eId="body"><hcontainer name="regulation" eId="regulation-1"><heading>Citation, commencement</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Social Security (Fines) (Deductions from Benefits) Regulations (Northern Ireland) 2018 and shall come into operation on 1st June 2018.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><hcontainer name="wrapper2"><paragraph eId="regulation-2-1"><num>(1)</num><intro><p>In these Regulations—</p></intro><hcontainer name="definition"><content><p>“the 1995 Order” means the Jobseekers (Northern Ireland) Order 1995<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00006" href="http://www.legislation.gov.uk/id/nisi/1995/2705">S.I. 1995 No. 2705 (N.I. 15)</ref></p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“the 2007 Act” means the Welfare Reform Act (Northern Ireland) 2007<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00007" href="http://www.legislation.gov.uk/id/nia/2007/2">2007 c. 2 (N.I.)</ref></p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“the 2015 Order” means the Welfare Reform (Northern Ireland) Order 2015<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00008" href="http://www.legislation.gov.uk/id/nisi/2015/2006">S.I. 2015/2006 (N.I. 1)</ref></p></authorialNote></p></content></hcontainer><hcontainer name="definition"><content><p>“the 2016 Act” means the Justice Act (Northern Ireland) 2016;</p></content></hcontainer><hcontainer name="definition"><content><p>“application” means an application for deduction from benefit made under section 14 of the 2016 Act;</p></content></hcontainer><hcontainer name="definition"><intro><p>“benefit week” has the meaning prescribed in—</p></intro><level class="para1"><num>(a)</num><content><p>regulation 2(1) of the Income Support Regulations;</p></content></level><level class="para1"><num>(b)</num><content><p>regulation 1(2) of the State Pension Credit Regulations (Northern Ireland) 2003<authorialNote class="footnote" eId="f00007" marker="7"><p><ref eId="c00009" href="http://www.legislation.gov.uk/id/nisr/2003/28">S.R. 2003 No. 28</ref></p></authorialNote></p></content></level><level class="para1"><num>(c)</num><content><p>regulation 1(2) of the Jobseekers Allowance Regulations; or</p></content></level><level class="para1"><num>(d)</num><content><p>regulation 2(1) of the Employment and Support Allowance Regulations.</p></content></level></hcontainer><hcontainer name="definition"><content><p>“the Claims and Payments Regulations” means the Social Security (Claims and Payments) Regulations (Northern Ireland) 1987<authorialNote class="footnote" eId="f00008" marker="8"><p><ref eId="c00010" href="http://www.legislation.gov.uk/id/nisr/1987/465">S.R. 1987 No. 465</ref>; relevant amending regulations are <ref eId="c00011" href="http://www.legislation.gov.uk/id/nisr/1988/67">S.R. 1988 No. 67</ref>, <ref eId="c00012" href="http://www.legislation.gov.uk/id/nisr/1989/40">S.R. 1989 No. 40</ref>, <ref eId="c00013" href="http://www.legislation.gov.uk/id/nisr/1993/146">S.R. 1993 No. 146</ref>, <ref eId="c00014" <ref eId="c00018" href="http://www.legislation.gov.uk/id/nisr/2007/330">330</ref> and <ref eId="c00019" href="http://www.legislation.gov.uk/id/nisr/2008/428">S.R. 2008 No. 428</ref></p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“collection officer”, means a person so designated under section 2(1) of the 2016 Act;</p></content></hcontainer><hcontainer name="definition"><content><p>“contribution-based jobseeker’s allowance”, except in a case to which paragraph (b) of the definition of income-based jobseeker’s allowance applies, means a contribution-based jobseeker’s allowance under Part II of the 1995 Order as amended by the provisions of Part 1 of Schedule 12 to the 2015 Order that remove references to an income-based allowance or under Part II of the 1995 Order as it has effect apart from those amendments, but does not include any back to work bonus under Article 28 of the 1995 Order which is paid as jobseeker’s allowance;</p></content></hcontainer><hcontainer name="definition"><content><p>“contributory employment and support allowance” means a contributory allowance under Part I of the 2007 Act as amended by the provisions of Schedule 3, and Part 1 of Schedule 12, to the 2015 Order that remove references to an income-related allowance or under Part 1 of the 2007 Act as it has effect apart from those amendments;</p></content></hcontainer><hcontainer name="definition"><content><p>“court” means the responsible