The Census (Scotland) Amendment Order 2000

Whereas a draft of this Order was laid before the Scottish Parliament in accordance with the provisions of section 1(2) of the Census Act 19201, section 6(2) of the Statutory Instruments Act 19462 and articles 3(3) and 12 of the Scotland Act 1998 (Transitory and Transitional Provisions) (Statutory Instruments) Order 19993 and the Scottish Parliament has by resolution approved so much of the Order as prescribes particulars with respect to the matters mentioned in paragraph 6 of the Schedule to the Census Act 1920 (any other matters with respect to which it is desirable to obtain statistical information with a view to ascertaining the social or civil condition of the population)4 and during the period of forty days beginning with the day on which a copy of the draft of the Order was laid before the Scottish Parliament, the Scottish Parliament has not resolved that the draft should not be submitted to Her Majesty in Council:

Now, therefore, Her Majesty, in exercise of the powers conferred upon Her by section 1(1) of the Census Act 1920 and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

Citation, commencement and extent1

This Order may be cited as the Census (Scotland) Amendment Order 2000 and shall come into force on the day after the day on which it is made.

This Order extends to Scotland only.

Amendment of the Census (Scotland) Order 20002

The Census (Scotland) Order 20005 shall be amended in accordance with the following paragraphs.

In Schedule 2 (particulars to be stated in returns)–

a

after paragraph 8, there is inserted the following:–

As regards the person’s religion, religious denomination or body they belong to and which they were brought up in, whether–

a

none;

b

Church of Scotland;

c

Roman Catholic;

d

other Christian denomination or body and if so stating which;

e

Buddhist;

f

Hindu;

g

Jewish;

h

Muslim;

i

Sikh; or

j

another religion, denomination or body and if so stating which.

for paragraph 10, there is substituted the following:–

As regards ethnic group, whether–

a

White (and whether Scottish, other British, Irish, or any other White background if so stating which);

b

Mixed and if so stating which;

c

Asian, Asian Scottish or Asian British (and whether Indian, Pakistani, Bangladeshi, Chinese, or any other Asian background if so stating which);

d

Black, Black Scottish or Black British (and whether Caribbean, African, or any other Black background if so stating which); or

e

other ethnic group and if so stating which.

In Schedule 3 (particulars to be stated in returns to which article 6(6) relates), at the end of paragraph 3 there is inserted the following:–

  • which may include–

    1. a

      the nature of the establishment;

    2. b

      whether or not the establishment is registered and if so whether it is registered with–

      1. i

        a health authority;

      2. ii

        a local authority; or

      3. iii

        both a health authority and a local authority;

    3. c

      the status of the person or body who is responsible for the management of the establishment;

    4. d

      the category or categories of person which the establishment caters for, the physical or mental condition attributable to that category or those categories of person and the type of services which the establishment provides.

This Order amends the Census (Scotland) Order 2000 by setting out the particulars to be stated with respect to religion (article 2(2)(a)) and amending the particulars to be stated with respect to ethnicity (article 2(2)(b)) and the communal establishment form (article 2(3)) in returns to be made in the Census to be held in Scotland on 29th April 2001.
