SCHEDULE 2AMENDMENT OF WATER PROVISIONS

Amendment of the Control of Asbestos in Water Regulations (Northern Ireland) 1995

1.  In the Control of Asbestos in Water Regulations (Northern Ireland) 1995(1), in regulation 2(1) (Interpretation), for the definition of “the Directive” substitute—

“the Directive” means Council Directive 87/217/EEC on the prevention and reduction of environmental pollution by asbestos as last amended by Decision (EU) 2018/853 as regards procedural rules in the field of environmental reporting(2)..

Amendment of the Urban Waste Water Treatment Regulations (Northern Ireland) 2007

2.  The Urban Waste Water Treatment Regulations (Northern Ireland) 2007(3) are amended as follows.

3.  In regulation 2(1) (Interpretation), for the definition of “the Directive” substitute—

“the Directive” means Council Directive 91/271/EEC concerning urban waste water treatment as last amended by Council Directive 2013/64/EU(4);.

4.  In Schedule 1(CRITERIA FOR IDENTIFICATION OF SENSITIVE AREAS), Part 1, sub-paragraph (b), for the words from “the concentration” to “Member States” substitute “50mg/l of nitrates in 95% of the samples”.

Amendment of the Quality of Bathing Water Regulations (Northern Ireland) 2008.

5.  The Quality of Bathing Water Regulations (Northern Ireland) 2008(5) are amended as follows.

6.  In regulation 2(2) (Interpretation), for the definition of “Bathing Water Directive” substitute—

“Bathing Water Directive” means Directive 2006/7/EC of the European Parliament and of the Council concerning the management of bathing water quality as last amended by Council Directive 2013/64/EU(6);.

7.  In Schedule 4, paragraph 2, for “the Directive” substitute “the Bathing Water Directive”.

Amendment of the Groundwater Regulations (Northern Ireland) 2009

8.  The Groundwater Regulations (Northern Ireland) 2009(7) are amended as follows.

9.  In regulation 2(1) (Interpretation), for the definition of “the Water Framework Directive” substitute—

“the Water Framework Directive” means Directive 2000/60/EC of the European Parliament and of the Council establishing a framework for Community action in the field of water policy as last amended by Commission Directive 2014/101/EU(8)..

10.  In regulation 13 (Review of existing disposal licences and existing resolutions of a District Council), for “Council Directive 80/68/EEC” substitute “the Directive”.

Amendment of the Water Supply (Domestic Distribution Systems) Regulations (Northern Ireland) 2010

11.  In the Water Supply (Domestic Distribution Systems) Regulations (Northern Ireland) 2010(9), in regulation 1(2)(b) (Citation, commencement and interpretation), for the definition of “the Drinking Water Directive” substitute—

“the Drinking Water Directive” means Council Directive 98/83/EC on the quality of water intended for human consumption as last amended by Commission Directive (EU) 2015/1787(10);.

Amendment of the Chemical Analysis of Water Status (Technical Specifications) Regulations (Northern Ireland) 2011

12.  In the Chemical Analysis of Water Status (Technical Specifications) Regulations (Northern Ireland) 2011(11), in regulation 2(1) (Interpretation), for the definition of “the Water Framework Directive” substitute—

“the Water Framework Directive” means Directive 2000/60 EC of the European Parliament and of the Council establishing a framework for Community action in the field of water policy as last amended by Commission Directive 2014/101/EU(12)..

13.  In the Water Framework Directive (Classification, Priority Substances and Shellfish Waters) Regulations (Northern Ireland) 2015 (13), in regulation 15(2)(b) (Watch List), for “2008 Directive” substitute “the Directive”.

Amendment of the Water Environment (Water Framework Directive) Regulations (Northern Ireland) 2017

14.  In the Water Environment (Water Framework Directive) Regulations (Northern Ireland) 2017(14), for Schedule 3 (EU instruments for the protection of water) substitute—

3.  Council Directive 92/43/EEC on the conservation of natural habitats of wild fauna and flora as last amended by Council Directive 2013/17/EU(17).

8.  Directive 2009/147/EC of the European Parliament and of the Council on the conservation of wild birds as last amended by Council Directive 2013/17/EU(22).

9.  Directive 2010/75/EU of the European Parliament and of the Council on industrial emissions (integrated pollution prevention and control)(23).

10.  Directive 2011/92/EU of the European Parliament and of the Council on the assessment of the effects of certain public and private projects on the environment as last amended by the Directive 2014/52/EU(24).

11.  Directive 2012/18/EU of the European Parliament and of the Council on the control of major-accident hazards involving dangerous substances(25)..

Amendment of the Private Water Supplies Regulations (Northern Ireland) 2017

15.  In the Private Water Supplies Regulations (Northern Ireland) 2017(26) in Schedule 4 (Sampling and Analysis), Part 3, paragraph 7 and Table D, footnote 1 for “laid down in Annex III, Table A of Directive 96/29/Euratom” substitute “referred to as “standard values and relationships” in Article 13, and recommended for the estimation of doses from internal exposure in the definition of “standard values and relationships” in Article 4(96), of the Council Directive 2013/59/Euratom laying down basic safety standards for protection against the dangers arising from exposure to ionising radiation(27)”.

Amendment of the Water Supply (Water Quality) Regulations (Northern Ireland) 2017

16.  The Water Supply (Water Quality) Regulations (Northern Ireland) 2017(28) are amended as follows.

17.  In Schedule 5 (Monitoring for Individual Radionuclides)—

(a)In paragraph 2, for “laid down in Annex III, Table A of Directive 96/29/Euratom” substitute “referred to as “standard values and relationships” in Article 13, and recommended for the estimation of doses from internal exposure in the definition of “standard values and relationships” in Article 4(96), of the Council Directive 2013/59/Euratom laying down basic safety standards for the protection against the dangers arising from exposure to ionising radiation (29)”;