court under section 27(1) of the 2016 Act;</p></content></hcontainer><hcontainer name="definition"><content><p>“debtor” has the meaning as defined under section 1(2) of the 2016 Act;</p></content></hcontainer><hcontainer name="definition"><content><p>“the Employment and Support Allowance Regulations” means the Employment and Support Allowance Regulations (Northern Ireland) 2008<authorialNote class="footnote" eId="f00009" marker="9"><p><ref eId="c00020" href="http://www.legislation.gov.uk/id/nisr/2008/280">S.R. 2008 No. 280</ref></p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“5 per cent. of the personal allowance for a single claimant aged not less than 25” means, where the percentage is not a multiple of 5 pence, the sum obtained by rounding that 5 per cent. to the next higher such multiple;</p></content></hcontainer><hcontainer name="definition"><content><p>“income support” means income support under Part VII of the Social Security Contributions and Benefits (Northern Ireland) Act 1992<authorialNote class="footnote" eId="f00010" marker="10"><p><ref eId="c00021" href="http://www.legislation.gov.uk/id/ukpga/1992/7">1992 c. 7</ref></p></authorialNote>, but does not include any back to work bonus under Article 28 of the 1995 Order which is paid as income support;</p></content></hcontainer><hcontainer name="definition"><content><p>“Income Support Regulations” means the Income Support (General) Regulations (Northern Ireland) 1987<authorialNote class="footnote" eId="f00011" marker="11"><p><ref eId="c00022" href="http://www.legislation.gov.uk/id/nisr/1987/459">S.R. 1987 No. 459</ref></p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><intro><p>“income-based jobseeker’s allowance” means—</p></intro><level class="para1"><num>(a)</num><content><p>an income-based jobseeker’s allowance under Part II of the 1995 Order; and</p></content></level><level class="para1"><num>(b)</num><content><p>in a case where, if there was no entitlement to contribution-based jobseeker’s allowance, there would be entitlement to income-based jobseeker’s allowance at the same rate, contribution-based jobseeker’s allowance,</p></content></level></hcontainer></paragraph></hcontainer><hcontainer name="wrapper2"><intro><p>but does not include any back to work bonus under Article 28 of the 1995 Order which is paid as jobseeker’s allowance;</p></intro><hcontainer name="definition"><intro><p>“income-related employment and support allowance” means—</p></intro><level class="para1"><num>(a)</num><content><p>an income-related employment and support allowance under Part 1 of the 2007 Act; and</p></content></level><level class="para1"><num>(b)</num><content><p>in a case where, if there was no entitlement to contributory employment and support allowance, there would be entitlement to income-related employment and support allowance at the same rate, contributory employment and support allowance;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“jobseeker’s allowance” means an allowance under Part II of the 1995 Order but does not include any back to work bonus under Article 28 of that Order which is paid as jobseeker’s allowance;</p></content></hcontainer><hcontainer name="definition"><content><p>“Jobseeker’s Allowance Regulations” means the Jobseeker’s Allowance Regulations (Northern Ireland) 1996<authorialNote class="footnote" eId="f00012" marker="12"><p><ref eId="c00023" href="http://www.legislation.gov.uk/id/nisr/1996/198">S.R. 1996 No. 198</ref></p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“outstanding amount” has the meaning prescribed in section 1(2) of the 2016 Act;</p></content></hcontainer><hcontainer name="definition"><intro><p>“personal allowance for a single claimant aged not less than 25” means—</p></intro><level class="para1"><num>(a)</num><content><p>in the case of a person who is entitled to either income support or state pension credit, the amount for the time being specified in paragraph 1(1)(e) of Column (2) of Schedule 2 to the Income Support Regulations; or</p></content></level><level class="para1"><num>(b)</num><content><p>in the case of a person who is entitled to an income-based jobseeker’s allowance, the amount for the time being specified in paragraph 1(1)(e) of Column (2) of Schedule 1 to the Jobseeker’s Allowance Regulations; or</p></content></level><level class="para1"><num>(c)</num><content><p>in the case of a person who is entitled to an income-related employment and support allowance, the amount specified for