The Justice (Northern Ireland) Act 2002 (Amendment of section 46(1)) Order (Northern Ireland) 2014

The Department of Justice, in exercise of the powers conferred by section 46(6) of the Justice (Northern Ireland) Act 20021, makes the following Order:

Citation and Commencement1.

(1)

This Order may be cited as the Justice (Northern Ireland) Act 2002 (Amendment of section 46(1)) Order (Northern Ireland) 2014.

(2)

This Order shall come into operation on the day following the date on which this order is approved by resolution of the Assembly.

Amendment of the Justice (Northern Ireland) Act 20022.

(1)

Section 46(1) of the Justice (Northern Ireland) Act 20022 shall be amended as follows.

(2)

For paragraph (i), substitute –

“(i)

Health and Social Care Board and Health and Social Care Trusts,”.

(3)

For paragraph (j), substitute –

“(j)

the Central Investigation Service within the Department of Agriculture and Rural Development,”.

(4)

After paragraph (j) insert –

“(ja)

the Veterinary Service Enforcement Branch within the Department of Agriculture and Rural Development,”.

(5)

For paragraph (k), substitute –

“(k)

the Child Maintenance and Enforcement Division,”.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order revises section 46(1) of the Justice (Northern Ireland) Act 2002 to reflect the changing circumstances of the criminal justice system in Northern Ireland and the organisations that operate within it. Section 46(1) sets out a list of organisations that the Criminal Justice Inspection Northern Ireland (CJINI) has a duty to inspect. This Order

  • updates references to the Health and Social Services Boards and Health and Social Services Trusts, which has become the Health and Social Care Board and Health and Social Care Trusts, and to the Northern Ireland Child Support Agency which has become the Child Maintenance and Enforcement Division to take account of changes to those organisations’ titles (Articles 2(2) and 2(5));

  • removes a reference to the Compensation Agency and adds a reference to the Central Investigation Service within the Department of Agriculture and Rural Development (Article 2(3)); and

  • adds a reference to the Veterinary Service Enforcement Branch within the Department of Agriculture and Rural Development (Article 2(4)).
