require the information in respect of the seeds specified in Part IV of Schedule 6.</Text></P2para></P2></BlockAmendment><AppendText>;</AppendText></P3para><P3para><Text> and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/6/f" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/6/f" id="regulation-6-f"><Pnumber>f</Pnumber><P3para><Text>In regulation 5(11) (marketing of seeds) the words “may be imported but" shall be omitted.</Text></P3para></P3></P1para></P1></P1group><P1group RestrictStartDate="2000-08-01"><Title> Amendment of regulation 8 of the principal Regulations</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/7" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/7" id="regulation-7"><Pnumber>7</Pnumber><P1para><Text>In regulation 8 in paragraphs (1) and (3) the words “a small package" shall be omitted.</Text></P1para></P1></P1group><P1group RestrictStartDate="2000-08-01"><Title> Amendment of regulation 9 of the principal Regulations</Title><P1 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/8" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/8" id="regulation-8"><Pnumber>8</Pnumber><P1para><Text>In regulation 9 (labelling of packages) after paragraph (1A) there shall be inserted–</Text><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/8/a" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/8/a" id="regulation-8-a"><Pnumber>a</Pnumber><P3para><BlockAmendment TargetClass="unknown" TargetSubClass="unknown" Context="unknown" Format="default"><P2><Pnumber>1B</Pnumber><P2para><Text>If a variety has been genetically modified, any label or document, whether official or otherwise, affixed to or accompanying a seed lot or any part of a seed lot in accordance with the provisions of this regulation, shall clearly indicate that the variety has been genetically modified.</Text></P2para></P2></BlockAmendment><AppendText>;</AppendText></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/8/b" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/8/b" id="regulation-8-b"><Pnumber>b</Pnumber><P3para><Text>in paragraphs (2) and (4) for the words “a package other than a small package of Basic Seed" where they occur in those paragraphs, there shall be substituted “a package of Basic Seed";</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ssi/2000/246/regulation/8/c" IdURI="http://www.legislation.gov.uk/id/ssi/2000/246/regulation/8/c" id="regulation-8-c"><Pnumber>c</Pnumber><P3para><Text>paragraph 6 shall be omitted;