the time being in paragraph 1(1)(b) of Column 2 of Schedule 4 to the Employment and Support Allowance Regulations;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“state pension credit” means the benefit of that name payable under the State Pension Credit Act (Northern Ireland) 2002<authorialNote class="footnote" eId="f00013" marker="13"><p><ref eId="c00024" href="http://www.legislation.gov.uk/id/ukpga/2002/14">2002 c. 14</ref></p></authorialNote>;</p></content></hcontainer><paragraph eId="regulation-2-2"><num>(2)</num><content><p>The Interpretation Act (Northern Ireland) 1954<authorialNote class="footnote" eId="f00014" marker="14"><p><ref eId="c00025" href="http://www.legislation.gov.uk/id/apni/1954/33">1954 c. 33(N.I.)</ref> </p></authorialNote> applies to these Regulations as it applies to an Act of the Assembly.</p></content></paragraph></hcontainer></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Deduction from debtor’s income support, state pension credit, jobseeker’s allowance or employment and support allowance</heading><num>3.</num><hcontainer name="wrapper2"><paragraph eId="regulation-3-1"><num>(1)</num><intro><p>Subject to regulation 4, where—</p></intro><level class="para1" eId="regulation-3-1-a"><num>(a)</num><content><p>the Department receives an application from a collection officer in respect of a debtor who is entitled to income support, state pension credit, income-based jobseeker’s allowance or income-related employment and support allowance;</p></content></level><level class="para1" eId="regulation-3-1-b"><num>(b)</num><content><p>the amount payable by way of that benefit, after any deduction under this paragraph, is 10 pence or more; and</p></content></level><level class="para1" eId="regulation-3-1-c"><num>(c)</num><content><p>the aggregate amount payable under one or more of paragraphs 3(2)(a), 5(5), 6(2)(a), 6A(3) or href="http://www.legislation.gov.uk/id/nisr/1988/67">S.R. 1988 No. 67</ref> to which there are amendments not relevant to these Regulations</p></authorialNote> to the Claims and Payments Regulations, together with the amount to be deducted under this paragraph does not exceed an amount equal to 3 times 5 per cent. of the personal allowance for a single claimant aged not less than 25 years,</p></content></level></paragraph></hcontainer><hcontainer name="wrapper2"><intro><p>the Department may deduct a sum from that benefit which is equal to 5 per cent. of the personal allowance for a single claimant aged not less than 25 or £5, whichever is the greater amount allowed by sub-paragraphs (b) and (c) and pay that sum to the court towards satisfaction of the outstanding amount.</p></intro><paragraph eId="regulation-3-2"><num>(2)</num><intro><p>Subject to regulation 4, where—</p></intro><level class="para1" eId="regulation-3-2-a"><num>(a)</num><content><p>the Department receives an application from a collection officer in respect of a debtor who is entitled to contribution-based jobseeker’s allowance or contributory employment and support allowance; and</p></content></level><level class="para1" eId="regulation-3-2-b"><num>(b)</num><content><p>the amount of that allowance payable, before any deduction under this paragraph, is 10 pence or more,</p></content></level></paragraph></hcontainer><hcontainer name="wrapper2"><intro><p>the Department may deduct a sum from that allowance, up to the appropriate maximum specified in paragraph (3), and pay that sum to the court towards satisfaction of the outstanding amount.</p></intro><paragraph eId="regulation-3-3"><num>(3)</num><intro><p>The appropriate maximum is 40 per cent. of the appropriate age-related amount for the debtor specified—</p></intro><level class="para1" eId="regulation-3-3-a"><num>(a)</num><content><p>where the debtor is entitled to contribution-based jobseeker’s allowance, in regulation 79<authorialNote class="footnote" eId="f00016" marker="16"><p>Regulation 79 was amended by Article 21(c) of <ref eId="c00027" href="http://www.legislation.gov.uk/id/nisr/2015/124">S.R. 2015 No. 124</ref> and regulation 4(9) of <ref eId="c00028" href="http://www.legislation.gov.uk/id/nisr/2017/116">S.R. 2017 No. 116</ref></p></authorialNote> of the Jobseeker’s Allowance Regulations or, as the case may be, regulation 49 of the Jobseeker’s Allowance Regulations (Northern Ireland) 2016<authorialNote class="footnote" eId="f00017" marker="17"><p><ref eId="c00029" href="http://www.legislation.gov.uk/id/nisr/2016/218">S.R. 2016 No. 218</ref></p></authorialNote>;</p></content></level><level class="para1" eId="regulation-3-3-b"><num>(b)</num><content><p>where the debtor is entitled to contributory employment and support allowance, in paragraph 1(1) of Schedule 4 to the Employment and Support Allowance Regulations or, as the case may be, regulation 62(1)(b) of the Employment and Support Allowance Regulations (Northern Ireland) 2016<authorialNote class="footnote" eId="f00018" marker="18"><p><ref eId="c00030" href="http://www.legislation.gov.uk/id/nisr/2016/219">S.R. 2016 No. 219</ref></p></authorialNote>.