Crown servants and members of Her Majesty's forces posted overseas10

The following persons do not have to meet the basic condition to be in Northern Ireland—
a
a Crown servant or member of Her Majesty's forces posted overseas;
b
in the case of joint claimants, the partner of a person mentioned in sub-paragraph (a) while they are accompanying the person on that posting.

A person mentioned in paragraph (1)(a) is posted overseas if the person is performing overseas the duties of a Crown servant or member of Her Majesty's forces and was, immediately before their posting or the first of consecutive postings, habitually resident in the United Kingdom.

In this regulation—
“Crown servant” means a person holding an office or employment under the Crown, and
“Her Majesty's forces” has the meaning in the Armed Forces Act 2006 M1.
