The Planning (2011 Act) (Commencement No.2) Order (Northern Ireland) 2015
Citation and interpretation1.

This Order may be cited as the Planning (2011 Act) (Commencement No.2) Order (Northern Ireland) 2015.

In this Order, “the 2011 Act” means the Planning Act (Northern Ireland) 2011.
Provision conferring power to make secondary legislation2.
To the extent that the provisions referred to in Article 3 confer or relate to the power to make orders and regulations, those provisions come into operation on 1st February 2015 for the purposes of enabling orders and regulations to be made.
Appointed day3.
(1)
Except for the provision mentioned in paragraph (2), the provisions of Part 3 of the 2011 Act (planning control) shall come into operation on 1st April 2015.

The provision mentioned for the purposes of this paragraph is section 63(1)(d) of the 2011 Act.

This Order provides for the coming into operation of Part 3 of the Planning Act (Northern Ireland) 2011 on the 1st February 2015 for the purposes only of making regulations and orders and 1st April 2015 for all other purposes.
Section 61(3)(d) is not being commenced at this time because Article 2 of the Electricity Consents (Planning) (Northern Ireland) Order 2006 which is the legislation which gives effect to the deemed permission procedure under Schedule 8 of the Electricity (Northern Ireland) Order 1992 has not yet been commenced.
The following provisions of the Planning Act (Northern Ireland) 2011 have been brought into operation by a Commencement Order made before the date of this Order.
