The Road Traffic (Fixed Penalty) (Amendment) Order (Northern Ireland) 2013

Coming into operation
The Department of the Environment makes the following Order in exercise of the powers conferred by Article 59(1) of the Road Traffic Offenders (Northern Ireland) Order 19961.

In accordance with Article 91(1) of that Order the Department has consulted with such representative organisations as it thinks fit.

Citation and commencement1.

This Order may be cited as the Road Traffic (Fixed Penalty) (Amendment) Order (Northern Ireland) 2013 and shall come into operation on 18th February 2013.

Amendment of the Road Traffic (Fixed Penalty) Order2.

Schedule 1 to the Road Traffic (Fixed Penalty) Order (Northern Ireland) 20072 is amended as follows—

(a)

omit item 2; and

(b)

after item 9 insert—

“9A

A fixed penalty offence under section 1(6) of the Goods Vehicles (Licensing of Operators) Act (Northern Ireland) 20103

£200”

EXPLANATORY NOTE
(This note is not part of the Order)

This Order amends Schedule 1 to the Road Traffic (Fixed Penalty) Order (Northern Ireland) 2007 as a consequence of the implementation of the Goods Vehicles (Licensing of Operators) Act (Northern Ireland) 2010 (“the Goods Vehicles Act”) by omitting item 2 and re-introducing the fixed penalty offence as item 9A.
