The scheme manager or Department may publish or provide to the Department of Finance and Personnel scheme information (as defined in section 15 of the 2014 Act) whether or not required to do so by any Department of Finance and Personnel directions given from time to time pursuant to that section.

Nothing in sub-paragraph (1) requires the scheme manager or the Department to publish or provide to the Department of Finance and Personnel any scheme information—

a

which the scheme manager or the Department is not required by the Department of Finance and Personnel directions to publish or provide to the Department of Finance and Personnel; or

b

which the scheme manager or the Department, apart from sub-paragraph (1), is prohibited lawfully from publishing or providing.
