http://www.legislation.gov.uk/nisr/2021/298/introductionThe Occupational and Personal Pension Schemes (Conditions for Transfers) Regulations (Northern Ireland) 2021enPENSIONSStatute Law Database2026-04-13Expert Participation2026-04-06 These Regulations prescribe the conditions for pension transfers that the Department for Communities is required to prescribe further to the amendments made by paragraph 13 of Schedule 11 to the Pension Schemes 2021 to the Pension Schemes (Northern Ireland) Act 1993 (“the 1993 Act”), in particular the insertion of subsections (6ZA) to (6ZC) into section 91 and of subsections (5A) to (5C) into section 97F. Those sections of the 1993 Act provide for the different ways in which trustees or managers of an occupational or personal pension scheme may, further to application or notice from the member of their scheme (“the transferring scheme”), use the cash equivalent value of, respectively, either the member’s accrued rights to benefits, or pension credit rights, so as to make a transfer of that value into another occupational or personal pension scheme. 2021 No. 298 Made 9th November 2021 Coming into operation 30th November 2021 The Department for Communities makes the following Regulations in exercise of the powers conferred by sections 91(6ZA) to (6ZC), 97F(5A) to (5C), 177(2) and (3) and 178(1) of the Pension Schemes (Northern Ireland) Act 1993 and now vested in it. 1993 c. 49; section 91(6ZA) to (6ZC) was inserted by paragraph 13(2) of Schedule 11 to the Pension Schemes Act 2021 (c.1); section 97F was inserted by Article 34 of the Welfare Reform and Pensions Order (Northern Ireland) 1999 (S.I.1999/3147(N.I.11)) and subsections (5A) to (5C) were inserted by paragraph 13(6) of Schedule 11 to the Pension Schemes Act 2021; section 178(1) was amended by Parts 3 and 4 of Schedule 5 to the Pensions (Northern Ireland) Order 1995 (S.I. 1995/3213 (N.I. 22)) See Article 8(b) of S.R. 1999 No. 481 and section 1(7) of the Departments Act (Northern Ireland) 2016 (c. 5 (N.I.))
