The Scottish Ministers make the following Order in exercise of the powers conferred by section 141(2) of the Criminal Justice Act 1988(1) and all other powers enabling them to do so.
In accordance with section 141(11J)(2) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
1988 c. 33; the functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
Section 141(11J) was inserted by section 60(1)(b) of the Custodial Sentences and Weapons (Scotland) Act 2007 (asp 17).