</p></content></level></paragraph><paragraph eId="regulation-3-4"><num>(4)</num><content><p>The Department shall notify the debtor and the court in writing of a decision to make a deduction under this regulation so far as is practicable within 14 days from the date on which it made the decision and at the same time shall notify the debtor of a right to appeal.</p></content></paragraph></hcontainer></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Circumstances, time of making and termination of deductions</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><intro><p>The Department may make deductions from under regulation 3(1) or (2) only if—</p></intro><level class="para1" eId="regulation-4-1-a"><num>(a)</num><content><p>the debtor is entitled to income support, state pension credit, jobseeker’s allowance or employment and support allowance throughout any benefit week; and</p></content></level><level class="para1" eId="regulation-4-1-b"><num>(b)</num><content><p>no deductions are being made in respect of the debtor under any other application.</p></content></level></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><content><p>The Department shall make deductions from income support, state pension credit, jobseeker’s allowance or employment and support allowance by reference to the times at which payment of income support, state pension credit, jobseeker’s allowance or employment and support allowance is made to the debtor<authorialNote class="footnote" eId="f00019" marker="19"><p><i>See</i> Schedule 7 to <ref eId="c00031" href="http://www.legislation.gov.uk/id/nisr/1987/465">S.R. 1987 No. 465</ref></p></authorialNote>.</p></content></paragraph><paragraph eId="regulation-4-3"><num>(3)</num><intro><p>The Department shall cease making deductions from income support, state pension credit, jobseeker’s allowance or employment and support allowance if—</p></intro><level class="para1" eId="regulation-4-3-a"><num>(a)</num><content><p>there is no longer sufficient entitlement to income support, state pension credit, jobseeker’s allowance or employment and support allowance to enable it to make the deduction;</p></content></level><level class="para1" eId="regulation-4-3-b"><num>(b)</num><content><p>entitlement to income support, state pension credit, jobseeker’s allowance or employment and support allowance ceases;</p></content></level><level class="para1" eId="regulation-4-3-c"><num>(c)</num><content><p>a collection officer withdraws the application for deductions to be made; or</p></content></level><level class="para1" eId="regulation-4-3-d"><num>(d)</num><content><p>the liability to make payment of the outstanding amount has ceased.</p></content></level></paragraph><paragraph eId="regulation-4-4"><num>(4)</num><content><p>Payments of sums deducted from income support, state pension credit, jobseeker’s allowance or employment and support allowance under these Regulations shall be made to the court at intervals of 13 weeks.</p></content></paragraph><paragraph eId="regulation-4-5"><num>(5)</num><intro><p>The Department shall notify the debtor in writing of the total of sums deducted under any application—</p></intro><level class="para1" eId="regulation-4-5-a"><num>(a)</num><content><p>on receipt of a written request for such information from the debtor; or</p></content></level><level class="para1" eId="regulation-4-5-b"><num>(b)</num><content><p>on the termination of deductions made under any such application.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Amendment of the Claims and Payments Regulations</heading><num>5.</num><intro><p>Schedule 8A of the Social Security (Claims and Payments) Regulations (Northern Ireland) 1987 is amended as follows—</p></intro><level class="para1" eId="regulation-5-a"><num>(a)</num><content><p><mod>in paragraph 1 (interpretation) after the definition of “family” insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown"
