This Order brings sections 15, 16 and 26(2) of, and Schedule 3 to, the Environmental Better Regulation Act (Northern Ireland) 2016 into operation.
The purpose of this Order is to enable fireplaces and fuels which cause only limited amounts of smoke pollution to become officially designated for use in smoke control areas in Northern Ireland without the need for legislation to be compiled.
Instead, the fuels and fireplaces are designated as being suitable for use in smoke control areas once added to lists kept by the Department of Agriculture, Environment and Rural Affairs, and published in a manner that it considers appropriate.
The lists are currently available to the public on request from the Department of Agriculture, Environment and Rural Affairs, Goodwood House, 44-58 May Street, Town Parks, Belfast BT1 4NN. The lists can also be found at the following web-sites:

The following Regulations are impliedly revoked by the making of this Order—
the Smoke Control Areas (Authorised Fuels) (Amendment) Regulations (Northern Ireland) 2015(1);
the Smoke Control Areas (Exempted Fireplaces) (Amendment) Regulations (Northern Ireland) 2015(2); and
the Smoke Control Areas (Exempted Fireplaces) (Amendment No. 2) Regulations (Northern Ireland) 2015(3).
