The Health Protection (Coronavirus, International Travel) (Amendment No. 27) Regulations (Northern Ireland) 2020

Coming into operation in accordance with regulation 1

The Department of Health M1 makes the following Regulations in exercise of the powers conferred by sections 25B and 25F(2) of the Public Health Act (Northern Ireland) 1967 M2.

Citation, commencement and interpretationN.I.

1.—(1) These Regulations may be cited as the Health Protection (Coronavirus, International Travel) (Amendment No. 27) Regulations (Northern Ireland) 2020 and shall come into operation at the time and on the date that the Regulations are made.

(2) In these Regulations, “the principal Regulations” means the Health Protection (Coronavirus, International Travel) Regulations (Northern Ireland) 2020 M3.

Amendment of the Health Protection (Coronavirus, International Travel) Regulations (Northern Ireland) 2020N.I.

2.—(1) The principal Regulations are amended in accordance with regulations 3 and 4.

(2) In relation to any person who arrived in Northern Ireland on or after 10th July 2020 and before the coming into operation of any amendment made by regulation 3 the principal Regulations apply as if that amendment had not been made.

Amendments to regulation 3N.I.

3.  In regulation 3(requirement to provide information), after paragraph (9) insert—

(10) Paragraph (9) does not apply in relation to a person who has arrived in Northern Ireland from South Africa or has, within the period beginning with the 14th day before the date of their arrival in Northern Ireland, departed from or transited through South Africa..

Amendments to regulation 4N.I.

4.—(1) Regulation 4 (requirement to self isolate), is amended as follows.

(2) After paragraph (1) insert—

(1A) This regulation also applies where a person (“P”) is residing at an address at which another person (D) is residing, where D is required to self-isolate under these Regulations because D has arrived in Northern Ireland from South Africa or has, within the period beginning with the 14th day before the date of D's arrival in Northern Ireland, departed from or transited through South Africa..

(3) In paragraph (3)—

(a)in sub-paragraph (a), for “or (c)” substitute “ ,(c) or (d) ”;

(b)after sub-paragraph (c), insert—

(d)where P is a person described in paragraph (1A), at the address referred to in that paragraph..

(4) In paragraph (6)(c), for “(c)” substitute “ (d) ”.

(5) In paragraph (7), before “P must” insert “ Where P is a person described in paragraph (1), ”.

(6) After paragraph (7), insert—

(7A) Where P is a person described in paragraph (1A) (residing with another person “D”), P must self-isolate until the end of the period during which, according to paragraph (7), D is required to self-isolate..

(7) In paragraph (12), for “If” substitute “ Subject to paragraph (13), if ”.

(8) After paragraph (12), insert—

(13) Paragraph (12) does not apply in relation to a person (“D”) who has, at any time in the period beginning with the 14th day before the date of their arrival in Northern Ireland, departed from or transited through South Africa.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Health Protection (Coronavirus, International Travel) Regulations (Northern Ireland) 2020 (“The principal Regulations”) —

(a)

Ensure a person listed in regulation 3(9) of the principal Regulations is not exempt from the requirement to comply with regulation 3 of those regulations if that person has arrived in Northern Ireland from South Africa or has, within the period beginning with the 14th day before the date of their arrival in Northern Ireland, departed from or transited through South Africa (“South Africa arrivals”).

(b)

Remove exemptions from the requirement to self-isolate for people who have arrived in Northern Ireland from South Africa or who have arrived in Northern Ireland from elsewhere and, during the 14 days preceding their arrival in Northern Ireland, have been in or transited through South Africa.

(c)

Require people residing at the same address as South Africa arrivals to self-isolate.

No impact assessment has been prepared for these Regulations.
