The Scottish Ministers, in exercise of the powers conferred upon them by section 8(5) of the Breeding and Sale of Dogs (Welfare) Act 1999(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation, commencement and extentS

1.—(1) These Regulations may be cited as the Sale of Dogs (Identification Tag) (Scotland) Regulations 1999 and shall come into force on 30th December 1999.

(2) These Regulations extend to Scotland only.

ProvisionsS

2.  In addition to the information required under section 8(5) of the Breeding and Sale of Dogs (Welfare) Act 1999 to be displayed on an identifying tag or badge, that identifying tag or badge shall also clearly display the following other information:–

(a)the date of birth of the dog; and

(b)the identifying number, if any, allocated to the dog by the licensed breeding establishment at which it was born.

Explanatory Note

(This note is not part of the Regulations)

The Breeding and Sale of Dogs (Welfare) Act 1999 creates certain offences in relation to the sale of a dog which is not wearing a collar with an identifying tag or badge. Section 8(5) of that Act defines “identifying tag or badge” as a tag or badge which clearly displays information indicating the licensed breeding establishment at which it was born and any other information required by Regulations.

These Regulations, which apply to Scotland only, set out the additional information which must be displayed on the tag or badge.
