The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 88 of the Climate Change (Scotland) Act 2009(1) and all other powers enabling them to do so.
In accordance with section 96(4)(2) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
1. These Regulations may be cited as the Single Use Carrier Bags Charge (Scotland) Amendment Regulations 2021 and come into force on 1 April 2021.
2. In regulation 6(2) of the Single Use Carrier Bags Charge (Scotland) Regulations 2014(3), for “5” substitute “10”.

These Regulations amend the Single Use Carrier Bags Charge (Scotland) Regulations 2014.
Regulation 2 makes provision for the minimum amount that a supplier must charge for a single use carrier bag to be increased from 5 pence to 10 pence.
A Business Regulatory Impact Assessment has been prepared and placed in the Scottish Parliament Information Centre. Section 96(4) has been modified by paragraph 5 of schedule 3 to the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10).
