Amendment of the Pension Protection Fund (Entry Rules) Regulations21.

In regulation 2 of the Pension Protection Fund (Entry Rules) Regulations (Northern Ireland) 200557 (schemes which are not eligible schemes)—

(a)

in paragraph (1)(g)(ii) for “is not contracted-out” substitute “was not contracted-out at any time before the second abolition date”;

(b)

after paragraph (8)58 add—

“(9)

In this regulation—

“contracted-out” is to be construed in accordance with section 3B(2) of the Pension Schemes Act;

“the second abolition date” has the meaning given in section 176(1) of the Pension Schemes Act.”.
