Rights (Northern Ireland) Order 1996 (Protection from Detriment in Health and Safety Cases) (Amendment) Order (Northern Ireland) 2021 and comes into operation on 31st May 2021.</p></content></article><article eId="article-2"><heading>Amendments of the Employment Rights (Northern Ireland) Order 1996</heading><num>2.</num><content><p>The Employment Rights (Northern Ireland) Order 1996<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00009" href="http://www.legislation.gov.uk/id/nisi/1996/1919">S.I. 1996/1919 (N.I.  16)</ref>.</p></authorialNote> is amended as follows.</p></content></article><article eId="article-3"><heading>Amendment of Article 68</heading><num>3.</num><intro><p>In Article 68 (health and safety cases)—</p></intro><level class="para1" eId="article-3-a"><num>(a)</num><content><p>in paragraph (1), omit sub-paragraphs (d) and (e);</p></content></level><level class="para1" 247</heading><num>6.</num><content><p><mod>In Article 247 (remedy for infringement of certain rights) after paragraph (1) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" Article 68(1A), the reference in paragraph (1) to an employee has effect as a reference to a worker.</p></content></paragraph></quotedStructure><inline name="appendText">.</inline></mod></p></content></article><article eId="article-7"><heading>Transitional and saving provision</heading><num>7.</num><paragraph eId="article-7-1"><num>(1)</num><content><p>A worker is not to be regarded as having been subjected to a detriment in contravention of Article 68(1A) of the Employment Rights (Northern Ireland) Order 1996 if the date of the relevant act or failure to act, or the last of a series of similar relevant acts or failures to act, occurred before commencement day.</p></content></paragraph><paragraph eId="article-7-2"><num>(2)</num><content><p>If the date of the last of a series of similar relevant acts or failures to act occurs on or after commencement day, the fact that a relevant act or failure to act in that series occurred before commencement day does not prevent it from being taken into account in determining whether the worker has been subjected to a detriment in contravention of Article 68(1A) of the Employment Rights (Northern Ireland) Order 1996.</p></content></paragraph><paragraph eId="article-7-3"><num>(3)</num><content><p>The repeal by this Order of Article 68(1)(d) and (e) does not prevent a complaint under Article 71 that an employee has been subjected to detriment in contravention of Article 68(1)(d) or (e) from being presented or continued on or after commencement day if the date of the relevant act or failure to act, or the last of a series of similar relevant acts or failures to act, occurred before commencement day.</p></content></paragraph><paragraph eId="article-7-4"><num>(4)</num><intro><p>In this article—</p></intro><hcontainer name="definition"><content><p>“commencement day” means the day on which this Order comes into operation;</p></content></hcontainer><hcontainer name="definition"><intro><p>“relevant act or failure to act” means—</p></intro><level class="para1"><num>(a)</num><content><p>in relation to Article 68(1) of the Employment Rights (Northern Ireland) Order 1996, an act, or deliberate failure to act, by an employer done on the ground set out in Article 68(1)(d) or (e) of that Order;</p></content></level><level class="para1"><num>(b)</num><content><p>in relation to Article 68(1A) of the Employment Rights (Northern Ireland) Order 1996, an act, or deliberate failure to act,
